江苏省律师协会成立于1981年6月，是由江苏省全体执业律师组成的全省性的律师自律性组织，目前协会共有608家团体会员（省辖市律师协会13家，直属分会1家，律师事务所594家），律师个人会员4429人。江苏省律师协会成立了理事会、监事会，并有13个工作委员会和12个业务委员会（包括民事业务委员会，涉外法律业务委员会，公司法业务委员会，金融证券业务委员会，知识产权业务委员会等）。江苏省律师协会的最高权力机构是律师代表大会，代表由会员民主选举产生。
协会的主要职责为：保障会员依法执业，维护会员的合法权益；总结、交流律师工作经验；制定行业规范和惩戒规则；组织会员业务培训和职业道德、执业纪律教育，对会员的执业活动进行考核；组织管理申请律师执业人员的实习活动，对实习人员进行考核；对会员实施奖励和惩戒；受理对会员的投诉或者举报，调处会员在执业活动和日常管理中发生的纠纷，受理会员的申诉；负责律师和律师事务所的对外宣传工作等。
协会成立至今，充分贯彻协会宗旨，以“三个代表”重要思想和科学发展观为指导，以维护宪法和法律的尊严、提高会员的执业能力和素质、维护会员在执业中的合法权益、促进江苏律师事业的健康发展为目的，为推进依法治国、建设“和谐江苏”、“法治江苏”，“全面达小康，建设新江苏”发挥了积极作用。

Jiangsu Bar Association
Jiangsu Bar Association (the association), as a self-discipline organization comprising all lawyers of Jiangsu Province, was founded in June, 1981. At present, the association has 608 group members (13 provincial city bar association、1 directly affiliated bar association and 594 law firms) and 4429 individual lawyer members. It sets up a Council, Board of Supervisors, 13 work committees and 12 practice sections (including Civil Practice Section, Foreign-Related Legal Practice Section, Corporate Law Practice Section, Finance & Security Practice Section, and Intellectual Property Law Practice Section etc). The supreme authority of the association is Lawyer Congress with representatives democratically elected by the members.
The fundamental duties of the association are to ensure the members to practice under the law and protect their rights and interests; to summarize and interchange experience of law practices; to develop vocational norm and disciplinary rules; to organize practice training and education of vocational moral and discipline for the members as well as to assess their practices; to organize, supervise and assess practice training of new applicants; to apply reward and punishment on the members; to accept complains against the members, conciliate disputes aroused from the members’ practice and daily management and accept appeals of the members, and to take responsibility for external propaganda of lawyers and law firms.
From the very beginning, the association fully implements its tenet, upon which it is established, under the instruction of “three represents” and scientific outlook on development. The association regards the protection of dignity of the Constitution and laws, the enhancement of capacity and quality of practice of the members, the safeguard of lawful rights of the members in vocation and the promotion of the development of lawyer business as its targets, and plays an positive role in accelerating the improvement of ruling the country by law and in building “harmonious Jiangsu”, “Jiangsu with Rule of Law” and “overall well-off society and a new Jiangsu”.

