甲、 乙双方经过友好协商一致签订本协议, 以资共同遵守。

一、 物业地址:
甲方将其全部位于上海市房屋及隶属设施在良好状态下出租给乙方 使用。

四、 定金
1、 乙方应付定金为元整, 乙方于年月日以前支付给甲方定金累计元整。
2、 在本协议签定以后至租期开始之前如甲方违约, 则上述定金由甲方双倍返还乙方, 如乙方违约则定金由甲方没收。定金赔偿不影响违约金索赔。
3、 租期开始以后, 上述定金全额自动转化为:

五、 租金
1、 数额: 双方议定租金为每个月元整, 乙方以方。汇率按支付当日中国人民银行公布之外汇官方牌价中间价计。

租金按个月为壹期支付, 第一期租金于以后每期租金于 日前缴纳, 先付后住（若乙方以划帐形式支付租金, 则汇出日为支付日, 汇费由汇出方负担）, 甲方收到租金后应给予书面签收。
4、 如乙方逾期支付租金, 则须支付天天相当于月租金百分之一滞纳金; 若逾期且在经甲方正式通知后仍未付租金总计超出拾个工作日, 则视为乙方自动退租, 组成违约, 甲方有权收回房屋, 并追究乙方违约责任。

1、 amount : the rental agreed upon by both parties shall be by transferring the amount of such rent to a bank account designated by party a in according to the official standard rate at payment day.

