&nbsp;   &nbsp; 工程地点:垦利县民丰路以东、广兴路以南  年 &nbsp; &nbsp;月 &nbsp; &nbsp;日 填写说明 &nbsp; &nbsp;一、本合同为技术合同示范文本,由技术合同当事人参照使用。 二、本合同书适用于一方当事人(受托方)以技术知识 为另一方(委托方)解决特定技术问题所订立的合同。 三、签约一方为多个当事人的,可按各自在合同关系中的作用等,在“委托方”和“受托方”项下分别排列为共同委托人或共同受托人。 四、本合同书未尽事项,可由当事人附页另行约定,并作为本合同的组成部分。 五、当事人使用本合同书时约定无需填写的条款,应在该条款处注明“无”等字样。 -可编辑修改- 工程质量检测技术服务合同 东营市建筑工程质量检测站受 &nbsp;山东万达地产有限公司 &nbsp;委托,承担其建设的 &nbsp;万达·财富新城三期 &nbsp;工程检测任务,为规范建设工程质量检测工作,明确工程参建各方的责任,强化各方的协作配合,保证信息交流,反馈通畅及时,确保检测工作准确、及时、有效,严格控制工程所用材料、制品、构配件的进场质量,促进工程质量稳步提高,依据《建设工程质量检测管理办法》、《山东省建设工程质量检测管理规定》及有关工程建设法律、法规、规章,遵照《中华人民共和国合同法》,双方就本工程的检测事宜,在平等自愿、协商一致的基础上,订立本合同,共同恪守。 工程概况: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 第二条:委托方权利与义务 (一)依据技术标准和检测机构的资质范围、诚信建设、服务水平、检测业绩、质量保险等条件委托质量检测业务,与检测方签订书面协议,承担委托责任。 (二)单位工程的检测业务一经委托,委托方不得将检测项目拆分委托给其他检测机构,并应监督工程监理单位和施工单位严格执行本合同约定内容。 (三)工程开工前根据设计图纸、图纸审查、图纸会审、相关技术标准和工程现场实际情况,组织编制建筑工程质量检测项目计划表。遇有设计变更应及时补充检测项目计划。对建筑工程质量检测项目的齐全、完整负责。 (四)按照有关规定向检测方提供符合检测要求的检测试样和工程设计图纸、工程变更等资料。 (五)委托方指定 刘海锋 为本工程见证人员(联系电话:13854642876),见证人依据有关工程建设标准和相关规定以及检测方案的要求,负责组织完成见证检测试件的取样、封样、送检等环节。并对试样的真实性、代表性负责。 (六)组织协调须在工程现场进行的检测项目以及抽样检测的各项准备工作,为检测方提供必要的工作条件,保证检测工作有效进行。 (七)发现检测人员不按合同要求履行工作职责或其行为影响合同正常履行的,有权要求检测方更换检测人员。 (八)对本工程的各类检测数据有知情权,合同执行过程中可随时查询。 (九)按照合同约定,向检测方支付检测费用,接收检测报告。负责对检测报告的齐全、完整、有效进行确认。对检测报告中有不合格数据的试样按有关规定进行处理。 (十)提供的非破坏性检测试样应在该项目检测完毕后十五日内取回。 第三条:检测方权利与义务 (一)工程质量检测机构应具有独立法人资格,取得相应的检测机构资质证书并通过计量认证。 (二)不得超出资质范围承担检测业务,不得转包检测业务。对于检测项目中的个别参数,属于检测设备昂贵或使用率低,需要由其他检测机构进行该项目参数检测业务的,不属于转包。  (三)依批准资质范围开展检测业务,按计量认证的标准,保证管理体系全面系统运行,提供优质、高效、科学、公正的检测服务。 (四)按照有关规定认真核验、接受委托方提供的检测试样和工程图纸、资料等,对不符合检测要求的,有权拒绝接受。 (五)根据有关工程检测标准、规范、规程和委托方检测项目计划表的要求,及时安排检测人员对样品进行试验、检测或到工程现场进行相关项目的检测。 (六)在检测过程中不得降低检测标准和服务水准,开展检测工作有完整的检测记录。 (七)检测过程中发现的重大质量问题及时向委托方和工程质量监督机构通报。 (八)在承诺期限内完成检测任务,出具客观、公正、齐全、有效益检测报告。检测报告经检测人员、技术负责人、检测机构法定代表人或者其授权的签字人签署,并加盖检测专用章后方可生效。见证取样检测的检测报告中应当注明见证人单位及姓名。 (九)按照合同约定,向委托方提供检测报告一式二份,对检测报告的完整性、准确性、真实性负责。 (十)标准规范明确要求须留置的试样,应明确标识,并按规定的程序、环境、数量、时间等要求留置,有权处置委托方逾期不取的非破坏性检测试样。 第四条:受检方承担的技术责任 (一)根据工程建设相关技术标准,按编制的建筑工程检测项目计划表,依据工程施工进度,向建设单位、监理单位提出检测项目方案,确保工程质量检测项目的完整性。 (二)指定 王涛 (联系电话:18705468908)为工程见证取样检测的送样人员。如有变动应及时书面通知检测单位。 (三)在建设(监理)单位见证下,负责在施工现场按相关技术标准和有关规定进行见证检测试样的取样、制样、封样工作,承担试样的养护和送检,确保试样的完好,对试样的真实性负责。 (四)配合工程现场检测以及抽样检测工作,保证检测工作及时有效。 (五)接收、整理、归档检测报告,有权拒绝接受检测数据、检测内容、填写不符合规范或检测表格形式不标准的检测报告。 (六)有告知建设单位、监理单位检测结果的义务。 第五条:检测方式 根据委托方检测项目计划要求,按照现行检测标准、规范、规程或双方约定的方式,由检测单位安排相应技术人员在实验室或工程现场开展检测工作。 (一)见证取样检测:在送样员送达检测样品并办理检测委托书后,由检测单位安排相应技术人员在实验室进行试验。必要时,检测方可提供检测样品现场抽样服务,费用另计。 (二)现场检测项目:委托方应提前两天通知检测方,检测方确认达到检测条件后在三日内安排检测人员到工程现场进行检测。 第六条:检测依据 1、《建设工程质量检测管理方法》 2、《山东省建设工程质量检测管理规定》 3、国家、行业和山东省现行检测标准、规范 4、委托方指定的方法 第七条:检测费用计取与支付 (一)检测计费 1、委托方和检测机构双方商定建筑材料与制品、建筑功能性材料与产品、建筑装饰材料与产品等检测项目的检测费用按以下方式计取: 按照检测项目单价计费 □按照建设面积实行包干 检测费用总额为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 。 2、建筑主体结构、钢结构、建筑门窗幕墙、室内环境质量及建筑节能等项目按检测项目据实结算,在附加条款中约定。 3、建筑地基基础检测另行签订合同,作为本合同的补充。 (二)支付方式 □预付款:检测工作开始前付清检测费。 分项付款:领取检测报告时支付检测费。 □按工程进度付款:基础工程完成支付 &nbsp; &nbsp; 元,主体封顶支付 &nbsp; &nbsp; &nbsp;元。 □一次性付款:竣工验收前一次性付清全部检测费用。 (三)付款方 □建设单位支付 □施工单位支付 □材料、产品供应商支付 检测方开户银行: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;帐号: 第八条:违约责任 (一)检测方违反法律、法规和工程建设强制性标准,给委托方造成损失的,应当依法承担相应的赔偿责任。 (二)委托方未按合同或检测方案的要求完成试验必须的准备工作而导致检测工作延误时,责任由委托方自负。 (三)合同签订后,委托方向检测方给付定金 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;无 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 。 按照合同约定,委托方全面履行义务后,定金抵作检测费或者收回;委托方未按合同约定履行义务,定金不预返还。 (四)一方不履行合同义务或延迟履行或履行合同义务不符合合同规定的,应向对方支付违约金 &nbsp; &nbsp; &nbsp; &nbsp; 无 &nbsp;
