慈溪市新未来文化培训学校外国教授管理制度A Regulation of Foreign Professionals Employed by Cixi new future training school.第一章 总 则Part One general principles第一条 为了维护国家和学院尊严和权益，维护外事工作严厉性，保障在我院工作外国教授正当权益，特制订此管理制度。Article One The regulatory rule is enacted to maintain the dignity and legal rights of the Peoples Republic of China and Humanistic Management new future training school. the seriousness of its foreign affairs, and safeguard the legal interests of the foreign professionals employed by Humanistic Management .第二条 聘用外国教授工作方针是：依据培养师资和教学工作需要，有计划地聘用含有真才实学外国教授.Article Two The general principle of employing foreign professionals is that qualified foreign professionals should be employed, in accordance with the Colleges working schedule. 第三条 聘用外国教授范围是：以英语专业为基础，逐步扩展到日语等其它专业及学科。Article Three The employment of foreign professionals begins from the major of the English language and literature, and then gradually expands to other majors including the Japanese language. 第四条 外国教授讲课对象关键是中小学生英语学习和英语爱好交流。Article Four The foreign professionals shall teach courses to the pupils and middle school students.第二章 聘用标准及条件Part Two Principles and Qualifications of Employment第五条 应聘我院外国教授应同时含有以下条件：Article Five The candidates who apply to the School shall meet all of the following qualifications: （一）含有良好职业道德，遵守中国法律、法规和学院教学规章制度；教书育人，为人师表，对华友好、愿和我方合作。Section One The candidates should be equipped with decent professional conducts, observation of Chinese laws, rules and regulations; they should be true to their professional obligations, and be willing to cooperate with the College under the friendly atmosphere with Peoples Republic of China and its people. （二）含有学士以上学位，十二个月以上英语（语言）教学经历。Section Two The candidates should be equipped with a bachelor degree and above, and an experience as an English instructor for more than one year. （三）年纪在55岁以下。Section Three The candidates should be below 55 at the age. （四）应聘者必需提交简历（姓名、性别、年纪、国籍、所在国工作单位，最高学历、专业及学术职称、来华任教期限等）、求职信、推荐信及学位证书复印件和健康汇报。Section Four The candidates should hand in their resume ( full name, sex, age, nationality, professional experience in other countries, supreme academic degree, professional title, previous professional experience in China), an application letter, a recommendation letter, a copy of diploma, and a free healthy report. 第三章 教学管理Part Three Administration of Teaching Affairs 第六条 外国教授不得在学校内从事和其教学身份不符活动，不得干涉中国内部事务；未经许可不得负担校内、外其它劳务事项。Article Six The foreign professionals must not be involved in illegal activities, must not interfere with the internal affairs of People Republic of China; besides, they should not be engaged in part-time jobs within and beyond the School unless authorized by the School. 第七条 外国教授到任后，应立即熟悉我校教育理念、教学制度和培养目标等。任教期间，教务处及相关教学单位有权对外国教授进行教学管理，并安排其开展教研活动。Article Seven The foreign professionals, once employed, shall acquaint themselves with the educational guidelines, regulations of teaching affairs and targets for undergraduate development.The Deans Office has the power to exercise its administration of teaching over the foreign professionals, and oblige them to be active in the teaching and research designed by the departments they are working with. 第八条 外国教授须服从学校日常工作安排，根据学校制订教学计划、教学纲领进行教学；开学两周内，须向教务处呈交教学进度表。Article Eight The foreign professionals shall carry out their teaching activities in accordance with the Schools working plans, general and specific, and its syllabus; they are supposed to hand in their teaching schedule within the fourteen days after a new term begins. 第九条 外国教授每七天工作量通常不少于18课时，不得自行调课，如需要调课，应根据教务处调课手续办理。Article Nine The foreign professionals shall be given no less than eighteen working hours. They should not cancel, change, rearrange or postpone the time and place of teaching. If necessary, they are supposed to make a written application under the regulation designed by Deans Office. 第十条 对教学成绩显著外国教授，应给精神或物质激励；对教学质量差，屡出教学事故，学生评教不合格或学生反应强烈，经警示后，在要求时间内仍无改善者，依据协议条款可给予解聘。Article Ten The foreign professionals, when evaluated Good, shall be awarded spiritually or materially; they, when evaluated Bad or involved in failures of normal teaching, shall be given a warning. If the execution of their duty is not put in good order in the designated time limit, they will be unemployed in accordance with the employment contract. 