1、 租 赁 合 同 PREMISES LEASE CONTRACT立合同人:出租方(以下简称甲方):Parties to the Contract: Lessor (hereinafter referred to as Party A) : 承租方(以下简称乙方): Tenant (hereinafter referred to as Party B) : 甲、乙双方经过友好协商一致订立本合同,以资共同遵守。 Having reached unanimity through friendly consultation and negotiation, Party A and Party B, h

2、ereby agree to enter into the following contract to be abided by both parties. 一 建物地址:甲方将其所有的位于苏州市 园 区 的房屋在正常状态下出租给乙方 居住 使用。Address of Premises : Party A lets to Party B its lawfully owned premises in nor- mal condition ,located at District, Suzhou for purpose.二、 房屋面积:出租房屋的登记面积为约 平方米( 建筑 面积)。 Area o

3、f Premises :The registered area of the premises let by Party A shall be square meters ( area). 三、租赁期限: 租赁期自 年 月 日起至 年 月 日止。甲方应于 年 月 日以前将房屋腾空交给乙方使用。 Lease Term:The lease term shall be from (month) (day), (year) to (month) (day), (year). Party A shall vacate the premises and deliver it to Party B for

4、use before (month) (day) (year). 四、定金:1、 乙方应付的定金为 整, 年 月 日支付给甲方定金共计 整。余额于 日内补足。 Earnest Money: Party B should pay as a earnest money . The earnest money to be paid to Party A on . (month) (day), (year) shall be in total. The rest shall be made up within days.2、 在本合同签定之后至租期开始之前如甲方违约,则上述定金由甲方双倍返还乙方,如乙

5、方违约则定金甲方所有并不再返还。 If Party A violates the Contract after it is signed and before the lease term begins, it shall pay double earnest money back to Party B . If Party B violates the Contract, the earnest money shall be confiscated by Party A.3、 租期开始之后,上述定金 。 After the lease term begins, the above menti

Party A shall issue a written receipt after each payment of rental is received. 4, 如乙方逾期支付租金超过五日,则每逾期一日按应付租金的百分之一向甲方支付滞纳金。如乙方逾期超过十五日,则视为乙方自动退租,构成

9、违约。甲方有权收回房屋,并追究乙方违约责任。 If Party B delays such rental payment in the excess of 5 days, it shall pay liquidated damages to Party A at the rate of 1% of the due rental for each day of delay. If the delay is in excess of 15 days, it shall be deemed as automatically quitting tenancy, which shall constitu

10、te breach of contract. Then, Party A shall have the right to recover the leased premises and take actions against Party B for liabilities of breach of contract. 六、保证金:1、 为确保房屋及其附属设施之安全与完好及租赁期内相关费用之如期结算,乙方同意支付给甲方保证金共计 整, 除乙方已支付的部分外,乙方应于 年 月 日前支付给甲方,甲方在收到保证金后应予以书面签收。 Deposit of Security:To ensure that

11、 the premises and its accessory facilities are safe and in good condition and that accounts of relevant fees are settled on schedule during the term of lease, Party B agrees to pay to Party A as a deposit of security for fulfilling the Contract. In addition to the amount has been already paid, Party

After receiving the deposit, Party A should issue a written receipt. 2、除合同另有约定之外,甲方应于租赁关系消除且乙方迁空房屋、以正常使用后的状态归还房屋及其附属设施、并付清所有应付费用后,当天将保证金全额无息退还乙方。 Unless otherwise agreed upon, the full amount of deposit of security shall be refunded by Party A wi

13、thout interest to Party B upon expiration of the lease, Provided that Party B has vacated the premises, left the premise and everything in the premises intact and paid up all expenses due.3、因乙方违反本合同的规定,而产生的违约金、损害赔偿金以及应付租金及相关费用,甲方可在保证金中扣抵,不足部分乙方必须在接到甲方付款通知后十天内补足。 Any penalty for breach of contract, c

14、ompensation for damage and rental and other relevant fees payable arising from Party Bs violation of the provisions of the Contract may be deducted by Party A from the deposit of security. Any shortage thereof must be made up for by Party B within ten days of the receipt of the notice of payment iss

15、ued by Party A. 七、其他费用:1)乙方应承担租赁期内的水、电、煤气、电讯、等一切因乙方实际使用而产生的费用,并按单如期缴纳。 Other Fees: Party B shall bear the water, electricity, gas and communication fees, and all other fees incurred by Party B in actual use and pay the bills on schedule during the term of lease. 2)土地使用税、房屋维修费、租赁综合税、管理费、停车费等原有甲方支付的费用

