工程意向协议书范本篇一：工程项目施工承包意向协议1 工程项目施工承包意向协议 甲方： 湖南锦江实业投资有限公司 乙方： 甲方将 号楼工程项目约 平方以包工包料的形式承包给乙方施工，经甲、乙双方协商，达成如下意向协议。 一、工程承包内容 1、该工程项目 号楼的基础、主体、屋面、室内外粉刷、明沟散水及水、电都在乙方施工承包合同范围内，待设计施工图审图盖章后再签正式施工合同。 2、三通一平、消防、电梯、外墙装饰、门窗、网络通信等弱电工程由甲方另外发包。 3、道路、绿化、亮化等附属工程由甲方另外发包。 二、承包工程价格 1、甲乙双方按照设计图纸所标明的工程内容，工程拟采用包干形式承包或预算定额式承包，在签订正式合同时甲乙双方再确定。 2、桩基工程单独核算。具体内容与造价由甲乙双方协商后确定并单独签订桩基承包合同。 3、土石方工程在正式合同内约定。 三、工程质量标准为合格工程。本工程严格按照国家规定的建筑工程施工质量验收规范、建筑工程质量检验及评定标准及相关配套文件进行施工和验收，质量标准合格。 四、工程保证金交纳及退还方式 1、工程保证金交纳 乙方在签订意向协议之日起 3 个工作日内向甲方交纳工程保证金壹佰万元，逾期该协议自动失效。 2、工程保证金初步约定分三次退还：第一次基础完成0退还25%；第二次主体完成退还25%；第三次竣工验收合格后退还50%。 五、工程付款方法 1、以保证工程款能直接用于本工程，本工程在整个过程中，工程款的拨付，甲方直接拨付给乙方委托人（即施工主要负责人），凭乙方单位委托人（即施工主要负责人）开具收据办理付款手续即可，结算时凭其工程正式建安发票（含税）办理总决算。建筑税、建安税、所得税由甲方代扣代缴。 2、与税收相关的税费由甲方代扣代缴。 3、归乙方负责的报建费用、计生保障费等由乙方承担。 4、工程劳动保证金、安全文明措施费等在正式合同中约定。 六、工程进度款的支付及结算 1、商业6#（三层）及Z5住宅（11层）： 施工期间按已完成工程量进度付款：完成基础0时并桩基验收合格后，付桩基工程工程款的95%；完成二层即三层楼面，付一层的工程施工总造价的50%；完成三层即四层楼面，付二层的工程施工总造价的50%；完成四层即五层楼面，付三层的工程施工总造价的50%；住宅按每完成四层付完成工程施工总造价的50%；屋面封顶，待屋面盖好小青瓦，付完成的工程施工总造价的50%。主体验收合格后，付足工程施工总造价的65%（含已付进度款）。装修粉刷完成一半时付工程施工总造价的5%；全部装修粉刷完成付5%；工程竣工验收合格付工程施工总造价的10%；余款15%在办理结算后30天内付工程施工总造价的10%，同时甲乙双方将工程竣工验收所有资料交由乙方统一汇总后给甲方归档，否则甲方不予乙方结算；工程结算总价的5%留作质保金，如无任何质量问题，质量保证金两年期满全部退还。 3、为了保证工程质量甲方有权制订工程材料和对材料进行认价，乙方必须根据甲方要求及质量标准采购工程材料。 七、违约责任： 1、因甲方原因造成的停工，由甲方驻现场项目经理和监理工程师认证后工期可以顺延。 2、因甲方原因造成的停建、缓建、甲方应在1个月内结算完毕并支付乙方已经完成的工程量的工程款。