第十一条 尊重外国教授宗教信仰，但不准在中国境内进行传教活动，不得以教学名义在学生中散发“圣经”等宗教书籍，更不得在教学中宣传宗教。Article Eleven The foreign professionals shall be respected in religious faith, but not allowed to preach religion within the Peoples Republic of China, not allowed to hand out the religious presswork including the Holy Bible, and not allowed to preach religion to the undergraduates. 第十二条 外国教授不能自行在教学活动中让学生填写任何国外记录表或调查表，如确需填写，须经学院同意。外国教授不能发表反对中国四项基础标准言论和攻击或挑衅性政治言论。Article Twelve The foreign professionals shall be forbidden to ask undergraduates to fill in the foreign registration sheets and questionnaires. If really necessary, it must be first authorized by the College authorities before the very act of doing it. The foreign professionals shall be forbidden to say something that runs encounter to the Four Cardinal Principles(the principle of upholding the socialist path, the principle of upholding the peoples democratic dictatorship, the principle of upholding the leadership of the Communist Party of China, and the principle of upholding Marxist-Leninist-Maoist thought)第十三条 外国教授提供视频教材须经教务处等相关教学单位审查，凡属有利于教学资料片、风光片、小说片，可向学生放映。内容反动或淫秽视频不得放映。Article Thirteen The foreign professionals shall have for-teaching-use videos censored by Deans Office before making use of them in class; it is such videos as are useful to teaching, about information, scenery, story-telling that can be shown to the undergraduates. Illegal or filthy videos shall not be played to the undergraduates. 第四章 生活管理Part Four Aspects of Board and Lodging第十四条 外国教授必需遵守我校公寓管理相关要求，许可和学校教职职员相互造访，造访时需出示有效证件，通常会客时间不得超出2230，不准留宿。外国教授直系亲属从外地探亲需留宿，须提前一天填写住宿申请单一式两份，由外事办和保卫部门审查同意，并持有效证件报公安局立案。Article Fourteen The foreign professionals shall be allowed to pay a visit to each other with the staff of the School in accordance with the regulation of the lodging management; the foreign professionals shall show their identifications while communicating and end visits by the time 22:30 p.m.The foreign professionals, when necessary to accommodate the family members coming from abroad to visit them, shall be supposed to fill in the blanks and make an application to the School authorities (Office of Foreign Affairs and Division of Public Security ) and, keep the Bureau of P Public Security informed of it. 第十五条 外国教授不准在公共场所吸烟、酗酒；不准私自接电或超要求使用电热设备；严禁存放易燃易爆品及其它危险品；严禁从事赌博、吸毒、邪教等违法活动。 Article Fifeen The foreign professionals shall be well aware that the following deeds are forbidden to take place: smoking and alcoholism in public, illegal access to electrical appliances of ultrahigh voltage, storage of combustible materials and explosive devices and other hazardous articles, gambling and drug taking and practice of heresy. 第五章 工作时间和休息休假Part Five Working Time, Rest and Vocation第十六条 外国教授享受中国下列节日休假； Article Sixteen Foreign professionals are entitled to enjoy the following holidays.元旦、春节、国际劳动节、国庆节及法律、法规要求其它节日。New Years Day, Spring Festival, National Day and other Chinese legal holidays. 第六章 病假和事假Part Six Sick Leave and Private Affair Leave第十七条 在工作时间内，外国教授不得私自外出，如有特殊邀请，应向学院外事办请示，同意后方可参与活动。Article seventeen In working hours, foreign professionals are not allowed to leave without permission. Ask for the Foreign Affair Offices permission if invited to participate activities outside.第十八条 外国教授因故不能上课，应按学院要求推行请假手续。假满返回后要立即销假，未办理请假手续或请假未获准私自离开岗位者，视情况给处罚，情节严重者我院有权解除协议并进行索赔。Article eighteen If unable to work, foreign professionals shall go through the procedure of taking a leave in light of the rules and report back from leave. Penalty shall be given if foreign professionals leave without permission. Certain offences are serious enough to warrant immediate discharge and claim compensation. 第十九条 在协议期内，外国教授在台湾、香港、澳门地域和中国境外就诊医疗费用自理。Article ninteen In the contracted period, the medical costs in Taiwan, Hong Kong, and Macao and outside China clinics shall be paid by oneself.第二十条 未经许可擅离职守，旷职一天，扣发三天工资。情节严重，我院有权解除协议，并追究其违约责任。Article twenty Be away from work for one day without asking for a leave will lead to loss of three days payment. Certain offences are serious enough to warrant immediate discharge, and the college has the rights to hold the violators be responsible 第七章 工资支付方法Part Seven: Payment Method第二十一条 工资以人民币支付。