在经济全球化的世界里，中美经济对双方的重要性与日俱增。中美两国之间的贸易关系，直接影响到世界经济的发展，也成为中美两国关系的晴雨表。而随着经济全球化的深入，两国之间的经济关系具有很强的互利性和互补性。同时，在互相竞争中，又存在着各种各样的摩擦。其中知识产权保护，是夹在中美贸易中重要的一环，对双方都将产生重大影响。而中美经济贸易关系保持稳定，特别是在金融危机后，对两国乃至世界的经济稳定，都具有积极的意义。
为加深中美两国之间的了解，使中美双方有一个公正客观的认识，以促进交流和沟通，更好地帮助中国企业“走出去”，真正参与到国际贸易中来，江苏省律师协会定于2009年11月5日在南京举办美国国际贸易委员会、诉讼法专家专题研讨会（具体由江苏金鼎英杰律师事务所承办）。我们此次特别邀请到美国国际贸易委员会（ITC）决策者之一、委员Charlotte R. Lane（夏洛特•莱恩）阁下莅临南京，为中国企业解读近期中美贸易中出现的状况和趋势、影响中美贸易关系的因素、ITC制定、修改中美贸易关系战略的依据和原则等，并回答中美经贸关系中的热点问题。
Charlotte R. Lane（夏洛特•莱恩）阁下，法学博士，自1972年起便在西弗吉尼亚州的联邦和州法庭执业。她是经布什总统提名为美国国际贸易委员会委员，并得到美国参议院的确认。
由于近几年中国公司在美国国际贸易委员会被提起337条款调查的案件急剧上升，此现象已引起中国国内各界的关注。据统计，目前，超过50%的337条款调查案以中国企业为被告，其中包括很多江苏地区的生产制造、销售企业。而因为对337调查案不甚了解，对可能引起的后果未给予足够的重视，许多中国企业不去应诉，导致这些企业丢失了美国市场。根据337条款规定，如果被调查方被实施排除或/和禁止令，则其对美国的涉案进口产品将被没收或其将被禁止今后再次进口和在美国销售涉案产品。可见，被实施排除或/和禁止令的后果对中国公司的打击程度十分严重。
有鉴于此，我们特别邀请到对于ITC337条款调查案有着多年丰富经验的，美国奥睿律师事务所华盛顿办事处合伙人艾德楷(Steven Adkins)律师，就ITC 337条款调查案进行专门演讲，使中国企业了解ITC特别是337条款调查的基本情况、程序、如何应对、败诉后果以及补救措施等，并回答与会者的问题，以帮助中国企业做好走出国门前的准备工作，避免不必要的损失。同时，我们还邀请美国奥睿律师事务所洛杉矶办事处合伙人Rob Dickerson先生、美国奥睿律师事务所香港办事处律师郑慧恩女士对于美国联邦法院知识产权诉讼的各个方面包括与337条款调查案的关系等进行讲解，以期使中国企业对于美国的知识产权的行政司法救济手段有全面清醒的认识。
由于中国企业，特别是制造业和高科技企业，近年来越来越多地被卷入337调查案，此次活动，旨在为中国企业，特别是江苏省企业，与美国有贸易往来或可能有贸易往来（产品出口到美国或在美国设有分支机构等）的企业的领导、法务人员、技术人员、出口业务负责人、法律工作者等相关人员，提供一个近距离接触中美经贸关系问题专家的平台，详细了解企业走向国际市场所需要做的准备工作 （特别是知识产权战略），真正做到知己知彼，不打无准备之战。更重要的是，在一旦发生国际贸易纠纷后，尤其是与ITC、美国联邦法院有关的纠纷，如何采用两国的法律武器，维护自己的权益，并达到企业的商业目标。

美国国际贸易委员会
美国国际贸易委员会（简称“ITC”），前身为1916年创建的美国关税委员会，是一个独立的、非党派的、准司法的联邦机构。 其决策机构由六名委员组成，任何政党的委员均不得超过三名，全部经由总统提名、参院批准产生,任期九年。
ITC的主要职能，包括：（1）进口损害调查，即对受到反倾销及反补贴指控的进口产品对美国国内产业是否构成损害及损害程度进行调查；（2）知识产权有关的进口调查（即337调查），即对进口产品涉及侵犯知识产权、垄断等不公平贸易行为进行调查；（3）产业及经济分析，对主要进口国的产业及经济状况进行分析，制定相应的对策；（4）关税及贸易信息收集及整理，ITC主要收集贸易伙伴的关税及贸易方面的信息，为总统、国会提供相关信息及为公众提供信息查询服务；（3）协助制定贸易政策，ITC委派贸易专家协助总统、贸易代表及商务部制定有关贸易政策。
其中，337调查是指ITC根据美国《1930年关税法》第337节关于“如果‘对美国进口或在美国销售商品是采取不正当的竞争方法或不公平做法，且这种方法或做法产生的威胁或效果将对国内产业造成毁坏或实质性损害，阻止相关产业的建立，或者限制或垄断美国的贸易和商业’，那么这种方法或做法为非法。”的规定发起，具体由其行政法法官对是否存在侵权或违法行为做出初裁，该裁决要经过ITC的审查。如果ITC认定违反337条款，它可以发布排除令、禁止令或同时发布这两项命令。排除令要求海关与边境防卫局禁止侵权商品对美国的进口，不论这些产品是来自于何处（普遍排除令）或者特定实体的产品（有限排除令）。另外，涉案企业也可能被处以高额罚款。美国总统可以在60天内否决ITC的命令。对ITC裁决不服可以向美国联邦巡回法院提起上诉。
从2005年1月1日到2007年9月30日共发起88项新的337条款调查看；除三起外，其余都与专利侵权的指控有关，少数调查还涉及对其他知识产权的侵犯。由于大多数337条款案件在相对较短的时间内结案，其已经成为美国知识产权拥有人对付外国公司的一个强有力的法律工具，而最近几年大量针对中国企业的337条款调查案件更加证实了这一点。

