房屋买卖居间协议
brokerage contract of real property purchase
甲 方(卖方): party a (seller):
乙 方(买方): party b (buyer):
丙 方(居间方): party c (agent):
信用标准, 共同委托丙方代理并见证甲乙双方之间买卖行为, 经甲、 乙、 丙三方协商一
致, 共同签订本协议, 以兹各方共同遵守。
pursuant to relevant laws and regulations of the people’s republic of china and relevant rules of
beijing municipality, party a and party b entrust party c to act as their agent for the sales
between party a and party b and bear testimony to the afore-said transaction in principle of
voluntary, fairness and honesty. through friendly negotiation, party a, party b and party c hereby
agree to enter into this agreement and abide by it jointly.
第一条 房产成交sales purchase of the property
甲方自愿将自有房屋产权有偿转让给乙方。该房产符合北京市建设管理委员会制订房屋
上市标准, 甲方出售该房屋时亦同时将该房屋已分摊土地使用面积和土地使用期限转让给
乙方。房屋具体情况以下:
party a agrees to sell the property to party b. the property is qualified for sale in the market in
accordance with the regulation of beijing municipal construction committee. together with the
sales of the property, the allocated land area for the property and the usable term of the land is
transferred to party b jointly. the property is described as:
1、 甲方依法取得房屋产权证号为: ;
serial no. of the title certificate of the property is:______________;
2、 房产位于北京市 区【县】; address: district (county), beijing;
房屋结构: , 房屋用途: ; (有产权车位请尤其注明)

4、 房产权属转移时, 附带隶属设施情况及室内装饰情况见(附件二);
together with the title of the property, facilities and interior decorations to be transferred are as
described in appendix (1);
5、 甲方确保已如实陈说该房产权属情况、 装饰情况和相关关系, 乙方对甲方上述转让房产
具体情况充足了解, 自愿买受该房产;
party a shall guarantee that it has completely disclosed the facts about the property, including but
not limited to the title, decoration and relevant information; party b has fully understood the facts
and agrees to buy the property voluntarily.
6、 房屋共有些人及共有些人意见: co-owners of the property and intention for the sale
房屋共有些人: 指对房屋共同享受全部权两个或两个以上自然人、 法人或其她组织共有
人。 property together.
第二条 成交价格及付款方法sales price and terms of payment
一、 成交价格sales price
甲、 乙双方经协商一致, 同意上述房产成交价格为人民币 元; 上述交易总价款包含:
【房价款】【公共维修基金】【室内不可移动之装修】【空调】及其它party a and party b agree

1. 二、 付款方法terms of payment
甲乙双方经协商一致, 甲方认可乙方采取以下第种方法付款:

a. 1、 现金支付cash
乙方应在签署本协议当日, 预先支付总房款 %, 作为确保双方推行协议定金, 该
笔款项连同剩下款项经甲乙双方协商, 决定采取下列第 种方法:
upon signing of this agreement, party b shall pay 10% of the price (say rmb________) as the
deposit. this payment shall be made in accordance with ______as follow:
i. 全部支付给甲方, 甲方开具对应收款凭证;
paid to party a in full and party a shall issue an invoice;
b) 临时存入二十一世纪不动产北京区域分部在特定银行开立监管账户内, 由该银行监管该
部分资金, 待该房屋权属过户手续办理完成及物业交割后, 连同剩下房款一并支付给甲方。
此业务须由甲乙双方与二十一世纪不动产北京区域分部另行签署交易资金监管委托协议;
deposited temporarily to the escrow account of century21 beijing region. this deposit will be
released only when the title transfer from party a to party b is completed and the property
handover has been concluded, and the deposit will be released together with the remaining
payment to party a. to do this, party a and party b need to sign a separate escrow agreement with century21 beijing region.
剩下款项支付: payment method of the remaining amount
监管账户即视同乙方已推行向甲方给付定金和房款义务。
party a and party b hereby agree that, for the afore-said method (b), once the escrow fund is
deposited in the escrow account of century21 beijing region, it is deemed that party b has
performed its payment obligation of deposit and the sales price.
2、 银行贷款mortgage
(1)乙方应在签署本协议当日, 预先支付总房款 %, 作为确保双方推行协议定金;
(2)乙方应在签署本协议 日内, 另行支付 款), 一并作为首付款(首付款金额根据贷款银行贷款条件不得低于房屋总价款 %)。
within ____ days after signing of this agreement, party b shall make up the rest part of the down
payment (the down payment shall be no less than% of the price in accordance with mortgage
bank’s requirement).
上述(1)、 (2)款项经甲乙双方协商一致, 决定采取下列第 种方法:
through the negotiation, party b agrees to make the afore-said payment in ______way as follow:
a) 全部支付给甲方, 甲方开具对应收款凭证;
paid in full amount to party a and party a shall issue an invoice;
b) 临时存入二十一世纪不动产北京区域分部在特定银行开立监管账户内, 由该银行监管该
部分资金, 待该房屋权属过户手续办理完成及物业交割后, 连同剩下房款一并支付给甲方。
此业务须由甲乙双方与二十一世纪不动产北京区域分部另行签署交易资金监管委托协议;