Article twenty one Salary is paid in RMB.第二十二条 工资应该自到职之日起至协议期满之日止，按月支付给教授本人。不足整月，按日计发。日工资为月工资1/30（二月份同）。 Article twenty two From the first working day till the contract expiration date, salary is paid directly to foreign professionals monthly. If working days are less than one month, salary is paid by day. Daily pay is 1/30 of monthly pay.第二十三条 我校不得克扣或拖欠工资。Article twenty three Pay-skimping and pay-defaulting is forbidden.第二十四条 外国文教教授应该根据中国个人所得税法依法交纳个人所得税。Article twenty four Foreign professionals shall pay individual income tax in accordance with the Individual Income Tax Law of the Peoples Republic of China.第八章 安全管理Part eight: Safety第二十五条 外国教授外出，必需提前向外事办请示，未经许可，不得私自离校。外出时要随身携带护照、教授证等证件，外出旅游只能在节假日进行，旅行只能到开放地域。Article twenty five Without permission of the Department of Foreign Affairs, foreign experts are not allowed to leave the school. Documents such as passports, certificate of foreign experts are necessary outside the school. Trips are limited to legally-allowed areas on weekends or holidays.第二十六条 外国教授出行前须向外事办人员登记出行目标地、起止日、出行方法、联络方法等相关信息，并和之保持电话联络，确保无事故发生。Article twenty six Before leaving the college, foreign experts should register the information to the Department of Foreign Affairs, such as destination, departing/returning date, means of transportation and contact. The cell phone should always be on for contact in case of emergency.第九章 聘用协议推行和违反协议责任Part nine The Performance of Employment Contract and Liability for Breach of the Contract第二十七条 协议一经签署，即含有法律约束力。当事人应推行协议约定义务，任何一方不得私自变更或解除协议。Article twenty seven The contract shall be legally binding as soon as it is established in accordance with the law. The parties shall perform their obligations stipulated in the contract. No party shall unilaterally modify or rescind the contract.第十章 聘用协议变更、解除和终止Part 10 Modification, Rescission and Termination of the Contract第二十八条 有下列情形之一，当事人一方有权通知另一方解除协议：Article 28 In any of the following circumstances, a party shall have the right to notify the other party to terminate the contract at any time if: （一）另一方违反协议，以至严重影响协议所确定工作任务和工作质量；（二）另一方在协议约定期限内没有推行协议，在被许可推迟推行合理期限内仍未推行；（三）发生不可抗力事件，致使协议义务不能推行；（四）协议约定解除协议条件已经出现；（五）当事人一方要求解除协议，应提前30天以书面形式向另一方提出，30天以后方可解除协议。(a) if the other party has breached the contract, thus adversely affecting the work requirements they expected to receive agreed upon in the contract;(b) if the other party fails to perform the contract within the time limit agreed upon in the contract, and again fails to perform it within the reasonable period of time allowed for delayed performance;(c)if all the obligations under the contract cannot be performed owing to force majeure; or(d) if the contractually agreed conditions for the rescission of the contract are present.(e) In case either party asks to terminate this contract, it shall give a 30 day notice to the other party in writing, and the contract shall only be terminated after 30 days.第十一章 外国文教教授聘用协议争议处理第二十九条 外国文教教授聘用协议发生争议时，当事人应尽可能经过协商或调解处理。当事人不愿协商、调解，或协商、调解无效，可向外国文教教授聘用协议争议仲裁委员会提出仲裁申请。仲裁委员会依据当事人签署协议中仲裁条款，或当事人双方达成仲裁协议裁决。当事人签署协议中没有仲裁条款，争议发生后双方又未达成仲裁协议，当事人可向中国地方法院提起诉讼。Article 29 If disputes over a contract develop, the parties shall, as far as possible, settle them through consultation, or through mediation. If the parties are unwilling to settle their dispute through consultation or mediation, or if consultation or mediation proves unsuccessful, they may submit the dispute to a Chinese arbitration body or any other arbitration body for arbitration. The arbitration award shall be in accordance with the arbitration clause provided in the contract or a written arbitration agreement reached by the parties.If no arbitration clause is provided in the contract, and a written arbitration agreement is not reached afterwards, the parties may bring suit in a peoples court.第十二章 附 则 第三十条 本制度自公布之日起施行，未尽事宜，以签呈形式补充。Article 30 The foreign affairs office is responsible for the interpretation of the contract. This contract shall take effect upon being signed by both parties and shall be automatically terminated upon expiration. Any outstanding matters (uncovered matters in the contract) shall be settled through the submission document. (Petition)