4、 if party b delays such rental payment, the interest would be imposed on overdue account at a
daily rate of 1%of month rental. after formal informing by party a, if party b still delays in the excess of ten working days, it shall deemed as automatically quitting tenancy, which shall constitute of contract.
六、 确保金
1、 为确保房屋及其隶属设施之安全与完好及租赁内相关费用之准期结算, 乙方同意于
年 月 日之前支付给甲方元整。作为乙方确保协议之确保金。甲方在收到确保金后应给予书面签收。
2、 除协议另有约定之外, 甲方应于租赁关系消除且乙方迁空、 点清、 并付清全部应付费用
后, 当日将确保金全额无息退还乙方。
3、 因乙方违反本协议要求, 而产生违约金、 损害赔偿以及应付租金及相关费用, 甲方
可在确保金扣抵, 不足部分乙方必需在接到甲方付款通知后十天内补足。
deposit of security:
1、 to ensure that the house and its accessory facilities are safe and in good condition and that
accounts of relevant fees are settled on schedule during the term of lease, party b agrees to pay to party a security for fulfilling to contract. after receiving the deposit ,party a should sign a written receipt.
2、 unless otherwise agreed upon, party a should return to party b the full amount of deposit of
security interest free on the day lease is dissolved and party b has vacated the house ,left everything in the house intact and paid up all expenses due.
4、 any penalty for breach of contract, compensation for damage and rental and other relevant
fees payable arising from party b’s violation of the provisions of the contract may be made up for by party b within ten days of the receipt of the notice of payment issued by party a.
七、 其她费用
1、 乙方应负担租赁期内水费、 电费、 煤气费、 通讯费和其她由乙方实际使用而产生费
用, 并按单准期缴纳。
2、 地租、 房产税、 租赁所得税、 房屋维修费、 物业管理费等原由甲方支付费用, 仍由甲
方负担。
other fee:
1、 party b should bear the water, electricity, gas and communication fees and all other fees
incurred by party b in actual use and pay the bills on schedule during the term of lease.
2、 the land rent, house tax, income tax and house maintenance fee, management fees that were
originally payable by party a shall continue to be paid by party a.
八、 甲方义务:
1、 甲方须按时将房屋及隶属设施交付乙方使用。
2、 房屋设施如因质量原因, 自然损耗或灾难而受到损坏时, 甲方有修缮责任并负担相关
费用。
3、 甲方应确保所出租房屋享受出租权利, 如在租赁期内, 该房屋发生全部权全部或部
分转移、 设定她项物权或其她影响乙方权益事情时, 甲方应确保全部权人, 她项权利人或其她影响乙方权益第三者能继续遵守本协议全部条款, 反之如乙方权益所以而遭受损害, 甲方应负赔偿责任。
obligations of party a:
1、 party a shall turn over the house and accessory facilities (see the appendix for detail) on
schedule to party b for use.
2、 party a shall be responsible for repairing any damage of the house due to poor quality, natural
tear and wear or calamities and bear the expenses thereof.
3、 party a should ensure that the house let out is entitled, to the lease. if all or part of the
ownership of the house is transferred, other rights item are settled, or any other happening affects the rights and interests of party b during the leasehold, party a should guarantee that the owner, person to the rights item or any other third party that affects the rights and interest of party b continue to abide by all the articles of the contract. otherwise, party a shall be liable for compensating to loss to the rights and interests suffered by party btherefrom.
九、 乙方义务:
1、 乙方应按协议要求, 按时支付租金、 确保金及其她各项应付费用。
2、 乙方经甲方同意, 可在承租用房内进行装修及添置设备。租赁期满后, 乙方可将添置
可拆动动产部分自行拆运, 并确保不影响房屋完好及正常使用。
3、 未经甲方同意, 乙方不得将承租房屋转租或分租, 并珍惜使用租赁房屋。如因乙方
过失或过失致使房屋及设施受到损坏, 乙方应负赔偿责任。
4、 乙方应按本协议约定正当使用租赁房屋, 不得私自改变使用性质, 不应存放危险物品,
如所以发生损害, 乙方应负担全部责任。
obligations of party b:
1、 party b should pay the rental, deposit of security and other fees payable on schedule
according to the provisions of the contract.
2、 party b may, upon approval by party a , fit up the rented house and add equipment therein
during the leasehold. upon expiration of the leased hold, party b may remove the added part of property that is removable, but it must ensure that the house is in good condition for normal use.
3、 party b must not transfer the lease ofthe house it has rented or sublet it without the
approval by party a. party b should take good care of the house rented. party b shall be liable for compensating for any damage caused to the house and facilities due to party b’s fault or misuse.
4、 party b should use the rented house lawfully according to the provisions of the contract. it
must to not change the nature of the use of the house without authorization. no hazardous materials and goods shall be allowed to be kept in the house. if any damage is attributable to such use, party b shall fully liable.
十、 协议终止及解除要求:
1、 乙方在租赁期满后, 乙方有优先承租权, 如需续租, 应提前两个月通知对方, 由双方另
行协商续租事宜。
2、 租赁期满后, 乙方应在天内将承租房屋交还甲方, 如有留置任何物品, 在未
取得甲方谅解之下, 均视为放弃, 任凭甲方处理, 乙方决无异议。
3、 本协议一经双方签字后立刻生效, 未经双方同意, 不得任意终止, 如有未尽事宜, 甲、
乙双方可另行协商。
termination and dissolution of the contract:
1、 if party b intends to renew the leased hold upon its expiration, it should notify party a of such
intention two month in advance. then, the two parties shall discuss matter over the renewal of leasehold.
2、 upon the expiration of the leasehold, party b should turn the rented house back to party a
days. any belongings left behind in the house shall, without obtaining previous understanding of party a, be deemed as things given up by party b and shall be disposed of by party a at its discretion, to which party b shall raise no objection.
3、 this contract shall go into effect the moment it is signed by both parties. it must not be
terminated at will without the approval of both parties. anything not covered in the contract shall be discussed separately by party a and party b.
十一、 违约处理:
1、 甲乙任何一方如未按协议条款推行, 造成中途终止协议, 而且过失方在未取得对方谅
解情况下, 则视为违约, 双方同意违约金为 元整。若违约金不足填补
无过失方之损失, 则违约方还需就不足部分支付赔偿金。
3、 凡在实施本协议或与本协议相关事情时双方发生争议, 应首先友好协商, 协商不成,
可向有管辖权人民法院提起诉讼。
handing of breach of contact:
1、 if failure of either party a or party b to fulfil the articles of the contract before its expiration,
the party at fault shall be deemed as violating the contract without obtaining the understanding of the other party. the two parties agree that the penalty for breach of contract shall be .in case such penalty is not sufticient to make up for the loss suffered by the faultless party. the party that has violated the contract shall pay additional compensation.
3、 any dispute arising from execution of the contract or in connection with the contract should
be settle through friendly discussion between the two parties. if no settlement can be reached through discussion, both parties shall have the right to sue with the people’s court, which has jurisdiction over the matter.
十二、 其她:
1、 本协议附件是本协议有效组成部分, 含有相同法律效力。

房屋租赁协议
tenancy agreement
一、 出租人（以下简称甲方）
landlord (hereinafter referred to as party a)
二、 承租人（以下简称乙方）
tenant(hereinafter referred to as party b)
三、 租赁范围及用途
tenancy:
甲方同意将其全部位于 北京市朝阳区光华路2号阳光100座 室房屋及其设施（包含家俱和电器）在良好及可租赁状态下租给乙方为 居住 使用, 出租房面积总计约 110平方米。
party a hereby agrees to lease its property located at and the related facilities(including furniture and appliances) in good tenantable condition to party b for size of the leased property is approximatelyspm.
四、 租赁期:
term of tenancy:
4.1 租赁期为年, 自年月日起至 月 14 日止。
续租或退租, 应提前壹个月通知甲方。
upon expiration of the tenancy, party a has the right to take back the entire leased property, and party b shall deliver the leased property to party a on time. alternatively, party b have the opton to renew this agreement or quit this agreement upon giving one month prior notice to party a before the expiration of this agreement.
五、 租金及付款方法
rent and the way of payment
5.1 双方谈定租金为每个月元。

