XXXXXXXXXXXXX有 限 公 司 劳 动 合 同 书 Labor Contract 甲方Party A: 乙方Party B: XXXXXXXXXXXXXXX 文化程度Education: 法定代表人member as of Right 出生日期Date of Birth: 年 月 日 或委托代理人or Authorized person : 居民身份证号码ID No.: 甲方地址Address: 家庭住址Address: XXXXXXXXXXXXXXX 所属街道办事处registered region: 依据《中国劳动法》、 《中国劳动协议法》、 《山东省劳动协议条例》, 甲乙双方经平等协商同意, 自愿签署本协议, 共同遵守本协议所列条款。 According to People’s Republic of CHINA Labor Law, People’s Republic of CHINA Labor Contract Law and Province Labor Contract Regulation, party A and party B are willing to sign the contract on the basis of fair discussion and agreement and comply with it. 一、 劳动协议期限 Contract Period 第一条 本协议期限类型为 无固定 期限协议, 开始时间为 。(依据劳动法可签署固定时限协议, 或无固定时限协议) This contract is non-fixed period contract, starting date is (According to Labor Law there could be fixed or non-fixed period labor contract). 二、 工作内容 Work Contents 第二条 乙方同意依据甲方工作需要, 担任指定 岗位(工种)工作, 以及其她由甲方指定兼职员作和临时工作。乙方工作地点为: xxxxx路1号。 Party B is willing to work as according Party A’s requirements and other part-time and temporary work required by Party A. Work place: No.1 Wild Road, Development Zone, Rizhao. 第三条 乙方必需根据甲方正当要求, 按时完成要求工作数量, 达成要求质量标准。 Party B should fulfill all the work in time and by quality standard according to Party A’s legal requirements. 三、 劳动保护、 劳动条件、 工作时间和休假 Work Protection, Condition, Time and Leaves 第四条 甲方安排乙方实施8小时/日工作制, 甲方依法确保乙方休息权利。乙方在劳动协议推行期间依法享受法定节假日以及探亲假、 婚丧假、 产假、 带薪年假等休假权利。 甲方安排乙方每日工作时间不超出8小时, 每七天工作5天, 平均每七天不超出40小时。甲方确保乙方每七天休息二天。因特殊原因需要延长工作时间, 在保障乙方身体健康条件下, 甲乙双方友好协商实施, 标准上每个月不超出二十四小时。 There are 8 working hours per Day. Party A promises rest time to Party B according to the laws. Party B has the right to enjoy the legal vacation, home leave, marriage and mourning leave, maternity leave and legal paid vacation, etc. Party A arranges Party B to work maximum 8 hours per day and 5 days every week, and the average work hours per week should be not more than 40 hours. Party A gives Party B 2 days vacation every week. Because of special reasons Party B needs to work over-hours on the basis of normal health condition, after agreement of two parties. Basically it should not be more than 24 hours every month. 第五条 甲方安排乙方加班, 应安排乙方相同时间补休或依法支付加班工资; 加点, 甲方应付加点工资。 If party A requires party B to do overtime work, Party A should give the equal time leave in some other time or give overtime payment according to law; if party B needs to work in extension hours, Party A should pay for the extension hours. 第六条 甲方为乙方提供必需劳动条件和劳动工具, 建立健全生产工艺步骤, 制订操 作规程、 工作规范和劳动安全卫生制度及其标准。 Party A should provide the necessary work conditions and tools, build up complete production process and make operation regulations, rules and safety system and standards. 第七条 甲方负责对乙方进行政治思想、 职业道德、 业务技术、 劳动安全卫生及相关规章制度教育和培训。 Party A should arrange to give the necessary training for Party B about political thoughts, professional morality, operation skills and operation safety and regulations. 四、 劳动酬劳 Work payment 第八条 乙方应根据甲方要求完成对应工作, 甲方应依据按劳分配、 效率优先、 兼顾公平标准, 根据国家要求和甲方依法制订工资分配措施等规章制度按月以货币形式支付乙方工资, 企业每个月7日前为职员支付上月工资(遇节假日则顺延)。甲方支付乙方工资标准为: 元/月。工资额度必需对第三者保密, 甲乙双方都应严格遵守。 Party B fulfills the work according to the requirements of Party A. Party A should give the payment in cash every month according to national law and party A’s salary payment regulation on the basis of working, efficiency priority with due consideration to fairness. Every month before 7th, Party A should pay Party B’s salary for last month. Party B’s salary is Yuan/Month. Both parties must keep the salary as a confidential matter to third party. 第九条 因为甲方生产任务不足, 使乙方待岗, 甲方确保乙方月生活费不低于日照市最低生活保障。 If Party A doesn’t have enough work task and Party B have no work to do, Party A should gives Party B the living allowance which should not be less than Rizhao Minimum living guarantee. 五、 保险福利待遇 Insurance and welfare 第十条 甲乙双方应按国家和山东省社会保险相关要求交纳职员养老、 失业和大病医疗统筹及其她社会保险费用。乙方应缴纳部分根据法律法规应有甲方代扣代缴, 由甲方从乙方工资中代为扣缴。 甲方应为乙方填写《职员养老保险手册》。双方解除、 终止劳动协议后, 《职员养老保险手册》按相关要求转移。 