Before the signing of this Contract, Party A has already informed Party B that the Property has been subject to a mortgage.1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况
7、和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The area and the use of the public or common part of the Property; the existing fixtures, facilities, condition of equipment and the contents, standard and other relevant matters to be ascertain

10、 Municipality in relation to the use and management of Property.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。Party B guarantee that during the lease term, it shall not alter the purpose of the Property without Party As prior written consent as well as the approval from the relevant governme

16、plementary provision.-五、保证金和其他费用Deposit and Other Fees and Charges5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为贰个月的租金,即人民币 元,(大写:人民币 圆整 )。甲方收取保证金后应向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分一周内无息归还乙方。Party A and Party B have agreed that at the time of the hand over of the Property by Party A, P

18、remaining deposit of the lease of the Property obtained by Party A shall be refunded to Party B after setting off the fees and expenses borne by Party B under the Contract without interest within one week.5-2租赁期间,使用该房屋所发生的水、电、煤气、每月房屋租赁税费,通讯费用及ADSL使用费由 乙方 (甲方/乙方)承担。其他物业管理费、有线及卫星电视收视费和小区的家庭会所卡,均由甲方(甲方

21、epartments, if delaying payment, Party B should be responsible for the penalty.六、房屋使用要求和维修责任Standard Required for Use of Property and Responsibility of Property Maintenance and Repair6-1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的 两 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。During the lease term, if Party B
22、 discovers any damages or defects of the Property and facilities attached, it shall notify Party A immediately for repair. Party A shall carry out the repair within two days after receiving notification from Party B. Any delay in repair may be repaired by Party B on Party As behalf and the expenses
23、incurred shall be borne by Party A.七、房屋返还时的状态Condition of Property at Delivery Back7-1除甲方同意乙方续租外,乙方应在本合同的租期届满后的 次 日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按0.5%向甲方支付该房屋占用期间的使用费。Except for the renewal of lease agreed by Party A, Party B shall deliver up the Property within second day after the expiration of le
24、ase term of this Contract. Late delivery of the Property without the consent of Party A shall be subject to a charge for adverse possession of the Property at 0.5% time of rent per day.7-2乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互结清各自应当承担的费用。The Property at the time of delivery up by Party B shall be of a

The delivery up shall be examined and authorized by Party A and the fee and charges responsible by the parties shall be cleared at the time of delivery up.八、转租、转让和交换Sublease, Assignment and Exchange8-1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方同将该房屋部分或全部转租给他人。但同一间居住房屋,不得
26、分割转租。Unless otherwise agreed in the supplementary clauses of this Contract, Party B shall obtain the written approval from Party A before it could sublease part or all of the Property to a third party during the lease term. Party B shall not sublease part of the Property or sublease to two lessees o
27、r more than two lessees at the same time.九、解除本合同的条件Conditions for Terminating this Contract 9-1甲、乙双方同意在租赁期内,有下列情形之一的,本合同终止,双方互不承担责任:Party A and Party B have agreed that during the lease term, this Contract shall be terminated under any of the following circumstances and both parties shall not be hel
28、d responsible as a result thereof:(一) 该房屋占用范围内的土地使用权依法提前收回的;The right to use of land within the scope of the Property was early resumed in accordance with the laws;(二) 该房屋因社会公共利益被依法征用的;The Property was resumed for public interests;(三) 该房屋因城市建设需要被依法列入房屋拆迁许可范围的;The Property has been classified as prem
29、ises to be demolished according to the law for the need of town planning;(四) 该房屋毁损、灭失或者被鉴定为危险房屋的;Damages, fire hazards occurred to the Property or otherwise been classified dangerous premises;(五) 甲方已告知乙方该房屋出租前已设定抵押,现被处分的。Penalty as a result of the mortgage created over the Property as notified to Pa
30、rty B by Party A before the lease;9-2甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反合同的一方,应向另一方按月租金的 2 倍支付违约金;给对方造成损失的,支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:Party A and Party B have agreed that one party may terminate this Contract by written notice to the other party under any of the following circumstances. 31、party in breach shall pay to the other party a penalty of 2 times of the rent per month; if damages is caused to the other party and the penalty is not sufficient to offset the damages of the other party, the party in breach shall also compensate for the difference between the penalty and the damage
32、s caused: (一)甲方未按时交付该房屋,经乙方催告后 7 日内仍未交付的;Party A fails to deliver up the Property accordingly and remain fail to deliver within 7 days after demand given by Party B;(二)甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。The Property delivered up by Party A falls short of the agreement of this Contrac
33、t, causing failure to realize the purpose of the lease; or the Property delivered by Party A is defective and affects the safety of Party B;(三)乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;Party B alters the use of the Property without the written consent of Party A, causing damages to the Property;十、违约责任Liabilities fo

38、好协商,自愿达成以下乙方为甲方提供会计代理服务相关事项的业务约定:一、 乙方为甲方提供以下会计代理服务:建账、记账(总分类账、二级明细账)、填制财务报表、税务报表、国税申报、地税申报(含网上申报)。甲方如有其他服务要求,需在约定书中注明,口头商定无效。 二、甲方在每月25日至次月15日前,按时将本单位所发生合法的经济业务票据传给乙方(乙方可上门取送票据,每月壹次)并提供纳税申报所需要的各种印章(公章、财务章、人名章等)。因甲方票据传递、提供各种印章及税务机关要求的其他资料不及时,造成乙方延误各种纳税申报的,责任由甲方自负。三、在甲方按时传递经济业务票据及按时提供各种印章的情况下,乙方应按时为甲
39、方代理纳税申报,造成延误各税种申报的, 责任由乙方负责。四、乙方丢失票据,书写、计算错误而引起的税务罚款及滞纳金,责任由乙方负责;甲方账外逃税、提供的虚假票据、提供原始凭证不符合规定引起的税务责任,由甲方负责。 五、甲方的出纳每月应主动与乙方会计核对银行账及现金账余额。六、甲方在签订业务约定书的同时付款,否则无效,到期后乙方接受甲方付款的视为约定延续,若到期后未续约付款的,约定终止,双方不再相互承担责任。七、甲方在业务约定期间内如有地址、电话、开户银行及账号、税务登记、工商登记等发生变化应在非报税期内三天、报税期内(每月25日至次月15日)当天通知乙方,不能及时通知乙方由此而产生的后果,由甲方