if the rent remain being unpaid on time, party b shall be liable to pay a late penalty fee equal to 0.5﹪ of the month rent per day.
六、 确保金（押金）:
security desposit:
6.1 为确保出租房屋及其设施之安全并完好及租赁期内相关费用之准期结算,
乙方同意于签署协议当日支付给甲方租赁押金5300元作为乙方确保协议推行之确保金。 to ensure the welfare and good condition of the leased property and the related facilities as well as the prompt payment and settlement of all related charges durning the term of tenancy, party b agrees to pay to party a within one day after the agreement signed a security desposit in the amount of as security for party b’s obligations hereunder.
6.2 除协议另有约定外, 乙方应于租赁期满之日与甲方点清室内设施, 并付清 全部应付费用后, 甲方当日将确保金全额无息退还乙方。
unless other provided in agreement, party a shall return to party b the entire security desposit without interest thereon upon expiration of the tenancy or sooner determination of this agreement after party b settled all charges of leased property with party a.
七、 费用担保:

7.1租赁期间物业费和取暖费由甲方负担。durning the term of the tenancy, the property management fees and the
heat-preservation fees shall be paid by party a.
7.2房屋冷、 热水、 电、 天然气消耗按每个月查表实数由乙方支付。
the cold, hot water, electricity, and gas payment(for water and tear) of the property shall be paid by party b according to its actual payment per month.
7.3电话费、 有线收视费按实际费用由乙方交付。
party b according to its zctual payment shall pay the payment for telephone and international channel.
八、 出租人责任
landlord’s obligations:
8.1 甲方须按时将出租房屋及其设施以良好状态交付乙方使用。
party a shall deliver the leased property and the related facilities in good condition to party b on schedule.
8.2租赁期内甲方不得收回出出租房屋（除非本协议另有要求）
party a shall not take back the leased property durning the term of the tenancy.(unless otherwise stipulated in this agreement)
8.3在乙方遵守本协议条款及交付租金前提下, 乙方有权于租赁期内拒绝 甲方或其她人骚扰而平静享用出租房屋。
provided that party b abides and performs the appendixes of the agreement and the payment for the tenancy, party b has the right to refuse the interruption from party a to enjoy the life satisfaction and peace.
8.4房屋基础设施和结构, 甲方有修缮责任并负担相关费用, 并对其做定
期修缮。party a is responsible for repairing and maintaining the basic facilities of the
leased property and for bearing all costs thereto.
8.5 甲方谨在此申明及确保甲方为出租房屋正当拥有些人并由正当地位出租此 房屋与乙方。
party a hereby represents and warrants that party a is the legal owner of the leased property and has the necessary legal capacity to lease the property to party
b.
8.6如在租赁期内, 租赁房屋发生全部权全部或部分转移、 或其她影响乙方权
益事情时, 甲方应确保全部权人或者其她影响乙方权益第三者, 能继续遵守本协议全部条款, 如乙方与本协议权益人首次等全部权人或第三者所影响或损害, 甲方须负责任赔偿乙方全部损失、 损害、 支出及费用。if durning the term of the tenancy, all or part of the leased property is
transferred or party b’s right to use the leased property is attested, party a shall ensure that such transferee or third party having an effect on party b’s right to use the leased property will continue to abide by the terms of this agreement.party a shall also be liable to keep party b be fully indemnified against any costs,expenses,losses, and damages suffered by party b if any of party b’s interests herein are affected or prejudiced by a third party.
九、 承租人责任:
tenant’s obligatons:
9.1 乙方应按协议要求, 按时支付租金, 确保金及其她各项应付费用。
party b shall be responsible to pay all rents and fees in at timely manner according to the terms of the contract.9.2 乙方经甲方事先同意, 可在负担租用房内进行装修及添置设备, 租赁期满
必需恢复原状（正常损耗除外）, 并负担其费用, 经甲方验收认可后归还甲方。
party b with the prior consent of party a, can renovate and install additional facilities in the leased property.upon expiration if the tenancy the leased property shall be resumed to party a in its original conditions (fair wear and tear exempted)and all expenses arising there from shall be borne by party b.
9.3 乙方应珍惜使用租赁房屋, 如因乙方过失或过失致使房屋及设施受到 损失（正常损耗除外）乙方应负赔偿责任。