be released only when the title transfer from party a to party b is completed and the property

payment to party a. to do this, party a and party b need to sign a separate escrow agreement
with century21 beijing region.
同时, 甲、 乙双方在此郑重确定: 前述由二十一世纪不动产北京区域分部进行资金监管款项,
一经进入资金监管账户即视同乙方已推行向甲方给付定金和首付房款义务。
party a and party b hereby agree that, for the afore-said method (b), once the escrow fund is
deposited in the escrow account of century21 beijing region, it is deemed that party b has
performed its payment obligation of deposit and the down payment.
乙方采取银行贷款方法支付剩下房款, 由二十一世纪不动产北京区域分部提供统一金融按
揭服务, 乙方须与二十一世纪不动产北京区域分部另行签订贷款委托协议。
if party b makes the remaining payment with bank mortgage, party b shall sign a separate
entrusted payment authorization with century 21 beijing region for its mortgage services.
1) 经办理贷款银行审批, 乙方符合贷款条件, 贷款银行依据乙方签署《委托付款授
权书》将款项一次性划至甲方在同行开设专用结算帐户。
if party b satisfies the criteria of getting the mortgage loan through the examination of the lending

方法处理:
in case party b does not satisfy the criteria of getting the loan through the examination of the
lending bank, party b will choose _______of the following methods as the solution:
a. 自银行做出不予批贷决定起日内, 乙方自行筹集剩下房款, 根据现金支付形
式支付给甲方, 乙方负担在此期间发生各项费用;
within ______ days after the bank decides not to provide the loan, party b shall raise the
remaining payment by himself and pay in cash to party a. party b shall bear all the expenses
occurred during this period;
b.终止本协议推行, 由甲乙双方返还对应款项, 期间发生各项费用由乙方负担。
terminate this agreement, and party a and party b shall refund the money which have been paid
to each other. party b shall bear all the expenses occurred during this period.
三、 相关税费相关要求 taxes and fees
1、 本协议推行期间内, 甲、 乙双方自行按国家及地方相关要求自行缴纳各项税、 费, 丙方
帮助甲乙双方进行相关税费确定及计算工作。税费分担经甲乙双方协商, 决定根据以下方
式进行分担:
a. party a and party b shall pay all the taxes and fees respectively in accordance with relevant
regulations of the state and local governments. party c shall assist party a and party b to calculate
relevant taxes and fees. through negotiation, party a and party b agree to bear the taxes and fees
as follows:
双方对前述税费未约定、 约定不明或遇政策调整, 双方应在权属过户之日前 日内协商
并达成一致, 不然, 按国家相关法律要求缴纳;
for any taxes or fees unspecified, unclear, or changed with the policy, party a and party b shall
reach a consensusdays before the title transfer, or party a and party b shall make the payment
in accordance with the government regulation.
在上述房屋交付前未支付物业管理费、 水、 电、 燃气、 通信费等其她费用, 由甲方负担,
房屋交付以后发生前述费用, 由乙方负担;
fees including but not limited to property management fee, utility fees for water, electricity, gas,
telephone and others before the handover of the property is concluded shall be born by party a.
and the fees after shall be born by party b.
2、 上述税费可在丙方向应付费方预收后代为缴纳, 相关部门所开具完税凭证、 行政事业
性收据、 工本费发票等单据, 待代理事项完成后, 由丙方交付给付费一方。
party a and party b may entrust party c to pay the aforesaid taxes and fees and party c shall
transfer the payment proof, receipts and invoices issued by relevant government to the parties that
make the payment.
第三条 居间酬劳金额及支付方法commission and terms of payment
因甲乙双方基于丙方媒介服务而签订房屋买卖协议, 丙方有权收取对应居间酬劳, 所以甲乙双方在签订房屋买卖协议时, 约定选择下列第种方法支付丙方居间酬劳:

甲乙双方房屋买卖协议签订后, 因甲方或/和乙方原因致使协议未推行, 居间酬劳不
予退还。

the afore-said commission shall not be refunded by party c to any party if this agreement fail to
be performed due to default of either party a or party b once this agreement is entered by the