Party A and Party B should pay endowment insurance, unemployment insurance and serious illness insurance and other social insurance as national and province regulations about insurance. The Part which should be paid by Party B should be withheld from salary by Party A. Party A should fill in Employee Endowment Insurance Handbook for Party B. After the termination of the contract, Employee Endowment Insurance Handbook should be handed over according to relevant regulations. 第十一条 乙方患病或非因工负伤, 其工资根据国家已经制订相关要求实施。 If Party B gets ill or gets hurt not because of work, then his/her salary should be calculated according to relevant national regulations. 第十二条 乙方患职业病或因工负伤工资和医疗保险待遇根据国家和山东省相关要求实施。 If Party B gets occupational disease or gets hurt because of work, then his salary and medical insurance should be calculated as relevant national and province regulations. 六、 劳动纪律 Work Disciplines 第十三条 乙方应遵守甲方依法制订规章制度, 严格遵守劳动安全卫生、 生产工艺、 操作规程和工作规范, 以及《劳动协议附件及职员保密协议书》, 珍惜甲方财产, 遵守职业道德; 主动参与甲方组织培训, 提升思想觉悟和职业技能。 Party B should follow Party A’s disciplines and rules, following close to the line of operation safety requirements, process, operation rules and regulations, Appendix to Labor Contract and Employee Secret-Keeping Agreement. Party B should protect company’s property, follow professional morality; Party B should be active to attend the training organized by Party A to increase professional skills. 第十四条 乙方违反劳动纪律, 甲方可依据本单位规章制度, 给予纪律处分, 直至解除本协议。 If Party B violates disciplines or regulations, Party A could give the penalty according to the company’s regulation or rules, or even to end the contract. 七、 劳动协议变更、 解除、 终止、 续订 Change, terminate, end or renew the contract 第十五条 签订本协议所依据法律、 行政法规、 规章发生改变, 本协议应变更相关内容。 If the relevant laws, regulations or rules have changed, this contract will be changed accordingly as well. 第十六条 签订本协议所依据客观情况发生重大改变, 致使本协议无法推行, 经甲乙双方协商同意, 能够变更本协议相关内容。 If the objective circumstance has changed a lot, which makes it not possible to continue this contract; after agreement of the two parties, the contract could be modified accordingly. 第十七条 乙方有下列情形之一, 甲方能够解除本协议: Party A could end the contract with Party B, If Party B: 1.在试用期间, 被证实不符合录用条件; It is proved during the probation period that Party B is not qualified for the work and employment; 2. 严重违反劳动纪律或甲方规章制度; Materially violate Party A’s rules and regulations; 下列行为属于严重违反甲方劳动纪律或规章制度行为: Those following actions belong to materially Violation: (1)在工作期间饮酒; Drinking during the work time; (2)连续旷工超出15天或一年内累计旷工超出30天; Absent from work continue for 15 days or more than 30 days total a year. (3)乙方是驾驶员, 因其本身原因, 其营运服务证、 照被吊扣或失效15天(含)以上或发生行车事故次要责任(含)以上; If Party B is driver, because of his mistake, the car or car license is caught by police or go out of valid period for more than 15 days (including), or in accident Party B take more than subordinate responsibility (including). (4) 在工作场所打架斗殴、 妨碍干扰正常工作秩序及违犯社会治安管理条例; Fight on working place, disturb normal working system, and violate society safety management regulation. (5) 乙方以欺诈、 胁迫手段, 使甲方在违反真实意思情况下签订或者变更协议; Party B sign or change the contract with party A without the willing the Party A by cheating or threating. (6) 在劳动关系存续期间, 与其她用人单位(或个人)建立劳动关系或发生劳务关系; During the contract Period, Party B does work for any other third employment Party. (7) 在工作期间搞其她产业或第二职业。 During work time, Party B does other work or secondary job. (8) 乙方在招聘录用时所填个人履历和档案等相关内容不真实, 提供虚假信息。包含但不限于: 离职证实、 身份证实、 户籍证实、 学历证实、 体检证实等是虚假或伪造; 应聘前患有精神病、 传染性疾病及其她严重影响工作疾病而在应聘时未申明 Party B gives the false information when filling in the Company Entrance Form, including but not limited to, Dimission Prove, ID prove, Residence Prove, Education Prove, Physical Checking Prove; have serious mental disorder, infected illness or other illness which affects his work. 3. 严重渎职、 营私舞弊, 对甲方利益造成重大损害((包含但不限于因个人有意或过失, 一次给甲方造成3000元以上损失或连续12个月内累计造成5000元损失); Commits serious dereliction of duty or practices graft, causing substantial damage to the Party A (including but not limited to the loss of 3000Yuan by one time or total 5000Yuan within continue 12 months caused by Party B’s deliberately or fault) ; 4, 被依法追究刑事责任。 Has his criminal liability pursued in accordance with the law. 