第一章: preliminary provisions
1.1 Definition and interpretation
1.1.1 The terms used in this Contract shall be interpreted as follows:
"Lessor" refers to the legal owner of the leased property.
"Lessee" refers to the individual or entity renting the leased property.
"Leased property" refers to the house/apartment located at ________, Dongguan.
"Lease term" refers to the period of time for which the Lessee is authorized to use the leased property.
"Rental amount" refers to the agreedupon amount to be paid the Lessee to the Lessor for the use of the leased property.
"This Contract" refers to the entire agreement between the Lessor and the Lessee.
1.2 Application and effectiveness of this contract
1.2.1 This Contract shall be effective upon the signatures of both the Lessor and the Lessee.
1.2.2 This Contract shall apply to the lease of the leased property for the lease term specified herein.
1.3 Law and jurisdiction
1.3.1 This Contract shall be governed and construed in accordance with the laws of the People's Republic of China.
1.3.2 Any disputes arising out of or in connection with this Contract shall be submitted to the appropriate courts in Dongguan, Guangdong.

第四章:Lease Term
4.1 Start and end date of the lease
4.1.2 The lease may be renewed upon mutual agreement of the parties upon expiration of the initial lease term.
4.2 Renewal option
4.2.1 The Lessee has the option to renew the lease for an additional term upon the expiration of the initial lease term, subject to the terms and conditions set forth in this Contract.
第五章:Rental Amount and Payment
5.1 Rental amount
5.1.1 The Lessee agrees to pay a rental amount of _______ (RMB) per month during the lease term.
5.1.2 The rental amount shall be paid the Lessee to the Lessor within _______ days after the date of receipt of the invoice or payment notice from the Lessor.
5.2 Payment terms and method

第六章:Maintenance and Repairs
6.1 Lessor's obligations
6.1.1 The Lessor shall maintain the leased property in a habitable condition throughout the lease term.
6.1.2 The Lessor shall be responsible for the repair and maintenance of the leased property and its associated facilities, excluding those caused the Lessee's fault or negligence.
6.2 Lessee's obligations

第八章:Damage and Loss
8.1 Damage caused lessee
8.1.1 The Lessee shall be responsible for any damage to the leased property or its facilities caused the Lessee's fault or negligence.
8.1.2 The Lessee shall notify the Lessor in writing of any damage to the leased property within _______ days after the occurrence of such damage.
8.2 Loss of lessee's belongings
8.2.1 The Lessor shall not be liable for any loss of the Lessee's belongings during the lease term.
8.2.2 The Lessee shall take appropriate measures to safeguard their belongings and shall not leave valuable items unattended in the leased property.
第九章:Subletting and Assignment
9.1 Lessee's right to sublet or assign
9.1.1 The Lessee may sublet or assign the leased property to a third party with the prior written consent of the Lessor.
9.1.2 The Lessee shall be solely responsible for any obligations arising from the subletting or assignment.
9.2 Lessor's consent requirement
9.2.1 The Lessor may withhold its consent for subletting or assignment if the proposed subtenant or assignee fails to meet the Lessor's criteria or if the Lessor has reasonable grounds to believe that such subletting or assignment may result in damage to the leased property.
第十章:Termination of Lease
10.1 Grounds for termination
10.1.1 The lease may be terminated either party upon the expiration of the lease term.
10.1.2 The Lessor may terminate the lease with cause, such as breach of this Contract the Lessee.
10.2 Notice of termination
10.2.1 Either party desiring to terminate the lease shall provide the other party with a written notice of termination at least _______ days prior to the desired termination date.
10.3 Return of the leased property
10.3.1 Upon termination of the lease, the Lessee shall return the leased property to the Lessor in good condition, normal wear and tear excepted.

第十一章:Dispute Resolution
11.1 Negotiation
11.1.1 The parties shall first attempt to resolve any disputes arising out of or in connection with this Contract through negotiation.

11.2.1 If the parties are unable to resolve the disputes through negotiation, either party may request mediation.
11.3 Arbitration
11.3.1 If the disputes cannot be resolved through mediation, the parties agree to submit the disputes to arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC).
第十二章:Miscellaneous
12.1 Entire agreement
12.1.1 This Contract constitutes the entire agreement between the Lessor and the Lessee, superseding all prior agreements, whether written or oral.
12.2 Amendments
12.2.1 This Contract may be amended or supplemented only a written instrument executed both parties.
12.3 Notices
12.4 Default
12.4.1 The failure of either party to enforce any provision of this Contract shall not be deemed a waiver of such provision or any other provision of this Contract.
12.5 Indemnification
12.5.1 The Lessee shall indemnify and hold harmless the Lessor from any claims, demands, actions, liabilities, or expenses arising out of or in connection with the Lessee's use of the leased property.
第十三章:Additional Agreements
13.1 List of attachments
13.1.1 Any attachments to this Contract, such as maps, plans, or specifications, are part of this Contract and shall be considered as integral parts hereof.
13.2 Special provisions
13.2.1 Any special provisions agreed upon the parties that are not inconsistent with the provisions of this Contract shall be set forth in an addendum attached hereto.

附加条款一:甲方为主导时的特殊约定
1.1 甲方权利和义务的扩展
1.1.1 甲方有权对租赁物进行定期检查,以确保租赁物的合理使用和维护。乙方应配合甲方的检查,并提供必要便利。
1.1.2 甲方应保证租赁物的设施和设备正常运行,如因设施故障导致乙方损失的,甲方应承担相应责任。
附加条款二:乙方为主导时的特殊约定
2.1 乙方权利和义务的扩展
2.1.1 乙方有权在租赁期内提出对租赁物的合理改进要求,甲方应在收到改进要求后_______天内予以回复。如甲方不同意改进要求,乙方有权终止本合同。

二、违约行为及认定:
1. 甲方未按约定时间交付租赁房屋,或交付的房屋不符合约定的,视为甲方违约。

3. 甲方未按约定进行房屋维修和维护,导致房屋损坏或无法使用的,视为甲方违约。
4. 乙方未合理使用租赁房屋,导致房屋损坏或无法使用的,视为乙方违约。
5. 中介提供虚假租赁信息,导致甲方或乙方损失的,视为中介违约。
三、法律名词及解释:
1. 租赁合同:指出租方将租赁物交付给承租方使用,承租方支付租金的合同。
2. 租金:指承租方为使用租赁物支付给出租方的费用。
3. 租赁押金:指承租方为保证履行租赁合同约定而支付给出租方的押金。