第四条 权属过户代理title transfer agency services
甲乙双方办理权属过户全部证件资料准备齐全, 由丙方为甲乙双方提供有偿过户委托代
理服务。丙方提供权属过户代理服务, 权属过户代理服务费金额为人民币元, 由 方于本协议签署当日支付给丙方, (或甲方支付元, 乙方支付元);
party a and party b shall prepare the certificates and materials for title transfer and party c shall
provide chargeable title transfer services for party a and party b with fees.
the service fee for title transfer agency services is rmb______. the fee shall be paid by party
___to party c upon signing of this agreement (or, party a pay rmb and party b pay rmb
to party c).
第五条 房屋交付handover of the property
【篇二: 居间服务协议】
贷款居间服务协议
甲方: 身份证号: 乙方:
依据中国《协议法》《民法通则》等法律要求双方代表经友好磋商后, 一致同意签订本协议书。
一、 甲方委托乙方向银行以及其她贷款机构申请借款(具体借贷金额由银行以及其她信贷机构评定审批后确定, 甲方不得以额度大小为理由拒贷, 拒贷产生费用由甲方负担)。
二、 甲方职责:
1、 提供借贷所需真实性资料。
2、 主动配合办理相关手续。
3、 维护乙方权益。
三、 乙方职责:
1、 充足发挥资源优势, 认真负责加速办理全部借款手续, 在金融机构审批后, 借款显示金额并成功提现即视为贷款成功。
2、 全方面协调甲方与金融机构关系。
3、 维护甲方权益。
四、 居间服务费: 甲方须在银行以及其她贷款机构借款显示金额并成功提现后, 一次性向乙方支付贷款总额% 为居间服务费。
五、 违约责任:
1、 乙方在本协议生效后如私自撤销委托则视作违约。
2、 银行以及其她贷款机构贷款抵达甲方银行账号当日, 甲方确保支付居间服务费到乙方指定账号, 每延误一天甲方按申请贷款总额 千分之五 向乙方支付滞纳金。
3、 如因政策调整及甲方贷款条件问题造成金融机构无法放贷, 甲乙双方对此均不负担违约责任。
六、 其它:
1、 本协议甲乙双方双方签字后即生效, 在履约完成后自行终止;
2、 本协议一式二份, 甲乙双方各执一份, 含有相同法律效力;
3、 本协议未尽事宜甲乙双方可协商处理;

【篇三: 居间服务协议】
居间服务协议
甲方: xxxx有限企业
乙方: xxxx有限企业
经双方协商一致, 依据老实守信和公平公正标准, 签订居间服务协议以下, 以资双方共同遵守。
一、 居间事项:
甲方现面向中国各地用户开展投融资服务事项, 并获知乙方能够提供内地需求资金用户信息并能够帮助甲方完成融资服务工作。现甲方委托乙方寻求介绍资金需求方, 帮助甲方帮助资金需求方完成融资服务。乙方接收该居间委托, 并严格推行, 已达成双方目。
二、 居间人权利与义务:
1、 乙方在接收委托时, 可向第三方表明其为甲方居间人, 并能够向第三方介绍甲方融资服务项目相关情况。
2、 乙方应认真完成甲方所委托居间事项, 主动为甲方寻求机会, 并为甲方及相关相对人签署协议提供联络、 帮助及撮合等服务。
3、 乙方在代理甲方所托事项过程中, 因甲方过失造成其损失时, 乙方有权要求甲方赔偿其损失。
4、 乙方对甲方所做融资服务款项不负担任何担保责任。甲乙双方关系仅为居间关系, 不适用其她劳务关系相关约定或要求。
三、 居间酬劳
1、 若乙方促成由借入资金意向第三方与甲方签署相关投融资协议, 并实际支付予第三方时, 甲方根据融资额度xx%向乙方支付居间酬劳, 该酬劳在甲方或甲方所寻求其她投融资主体向相对人支付款项前给予支付。
2、 居间酬劳根据融资资金支付分批以现金方法支付, 为税后净收益。
四、 违约责任
本协议任何一方违反本协议之约定给对方造成损失, 都应赔偿所以而给对方造成一切损失, 并根据本居间服务协议所确定酬劳数额一倍负担违约责任。
五、 争议处理
本协议在推行过程中如发生争议, 由争议双方友好协商处理, 如协商不成, 任何一方都可提起诉讼。
六、 其她约定事项
1、 本协议中所知投融资事项及款项, 甲方有权直接出资或另行居间介绍其她主体介入出资, 不管是由甲方直接出资或由甲方再行居间介绍其她主体介入该事项, 只要乙方所介绍之用户取得相对额度资金, 皆视为甲方与乙方根据本协议所约定居间酬劳结算依据。
2、 本协议未尽事宜, 双方可另行签署补充协议, 补充协议与本协议含有相同法律效力。
3、 甲方应对所操作融资服务款项、 操作程序正当性及正当性负担责任。
4、 本协议一式两份份, 双方各执一份, 签字盖章后生效。