16、,仍由甲方缴纳。The ground rent, house maintenance fee, management fees , parking fees and comprehensive rental tax that were originally payable by Party A still shall be paid by Party A. 八、甲方的义务:1、 甲方须按时将房屋及附属设施(详见附件)交付乙方使用。 Obligations of Party A:Party A shall turn over the premises and accessory faciliti

17、es (details refer to the appendix) on schedule to Party B for use.2、 房屋设施如因质量原因、自然损耗或灾害而受到损坏时,甲方有修缮的责任并承担有关的费用。 Party A shall be responsible for repairing any damage of the premises due to poor quality, natural tear and wear or calamities and bear the expenses thereof.3、 甲方应确保所出租的房屋享有出租的权利,如在租赁期内,该房

18、屋发生所有权全部或部分的转移、设定他项物权或其他影响乙方权益的事情时,甲方应保证所有权人、他项权利人或其他影响乙方权益的第三者,能继续遵守本合同所有条款,反之如乙方权益因此而遭受损害,甲方应负赔偿责任。 Party A shall ensure that the premises let out is entitled to the lease. If all or part of the ownership of the premises is transferred, other rights in them are settled, or any other happening affe

19、cts the rights and interests of Party B during the leasehold, Party A should guarantee that the owner, person to the rights in them or any other third party that affects the rights and interest of Party B continue to abide by all the articles of the Contract. Otherwise, Party A shall be liable for c

20、ompensating the loss to the rights and interests suffered by Party B therefrom. 九、乙方的义务:1、 乙方应按合同的规定,按时支付租金、保证金及其他各项应付费用。 Obligations of Party B:Party B should pay the rental, deposit of security and other fees payable on schedule according to the provisions of the Contract. 2、乙方获甲方同意后,可在不影响房屋结构的情况下

21、,进行房屋内部装修及添 置设备。租赁期满后,乙方可将添置的可拆动的动产部分自行拆运,并保证不影响房屋的完好及正常所有。 Party B may , upon approval by Party A, fit up the leased premises and add equipment therein during the leasehold. Upon expiration of the leasehold, Party B may remove the added part of property that is removable, but it must ensure that th

22、e premises is in good condition for normal use. 3、未经甲方同意,乙方不得将承租的房屋转租或变相出租,并爱护使用租赁的房屋和附带设备。如因乙方的过失或过错致使房屋及设施受到损坏,乙方应负修复及赔偿责任。 Party B shall not transfer or sublet the leased premises without the approval by Party A and shall take good care of the leased premises. Party B shall be liable for compensa

23、ting for any damage it caused to the premises and facilities resulting from Party Bs fault or negligence.4、 乙方应按本合同的约定合法使用租赁房屋,不得擅自变更使用性质,不应存放危险品,如因此发生损害,乙方应承担全部责任。 Party B shall use the leased premises lawfully according to the provisions of the Contract. Party B shall not arbitrarily change the us

24、e of the said premises. No hazardous materials and goods shall be allowed to be kept in the premises. If any damage is attributable to such use , Party B shall be fully liable. 十、 合同终止及解除的规定: Termination and Dissolution of the Contract:1、 乙方在租赁期满后,如需续租,应提前两个月通知对方,由双方另行协商续租事宜,在同等条件下,乙方有优先续租权。 If Part

25、y B intends to renew the leasehold upon its expiration, it shall notify Party A of such intention two months prior to the expiration of the lease term. Then, the two parties shall discuss matters over the renewal of leasehold.2、 租赁期满后,乙方应在 叁 日内将承租的房屋及设施在正常状态下交还甲方,如有遗留的任何物品,在未取得甲方的谅解之下,均视为放弃,任凭甲方处置,乙

26、方决无异议。 Upon the expiration of the leasehold, Party B shall return the leased premises and accessory facilities in normal condition to Party A within days. Any belo-ngings left behind in the house shall , without obtaining previous understanding of Party A, be deemed as things given up by Party B and

27、 shall be disposed of by Party A at its discretion , to which Party B shall raise no objection.3、 本合同一经双方签字或盖章后立即生效,未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。 This contract shall come into force upon the date of being signed or sealed by both parties. It must not be terminated at will without the approval of

Anything not covered in the Contract must be consulted separately by Party A and Party B. 十一、违约处理: Handling of Breach of Contract: 1. 甲、乙任何一方如未按本合同的条款履行,导致中途终止本合同,并且过错方在未征得对方谅解的情况下,则视为违 约,双方同意违约金为 人民币9200 整。若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。 If failure of either Party A or Party B to fu