第十八条 下列情形之一, 甲方能够解除本协议, 但应提前三十日以书面形式通知乙方: If one of the following situations applies, Party A could terminate the contract, but has to inform Party B 30 days in advance by written: 1、 乙方患病或非因工负伤, 医疗期满后, 不能从事原工作也不能从事由甲方另行安排工作; After the recovering period of medical care for an illness or non-work-related injury, Party B can engage neither in his original work nor in other work arranged for him by Party A. 2、 乙方不能胜任工作, 经过培训或者调整工作岗位, 仍不能胜任工作; Party B is incompetent and remains incompetent after training or adjustment of his position. 3、 双方不能依据法律律要求和本协议约定就变更协议达成协议。 Two parties can not reach the agreement to modify the contract as law or this contract. 第十九条 甲方濒临破产进行法定整理期间或者生产经营发生严重困难, 经向工会或者全体职员说明情况, 听取工作或者职员意见, 并向劳动行政部门汇报后, 能够解除本协议。 During restructuring period pursuant to the Enterprise Bankruptcy Law or Serious difficulties in production and/or business operations, after Party A has explained the situations to its Labor Union or to all of his employees, and has considered the opinions of the Labor Union or the employees and has subsequently reported to the labor administration department, Party A may terminate the contract. 第二十条 乙方有下列情形之一, 甲方不得依据本协议第十八条、 第十九条终止、 解除协议: Party A may not terminate an employment contract pursuant to Article 18 or Article 19 hereof if Party B: 1、 患病或非因工负伤、 在要求医疗期内; Has contracted an illness or sustained a non-work-related injury, and the recovering period of medical care therefore has not expired; 2、 女职员在孕期、 产期、 哺乳期内; Is a female employee in her pregnancy, maternity or breast feeding period 3、 在本单位连续工作满十五年, 且距法定退休年纪不足五年; Has been working for the Employer continuously for not less than 15 years and is less than 5 years to his legal retirement age 4、 法律法规要求其她情形。 Other situations pursuant to Laws or regulations 第二十一条 乙方患职业病或因工负伤, 医疗终止, 经市、 区、 县劳动判定委员会确定完全或部分丧失能力, 按劳动协议法相关要求办理, 不得依据本协议第十八条、 第十九条解除劳动协议。 Party B Has been confirmed as having complete lost or partially lost his ability to work due to an occupational disease contracted or a work-related injury sustained with the Employer, after diagnosed by City, Zone, County Labor authentication Committee ,Party A should not terminate the contract as Article18,19, but should follow relevant regulations. 第二十二条 乙方解除本协议, 应该提前三十日以书面形式通知甲方。 If Party B wants to terminate the contract, he/she should inform Party A by written 30 days in advance. 第二十三条 有下列情形之一, 乙方能够随时通知甲方解除本协议: Party B may terminate the contract in any time under the one of the following situations: 1、 在试用期内; During the probation period 2、 甲方以暴力、 威胁或者非法限制人身自由手段强迫劳动; Party A forces or threats Party B to work or illegally restrict freedom of Party B. 3、 甲方不能根据本协议要求支付劳动酬劳或者提供劳动条件。 Party A can not pay or provide work conditions as Contract. 第二十四条 本协议期限届满, 甲乙双方经协商同意, 能够续订劳动协议。 After the termination of the contract, Party A and Party B could renew the contract after discussion and agreement. 第二十五条 签订无固定时限劳动协议, 乙方离休、 退休、 退职及死亡或本协议约定解除条件出现, 本协议终止。 If the contract is open-ended contract, when Party B has leaved, retired, died or other factors which would end the contract as we mentioned in the contract, this contract can terminate. 第二十六条 乙方确保在与甲方签订劳动协议时, 已熟知甲方各项规章制度, 并确保在任职期间认真学习甲方制订各项规章制度。 Party B should promise that he has know all the rules and regulations of Party A when he signs the contract and promise to learn all the rules and regulations during work period. 八、 劳动争议处理Disputation settlement 第二十七条 因推行本协议发生劳动争议, 当事人能够向本单位劳动争议调解委员会申请调解; 调解不成, 当事人一方要求仲裁, 应该自劳动争议发生以后向劳动争议仲裁委员会申请仲裁。当事人一方也能够直接向劳动争议仲裁委员会申请仲裁。对裁决不服, 能够向人民法院提起诉讼。 If there is any labor disputation during the performance of the contract, the party could apply for the settlement to company intermediation department. If it still can not been settled and one party wants arbitration, then he should apply for arbitration to Labor Arbitration Committee after the disputation. The party also could ask for the arbitration directly. If one party is not agreed to the arbitration, he could go to the court. 九、 其她Others 第二十八条 本协议未尽事宜或与以后国家、 山东省相关要求相悖, 按相关要求实施。 Those items which have not mentioned in this contract or go against with future national and province regulations would be performed as relevant regulations. 第二十九条 本协议一式两份, 甲、 乙双方各执一份。 This contract has two copies, one for each party. 甲方Party A(盖章stamp) 乙方Party B(签章stamp) 法定代表人Member as of right 或委托代理人(签章) or Authorized person(signature) 签署日期Date: 年 月 日
