Lease Contract
Lessor(hereinafter referred to as Party A): NAME ( ID Number:*************)
Lessee(hereinafter referred to as Party B): **** (ID Number: ****************)
According to Economic Contract Law of the Peoples Republic of China, both parties have reached a lease contract based on free equality and free will. The contract is as follows:
1. Party A will lease to Party B the commodity house which is located at****************.
2. Lease term totals__**__ years, commencing from ** to ** . Party A may take over the house on the day of which the contract expires. Party B shall deliver the written notice to Party A 6 months prior to the expiration of this contract if Party B intends to carry over the contract, whose rental shall be adjusted again.
3. The rental is RMB ____****___ per year, totals RMB __****___ which shall be a plump-sum payment, and Party A lease ** years housing use right.
4. The contract will become effective once signed by both parties. Party B has to pay off the entire rental within 3 months according to the contract. Otherwise, party B will be charged 0.5%penal sum. Party A is deemed to take over the house if party B can not pay off the entire rental within 6 months.
5. Party B will be responsible for payment of water, electricity and heating fees which will be charged according to the standard price of Chongqing. Party A takes no responsibility if there’s any effect due to Party B’s delay payment.
6. Rights and Obligations:
6.1 Party A ensures that the premises and other facilities rented to Party B are real, legal and valid. Party B will use the premises lawfully according to this contract without changing the nature of the premises. Any change of the premises and facilities should get Party A’s approval.
6.2 The rent cannot be increased during the term of this tenancy Agreement. Party A can only renew the rental when the contract expires, and the new rental can not exceed the average market price.
6.3 Party B can transfer the lease of the premises lawfully with Party A’s approval.
6.3Party B must take care of the property and its contents, and use them exactly according to the specific instructions; otherwise Party B should pay for the compensation and repairing fees to Party A for its improper use of the property. Upon the expiration of the lease term or when this contract is terminated in advance, Party B shall return the premises recovered to their original condition to Party A upon expiration of this term.
6.5 When the contract ends, Party B should pay off all the water, electricity and heating fees before delivering the premise to Party B.
6.6 Facilities which are connected to the house like water route, electric circuit, heating and air conditioning belong to party A. Party B can remove improvements, decorations or additions to the premises when the contract expires.
7. Party B must ensure its product is line with environment requirements of the country and be responsible to any possible effects.
8. Party B can only change the structure of the premises with the approval of Party A and undertake the cost. In case Party B terminates this contract during the term without obtaining the written approval from Party A, Party B should compensate Party A’s losses and pay a penalty equals to 6 monthly rental to Party A, vice versa.
9. This contract may be terminated during the term due to the force majeure causing the non-performance of this contract, and the Parties shall not assume any liability onto each other.
10. Party B will strictly carry out relevant law and regulations on safety in production of the country and undertake the loss caused by unsafe production, fire and security, and make a reasonable compensate for party A and the third party.
11.Any disagreement about the contract shall be negotiated and determined by both Parties upon mutual agreement by way of supplementary agreement. If there’s uncoordinated conflict, both parties can propose a lawsuit to People’s Count of Chongqing.
12. This contract shall be in duplicate copies, with one copy for each of the Parties, and shall take effect upon affixation there to of the signatures and seals of the Parties.