29、lfill the articles of the Contract results in the termination of the Contract before its expiration, the Party at fault shall be deemed as violating the Contract without obtaining the understanding of the other Party. The two parties agree that the penalty for breach of contract shall be .In case su

30、ch penalty is not sufficient to make up for the loss suffered by the faultless party , the party that has violated the Contract shall pay additional compensation. 2.凡在执行本合同或与本合同有关的事情时双方发生争议,应首先友好协商,协商不成,向房屋所在区的人民法院提起诉讼。 Any dispute arising from the execution of, or in connection with, the Contract s

31、hall be settled through friendly negotiation between both parties. In case no settlement can be reached, the disputes shall be submitted to the peoples court which has jurisdiction over the premises. 十二、其他: 1、 本合同的附件是本合同的有效组成部分,具有同等法律效力。 Others :The appendix is an effective component of this Contrac

32、t, which shall have the same force of law. 2、 本合同一式 叁 份,甲、乙双方各执 壹 份,苏州园区胜腾房产经纪有限公司执壹份。 This Contract is made in copies; for each party and one to be held by ShengTeng REAL ESTATE Co. Ltd. . 3 甲、乙双方如有特殊事项,可在本条款另行约定。 If Party A or Party B has any specific matters, it may be agreed upon by both parties

34、表、国税申报、地税申报(含网上申报)。甲方如有其他服务要求,需在约定书中注明,口头商定无效。 二、甲方在每月25日至次月15日前,按时将本单位所发生合法的经济业务票据传给乙方(乙方可上门取送票据,每月壹次)并提供纳税申报所需要的各种印章(公章、财务章、人名章等)。因甲方票据传递、提供各种印章及税务机关要求的其他资料不及时,造成乙方延误各种纳税申报的,责任由甲方自负。三、在甲方按时传递经济业务票据及按时提供各种印章的情况下,乙方应按时为甲方代理纳税申报,造成延误各税种申报的, 责任由乙方负责。四、乙方丢失票据,书写、计算错误而引起的税务罚款及滞纳金,责任由乙方负责;甲方账外逃税、提供的虚假票据、

35、提供原始凭证不符合规定引起的税务责任,由甲方负责。 五、甲方的出纳每月应主动与乙方会计核对银行账及现金账余额。六、甲方在签订业务约定书的同时付款,否则无效,到期后乙方接受甲方付款的视为约定延续,若到期后未续约付款的,约定终止,双方不再相互承担责任。七、甲方在业务约定期间内如有地址、电话、开户银行及账号、税务登记、工商登记等发生变化应在非报税期内三天、报税期内(每月25日至次月15日)当天通知乙方,不能及时通知乙方由此而产生的后果,由甲方自负。 八、业务约定到期或终止时,如果甲方聘用乙方工作人员,乙方对业务约定期间的凭证、账目、税务出现的问题概不负责。 九、甲方为:1.纯地税户 2.国地税户3.

36、一般纳税人,每月凭证不超过一本,无特殊核算要求(超出要求范围的,服务费另行协商)。十、约定期限: 年 月至 年 月,付款方式:每 ,另每会计年度账本及报表资料费贰佰元,工商年检代理费贰佰元,残保金代理费贰佰元; 年 月 日合计收取 元。十一、本业务约定书一式两份,双方各持一份,经双方签字盖章付款后生效。本约定书未尽事宜,甲乙双方应本着友好协商的态度进行协商解决。十二、会计每月25日至次月1日联系取票据,以下列举部分单据: 1、企业本月开具的发票及与之相对应的收款凭证(进账单、现金送款单、现金收入凭单、出库单、发票领用存情况等);2、企业取得的购货发票及与之相对应的支出凭证(支票根、电汇单、现金

37、支出凭单、入库单等);3、企业取得的费用发票(交通费、差旅费、通讯费、广告费、业务宣传费、房租、水电费、办公费、运费、汽油费、保险单据等)及与之相对应的支出凭证(支票根、电汇单、现金支出凭单等);4、银行缴税税票,利息单,进账单,支票存根,电汇单及其它各种银行票据;5、企业自制原始凭单:工资单,折旧单等;6、一般纳税人发票汇总表(一套),作废发票(联次齐全),抵扣票认证清单,金税卡;7、其它需要的资料_8、凭证报表由乙方暂存,待工作完成后,年度终了时返还客户。 注意:月末取票后企业如开具收入发票须立即通知乙方。甲方: 乙方: 联系人: 联系人:联系电话: 联系电话:电子邮件/ QQ: 地址:
