3、方在平等、 自愿、 公平和老实信用基础上, 经协商一致, 就乙方承租甲方可依 出租 (出租) 商品房 (房屋/商品房)事宜, 签订本协议。 In accordance with the Laws of Contract of the People’s Republic of China and the Tenancy Regulations of the Shanghai Municipality (hereinafter referred to as “the Provisions”), Party A and Party B, having reached an a
4、greement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B. 一、 出租房屋情况 Condition of the Lease or Pre-Lease Property 1-1甲方 出租 (出租)给乙方房屋座落在本市 (区/县)

8、eveloped a lessor/lessee relationship. Before the signing of this Contract, Party A has already informed Party B that the Property subject to a mortgage. 1-3该房屋公用或适用部位使用范围、 条件和要求; 现有装修、 隶属设施、 设备情况和甲方同意乙方自行装修和增设隶属设施内容、 标准及需约定相关事宜, 由甲、 乙双方分别在本协议附件(二)、 (三)中加以列明。甲、 乙双方同意该附件作为甲方向乙方交付该房屋和本协议终止时乙

Party A and Party B have agreed the said Appendix shall represent the condition of the Property at the time of hand over of the Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Contrac
11、t. 二、 租赁用途 Purpose of the Property 2-1乙方向甲方承诺, 租赁该房屋作为 住宅 使用, 并遵守国家和本市相关房屋使用和物业管理要求。 Party B warrants to Party A that the Property shall be used for Residential purpose and follows the regulations of the State and this Municipality in relation to the use and management of P
12、roperty. 2-2乙方确保, 在租赁期内未取得甲方书面同意以及按要求须经相关部门审批核准前, 不私自改变上款约定使用用途。 Party B guarantee that during the lease term, it shall not alter the purpose of the Property without Party A‘s prior written consent as well as the approval from the relevant governmental department. 三、 交付日期和租赁期限 Delivery Dat

14、until . 3-2租赁期满, 甲方有权收回该房屋, 乙方应准期返还。乙方需继续承租房屋, 则应于租赁期届满前 2个月, 向甲方提出续租书面要求, 经甲方同意后重新签署租赁协议。 Upon expiry of the lease term, Party A shall have the right to repossess the Property in its entirety and Party B shall deliver it up accordingly. If Party B wishes to renew the lease, it shall
15、submit such intent in writing to Party A two months prior to the expiry of the lease and sign a new lease contract with the consent of Party A. 四、 租金、 支付方法和期限 Rent, Method of Payment and Term 4-1甲、 乙双方约定, 【出租】月租金人民币( )(大写: )。该房屋租金

19、租金, 即(人民币贰万贰仟元整 )。甲方收取确保金后应向乙方开具收款凭证。 租赁关系终止时, 甲方收取房屋租赁确保金除用以抵充协议约定由乙方负担费用外, 剩下部分一周内无息归还乙方。 Party A and Party B have agreed that at the time of the hand over of the Property by Party A, Party B shall pay to Party A a rental deposit of the Property, the deposit shall be Two months of rent, that is

