中国劳工研究与服务网络简介 51.org Brief Introduction of China Labor Study and Service Network 51.org 背景: Background: 随着中国的改革开放,众多内陆和农村的农民,离开土地,前往广东(珠江三角洲)、浙江(长江三角洲)、上海、北京等较为发达的城市,逐步取代了原来城市工人的工作,成为工人。这些被称之为“农民工”约有1.5-2亿名的群体正在成为中国一个新的阶层。中国实行的城乡两元制的户籍管理政策时这一数量庞大群体无法享受和城市工人一样公平的待遇和社会福利,他们对中国的经济、政治等都将产生重要的影响。 Along with the implementation of reform and opening-up in China, many farmers from inland and countryside are leaving their original land for developed cities of Guangdong province(Pearl River Delta), Zhejiang province(Yangtze River Delta), Shanghai city and Beijing city, etc., these farmers do the work previously done by urban workers and become workers. Being called “off-farm workers”, they are with a population of about 150-200 million and have formed a unique group in nowadays becoming a new stratum in China. For which, China’s household registration management policy of urban and rural dualistic system hasn’t been able to bring them the treatment and social welfare equal to that for urban workers, while they are impacting China’s economy and politics more and more greatly. 关于我们: About Us: 基于上述的原因,一些关注自己未来命运农民工(劳工),追求公平、公正的高校教授、学生、ngo、富有社会责任感的记者和律师,组成了这个劳工服务与研究网络,我们是一个完全没有政府参的、独立的NGO。主要研究中国劳工现状,中国劳资关系,跨国公司的企业社会责任以及与劳工有联系的其它社会现象。有更多的人正在加入我们的行列。 For the above reasons, the labor service and study network is established by those including off-farm workers (laborers) who concern their own futures, professors and students of high schools who pursue equality and fairness, non-government organizations, journalists and lawyers who have social responsibility senses, our website is an independent non-government organization without governmental involvements. We mainly study the present state of China laborers, the Chinese employee-employer relationship, corporate social responsibilities of multinational companies, and other social phenomenon relating to laborers. More and more people are joining in us. 2005年,劳工研究与服务网络主要执行机构春风劳动争议服务部经政府批准注册成立于中国深圳。目前在深圳和东莞设立有办公室,拥有6名全职的工作人员,有工人和其它志愿者组成的理事会和监事会指导和监督我们的工作,劳工研究和服务网络在北京、广东、上海和浙江等农民工比较集中的地区拥有志愿者小组,约20名各地、各行业的专家给我们提供咨询和指导,大约100多名各农民工集中城市的农民工(劳工)经过和我们的交流以及指导,成为了我们在当地的志愿者,劳工研究与服务网络拥有两个全国性的以研究劳工和劳资关系的专业网站,20个基于互联网的网络社区,我们通过这些渠道有效的了解和纪录当地有关劳工问题的各种资讯了解和帮助全国各地的劳工。 In 2005, Chunfeng Labor Disputes Service Center, the key executing mechanism of Labor Study and Service Network was registered and established in Shenzhen, China upon the governmental approval. At present, it has offices in Shenzhen and Dongguan with 6 full-time personnel, a council and a broad of supervisors to guide and supervise our work. Labor Study and Service Network has volunteer teams in Beijing, Guangdong, Shanghai and Zhejiang where off-farm workers are concentrated, we perform our work by consulting more than 20 experts from all places and all fields who provide us with guidance, and about more than 100 off-farm workers (laborers) have become our volunteers in those off-farm worker-concentrated cities after receiving communication and guidance from us. Labor Study and Service Network has 2 nationwide professional websites focusing on employee-employer relationship and 20 internet-based net communities, through which, we get to know and make record of local labor issues efficiently and provide helps to laborers all over the country. 我们的目的: Our Objectives: 观察和研究农民工(劳工)群体,在各地建立团结互助的劳工互助网络,并以此为契机,提供法制宣传、援助。普及劳动职业安全知识,提供文化、生活、交际、职业技能等各方面的咨询与服务,提高农民工在城市中的生存和发展能力,最终提升劳工维权、公民意识,最终使劳工共享劳动和经济发展成果,在公平公正、和平法制的环境下生活是我们的目标。和谐地和雇主、政府对话、合作也是我们一直所努力改善和尝试的。 Observe and do researches to the group of off-farm workers (laborers), establish mutual-assistance network in all places for unity and mutual-aid, by which, to provide legal publicity and aids. Popularize the knowledge about safeties in labor and occupation, provide consultations and services relating to culture, life, communication and vocational skills, etc., so as to improve off-farm workers’ ability of living and developing in cities to finally promote their awareness of rights-defending and citizenship, and to ultimately enable them to enjoy the working results and economic development achievements as living in an environment of equity, fairness, peace and legalness, which also serves as our objective. To harmoniously communicate and cooperate with employers and government is also what we are striving to attempt and improve. 我们在做的: What We Are Doing: 一 、 法律援助和其它援助 One. Law Aids and Other Aids 农民工来到城市,很多是时候都会遇到合法权益被侵犯的情况,大部分的农民工都不具备通过法律途径维护自己合法权益的能力。所以对遇到法律困扰的工友我们会提供免费的咨询服务和援助。当一些工友失去工作、生活陷入困境或者受到工作伤害,其它伤害、心理困扰等我们都会对其进行尽力的帮助,两年来,服务部共累计印发法律和职业安全宣传资料约200000份,通过热线电话接受法律咨询、心理咨询、生活常识咨询的劳务工超过50000多人次。