第一条 依据《中国劳动协议法》等相关要求, 甲乙双方本着遵照正当、 公平、 平等自愿、 协商一致、 老实信用标准, 签订本劳动协议, 共同遵守推行。
Article 1 The contract is hereby concluded by both parties in accordance with Labor Law of the People's Republic of China and Labor Contract Law of the People’s Republic of China, in the principles of fairness, legitimacy, equality, voluntariness, consensus through negotiation and good faith.

第二条 协议期限
Article 2 Contract Term
劳动协议期限经双方约定, 采取下列第　　　种形式。
（一）固定时限: 自 年　月　 日起至　 年 月 日止。
（二）无固定时限: 自　 年　 　月　　 日起至法定解除或终止劳动协议条件出现时止。

第三条 工作内容与工作地点
Article 3 Job Responsibility and Work Place
(1) 甲方聘用乙方从事 岗位工作。
(2) 工作地点为 。依据甲方工作需要, 经甲乙双方协调一致, 可变更工作地点。
(3) 乙方应主动遵守企业全部规章制度, 按质、 按量、 按时完成其本职员作。
（4) 甲方能够依据实际工作需要, 依据乙方工作能力和表现, 调整乙方工作岗位或安排乙方临时从事其她工作岗位, 乙方应给予认可配合。
（5）甲、 乙双方同意按以下方法确定乙方工作时间:
□ 标准工时制, 即每日工作 小时, 每七天工作 天;
□ 不定时工作制;
□ 综累计算工时工作制, 乙方所在岗位实施以 周期, 总工时小时综累计算工时工作制。

(3) Party B shall fulfill his job in a high-quality, quantitative and time-efficient manner and abide by all the company rules.
(4) Party A may adjust Party B’s job or appoint Party B to do another job temporarily by virtue of its business requirements as well as Party B’s competence and performance. Party B shall agree and cooperate with Party A.
(5) Both parties agree Party B’s working hours are specified as follows (Please choose):

□ Non-fixed working hours system; or
□ Cumulative working hours system and the calculation period is ____.

第四条 劳动酬劳与福利待遇
Article 4 Labor Remuneration and Welfare
（1） 甲方每个月 日以货币形式足额支付乙方工资, 结算周期为上月月初到上月月末, 实施先工作后发薪制度。
（2）乙方正常工作基础月薪为 元（人民币/美元/英镑）, 汇率以支付当日为准。依据企业经营情况和乙方工作表现, 乙方工资及奖金可另行调整。
（3） 甲方根据中国相关要求对乙方所应负担社会保险费用及个人所得税进行代扣代缴。根据乙方工作所在地国家要求所应支付相关税费由乙方自行负担。
(1) Party A shall pay off salary to Party B in currency on the of every month. The pay period is from the beginning to the end of last month. Party B works before paid.
(2) Party B’s normal basic salary is ________ in RMB/USD/GBP at the exchange rate to the payment date. The basic salary can be adjusted as per the company’s operation and Party B’s performance.
(3) Party A will deduct Party B’s social insurance premium and individual income tax from his or her salary according to the law and regulation of China. And Party B should afford the relevant taxes and fees in accordance with the law and regulation of the workplace.

第五条 劳动协议推行与变更
Article 5 Contract Performance & Alternation
（1）甲方应根据约定为乙方提供合适工作场所、 劳动条件和工作岗位, 并按时向乙方支付劳动酬劳。乙方应该认真推行自己劳动职责, 并亲自完成本协议约定工作任务。
（2）甲、 乙双方协商一致, 能够变更本协议内容, 并以书面形式确定。
(1) Party A shall furnish Party B with proper working place, labor conditions and position, and shall also pay the remuneration to Party B on time, conforming to the provisions herein. Party B shall fulfill his responsibilities herein in due diligence.
(2) The contract may be revised in written form, after both parties’ agreement through negotiation.

第六条 协议解除和终止
Article 6 Contract Cancellation and Termination
（1） 协议期满双方不再续签或者双方约定协议终止条件出现时, 雇佣协议即终止。
（2） 经协议双方当事人协商一致, 本协议能够解除。
（3）乙方应遵守中国政府法律、 法规及相关要求, 乙方如违反上述要求, 甲方有权即时解除协议; 乙方因健康原因, 经医生证实连续病休15工作以后仍不能继续工作, 甲方有权提前终止协议。
(4) 乙方因归国或其她私人原因未正常出勤且超出十天且未向甲方做出书面说明, 本协议自动终止。
(5) 乙方被证实无法完成本协议项下工作任务, 甲方有权随时解除本协议。
(6) 乙方应严格遵守甲方工作要求以及规章制度, 尽职尽责, 不然, 甲方有权随时解除协议并追究所以而造成经济损失, 并有权对所造成经济损失在乙方酬劳中作对应扣除。
(7) 乙方有权提前30 日以书面形式通知甲方解除本协议, 在试用期内提前3日通知甲方即可解除。
(1) This contract shall be terminated once it expires and both parties do not extend the contract.
(2) The contract may be canceled based on both parties’ mutual negotiation.
(3) Party B should abide by China laws, decrees and related regulations and Party A’s working systems. During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannot resume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.
(4）The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.
(5) In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel the contract at any time.
(6) Party B should abide by Party A’s working systems, rules and regulations. Otherwise, Party A is entitled to cancel the contract and claim a corresponding compensation of any economic loss from Party B’s payment.
(7) Party B should inform Party A in written form 30 days in advance for canceling the contract, and 3 days in advance during the probation period.

第七条 其她事项
Article 7 Others
（1）其她未尽事宜, 双方可参考甲方企业内部相关规章制度实施, 或者可由甲、 乙双方另行签订补充条款, 补充条款与本协议含有相同法律效力。
（2）甲乙双方均应遵守本协议之约定, 任何一方违约, 非违约方都有权要求违约方负担对应损失。
（3）在协议推行中, 发生其她事项而本协议未明确, 按中国相关法规实施。
（4）本协议分为中英两种文本, 每种文本含有相同法律效力; 如两种文本产生冲突, 则汉字文本为作准文本。
（5）本协议一式两份, 甲、 乙双方各执一份, 每份含有相同法律效力。本协议经甲、 乙双方签字盖章后生效。
(1) Other items not stipulated by the two parties can be implemented according to the internal rules and regulations of Party A; or both parties may conclude a supplement clause and the clause shall have the same effect as this contract.
(2) The two parties should abide by the contract. In case one party tears up the contract, the other party has the right to require the defaulting party to undertake corresponding loss.
(3) If there is something undefined in this contract when implementing this contract, it shall be executed according to relevant laws and regulations of China. 
(4) The contract has two versions in Chinese and in English. The two copies are equally authentic. In case any dispute happens, the Chinese version shall prevail.
(5) The contract is in duplicate, held by Party A and Party B respectively. The two copies are equally authentic. The contract comes into effect upon signatures or seals of both parties.