United States International Trade Commission (ITC)
The United States International Trade Commission is an independent, quasijudicial Federal agency with broad investigative responsibilities on matters of trade. The agency investigates the effects of dumped and subsidized imports on domestic industries and conducts global safeguard investigations. The Commission also adjudicates cases involving imports that allegedly infringe intellectual property rights. Through such proceedings, the agency facilitates a rules-based international trading system. The Commission also serves as a Federal resource where trade data and other trade policy-related information are gathered and analyzed. The information and analysis are provided to the President, the Office of the United States Trade Representative (USTR), and Congress to facilitate the development of sound and informed U.S. trade policy. The Commission makes most of its information and analysis available to the public to promote understanding of international trade issues.
The mission of the Commission is to (1) administer U.S. trade remedy laws within its mandate in a fair and objective manner; (2) provide the President, USTR, and Congress with independent analysis, information, and support on matters of tariffs, international trade, and U.S. competitiveness; and (3) maintain the Harmonized Tariff Schedule of the United States (HTS).
The Commission has five major operations that serve its external customers:

² Industry and Economic Analysis
² Tariff and Trade Information Services
² Trade Policy Support
The USITC is headed by six Commissioners who are nominated by the President and confirmed by the U.S. Senate. No more than three Commissioners may be of any one political party. Currently three Democrats and three Republicans serve as Commissioners. The Commissioners serve overlapping terms of nine years each, with a new term beginning every 18 months.
The USITC staff of about 365 individuals includes international trade analysts (investigators and experts in particular industries), international economists, attorneys, and technical support personnel.

Charlotte R. Lane 委员
Charlotte R. Lane是西弗吉尼亚州共和党员，2004年11 月21日被布什总统提名为美国国际贸易委员会委员并得到美国参议院的确认，任期于2009年12月16日结束。其经参议院休会任命之后，自2003年8月27日起担任委员。
在此之前，Lane委员于1997年至2003年是西弗吉尼亚州的公共服务委员会成员，并在1997年至2001年期间担任该委员会主席，之前其曾于1985年至1989年担任西弗吉尼亚州公共服务会委员。
Lane委员于1979年至1980年、1984年和1990年至1992年系西弗吉尼亚州卡瓦纳郡州参议院成员。
Lane委员自1972年起便在西弗吉尼亚州的联邦和州法庭执业。其还是1987年西弗吉尼亚州南区的临时美国联邦检察官。

Charlotte R. Lane
Commissioner of ITC
Charlotte R. Lane, a Republican of West Virginia, was nominated to the U.S. International Trade Commission by President George W. Bush and confirmed by the U.S. Senate on November 21, 2004, for the term ending December 16, 2009. She served as a Commissioner from August 27, 2003, through her Senate confirmation under a recess appointment.
Prior to her appointment, Commissioner Lane served as a member of the West Virginia Public Service Commission from 1997 to 2003 and was Chairman of that Commission from 1997 to 2001. She previously served as a Commissioner on the West Virginia Public Service Commission from 1985 to 1989.
Commissioner Lane served as a Member of the West Virginia House of Delegates from Kanawha County in the years 1979 to 1980, 1984, and 1990 to 1992.
Commissioner Lane has practiced law since 1972 in federal and state courts in West Virginia. She also served as Interim United States Attorney for the Southern District of West Virginia in 1987.
Commissioner Lane has been active in local and state organizations and previously served as president of the West Virginia Bar Association, president of the Charleston Rotary Club, and president of the Mid-Atlantic Conference of Regulatory Utility Commissioners.
Commissioner Lane holds a Bachelor of Arts degree from Marshall University and a Juris Doctor degree from West Virginia University