针对数家医院开展了工伤探访工作,直接为200多位劳务工朋友提供了法律服务或法律援助服务。更多的劳工则从我们的网站或网络社区获得有帮助价值的资讯。 Many off-farm workers have encountered the cases of lawful rights being invaded after coming into cities, and most of them don’t have the ability of defending their lawful rights through lawful approaches. Thus, we will provide free consultation and aids to our worker friends who are in legal troubles. We also dedicate in helping the worker friends who are troubled by unemployment and living difficulties or work-related injuries, the ones who are suffering other injuries and psychological troubles can also come to us for assistance, over these two years, the Service Center has accumulatively published about 200000 law publications and job safety publications, the workers and laborers who have received legal consultation, psychological consultation and practical living knowledge through our service telephone have reached more than 50000 person-times. We implement visits to several hospitals for the ones with work-related injuries and have directly provided legal services and legal assistances to more than 200 worker and laborer friends. There are even more workers and laborers getting helpful and valuable information from our websites and net communities.    二、法律和职业安全培训 Two. Trainings on Laws and Occupational Safety 农民工群体大部分来自与农村,受教育的程度普遍较低,缺乏法律知识和应对不良雇主的方法,受教育程度越低、或年龄小、缺乏社会经验的农民工最容易被不良雇主盘剥和不公正对待,农民工的各项合法和正当权益正遭受肆意侵害。 Off-farm workers mostly come from the countryside and are with low education degree, they are lack in the law knowledge and the methods of how to deal with bad employers, the ones with lower education or being younger and with much less social experiences are much more likely to be exploited and treated unequally by those bad employers, most of the lawful rights legitimate interests of off-farm workers are under wanton invasion. 我们发现很多农民工因不懂法和不知法而使自身合法权益遭受侵害和损失。为此,2006年起,我们安排专业的律师和志愿者针对农民工开展了免费的法律和职业安全方面的培训。 We found that a lot of off-farm workers are suffering invasion and losses in the lawful rights as a result of their ignorance of the laws or lack of understanding the laws. Therefore, since the year of 2006, we have been arranging professional lawyers and volunteers to perform free trainings on laws and occupational safety knowledge for off-farm workers. 农民工免费参加法律和职业安全培训,并能得到适当的交通和伙食补贴。我们希望通过这样的培训能够提高农民工的法律知识,在遇到类似问题时能够去维护自己和其它工人的的权益。促进法制社会进步。 As well as receiving free trainings on laws and occupational safety, the off-farm workers are also provided with appropriate allowance for transportation and meals at the same time. We hope that through these trainings, the off-farm workers are able to get improved in their law knowledge and protect the rights and interests of both their owns and others while encountering similar cases. So as to achieve an goal of facilitating social development.      三、文化娱乐 Three. Culture and Recreation 在深圳我们建立了活动室和图书室,购买电视机、DVD、功放机等卡拉ok设备免费供农民工在工作之余使用,组织在工业区或农民工聚居地放映电影。同时通过网络,根据农民工的的兴趣和爱好,组织或赞助各种交友聚会或活动,以丰富农民工的精神文化生活。扩大和团结农民工志愿者数量,加强机构对农民工群体的影响力。 We have established activity rooms and libraries in Shenzhen and also purchased Karaoke devices including TV, DVD and amplifiers for off-farm workers to use after work, at the same time, we arrange movies in industrial zones and the centralized areas of off-farm workers. Also, various kinds of friends-meeting parties and activities are arranged or sponsored through internet by us as per the interest and hobbies of off-farm workers, so as to enrich their spiritual and cultural life. Our goal is expanding and consolidating the volunteers for off-farm workers and strengthening the impact of our organization to the group of off-farm workers.  四、机构学习与交流 Four. Learning and Communications of the Organization 机构成立以来,主要工作人员曾多次参加中山大学、清华大学、英国领事馆文化教育处等机构举办的非营利组织能力建设研修班,广泛的与政府官员、高校学者、企业主、劳工NGO和农民工愿者进行了积极接触和探讨。积极参加或组织各类与劳工利益关联的会议,加强与各机构的交流沟通和重视自身能力建设。保持对农民工、农民工关联问题的全面了解和掌握。 Since the organization being established, our key staff have participated in the classes for advanced studies of capability construction of non-profitable organizations which are provided by Sun Yat-sen University, Tsinghua University and the Cultural and Education Section of British Embassy, etc., active contacts and discussions have been there between us and governors, high-school scholars, enterprise owners, laborer NGO and off-farm workers, etc.. We actively take part in or organize all kinds of meetings relating to labor interests, strengthen the communications with various organizations and give great attention to self-capability construction.