21、g off the fees and expenses borne by Party B under the Contract without interest within one week. 5-2租赁期间, 使用该房屋所发生水、 电、 煤气、 通讯费用及ADSL安装费由 乙方 (甲方/乙方)负担。其她物业管理费、 卫星电视收视费和现场家庭会所卡两人, 均由 甲方 (甲方/乙方)负担。 During the lease term, the water, electricity, gas, communication of the Property, ADSL usage
22、 fee and other fees resulted from the use of the Property shall be borne by Party B. All other management fee , satellite TV installation, onsite club membership card shall be borne by Party A . 5-3 乙方 (甲方/乙方)负担上述费用, 计算或分摊措施、 支付方法和时间: 依据上述企事业单位列出帐单凭证支付, 如不按期付款, 滞纳金由乙方负担。 Party B
23、 shall be responsible to pay the above fees and charges, the computation or amortization, method and time of payment: According to the demand notes, if delaying payment, Party B should be responsible for the penalty. 六、 房屋使用要求和维修责任 Standard Required for Use of Property and Responsibilit
24、y of Property Maintenance and Repair 6-1租赁期间, 乙方发觉该房屋及其隶属设施有损坏或故障时, 应立刻通知甲方修复; 甲方应在接到乙方通知后 日内进行维修。逾期不维修, 乙方可代为维修, 费用由甲方负担。 During the lease term, if Party B discovers any damages or defects of the Property and facilities attached, it shall notify Party A immediately for repair. Party A
25、 shall carry out the repair within days after receiving notification from Party B. Any delay in repair may be repaired by Party B on Party A’s behalf and the expenses incurred shall be borne by Party A. 6-2租赁期间, 乙方应合理使用并珍惜该房屋其隶属设施。因乙方使用不妥或不合理使用, 致使该房屋及其隶属设施损坏或发生故障, 乙方应负责维修。乙方拒不维修, 甲方可代为维修, 费用
26、由乙方负担。 During the lease term, Party B shall reasonably use and take good care of the Property and the facilities attached. Party B shall be responsible to repair immediately the damages caused to the Property and/or facilities due to improper and unreasonable use by Party B. If Party B refuses to
27、 repair, Party A may repair on its behalf and the expenses incurred shall be borne by Party B. 6-3租赁期间, 甲方确保该房屋及其隶属设施处于正常可使用和安全状态。甲方对该房屋进行检验、 养护, 应提前 日通知乙方。检验养护时, 乙方应给予配合。甲方应降低对乙方使用该房屋影响。 During the lease term, Party A shall guarantee the normal usable and safe condition of the Property and
28、facilities attached. Party A shall notify Party B days in advance before carrying out examination and maintenance works. Party B shall render cooperation during the examination and maintenance. Party A shall reduce the effect caused to Party B in using the Property. 6-4乙方需装修或者增设隶属设施和设备, 应事
29、先取得甲方书面同意, 按要求须向相关部门审批, 则还应由 甲方 (甲方/甲方委托乙方)报请相关部门同意后, 方可进行。乙方增设隶属设施设备归属及其维修责任由甲、 乙双方另行书面约定。 Except for Appendix 3 of this Contract, before carrying out any extra renovation or addition of facilities attached and equipment, Party B shall obtain the written consent of Party A and submit the same
30、 to the relevant authority for examination and approval in accordance with the regulations. The works could only be carried out upon completion of the procedure of approval with the relevant authority by Party A . The responsibility of the maintenance of the added facilities by Party B shall be
31、agreed by Party A and Party B in separate written agreement. 七、 房屋返还时状态 Condition of Property at Delivery Back 7-1除甲方同意乙方续租外, 乙方应在本协议租期届满后 日内返还该房屋, 未经甲方同意逾期返还房屋, 每逾期一日, 乙方应按 向甲方支付该房屋占用期间使用费。 Except for the renewal of lease agreed by Party A, Party B shall deliver up the Property within
32、 after the expiration of lease term of this Contract. Late delivery of the Property without the consent of Party A shall be subject to a charge for adverse possession of the Property at time of rent per day. 7-2乙方返还该房屋应该符合正常使用后状态。返还时, 应经甲方验收认可, 并相互结清各自应该负担费用。 The Property at the ti
33、me of delivery up by Party B shall be of a condition after normal use. The delivery up shall be examined and authorized by Party A and the fee and charges responsible by the parties shall be cleared at the time of delivery up. 八、 转租、 转让和交换 Sublease, Assignment and Exchange 8-1除甲方已在本协议补充条款中
34、同意乙方转租外, 乙方在租赁期内, 需事先取得甲方书面同意, 方同将该房屋部分或全部转租给她人。但同一间居住房屋, 不得分割转租。 Unless otherwise agreed in the supplementary clauses of this Contract, Party B shall obtain the written approval from Party A before it could sublease part or all of the Property to a third party during the lease term. Party B shall
35、not sublease part of the Property or sublease to two lessees or more than two lessees at the same time. 8-2乙方转租该房屋, 应按要求与接收转租方签订书面转租协议。并按要求向该房屋所在区、 县房地产交易中心或农场系统受理处办理登记立案。 When Party B subleases the Property, it shall enter into a sublease contract with the lessee in writing in accordance with t
36、he regulations. The sublease contract shall be registered and filed with the Real Estate Trade Management Department or the Ministry of Agricultural Systems where the Property is located. 8-3在租赁期内, 乙方将该房屋转让给她人承租或与她人承租房屋进行交换, 必需事先取得甲方书面同意。转让或交换后, 该房屋承租权受让人或交换人应与甲方签署租赁主体变更协议并继续推行本协议。 During the
37、lease term, Party B shall obtain the written consent from Party A before assigning the Property to a third party for sublease or exchange the Property subleased by a third party. After the assignment or exchange, the assignee of the Property or the party to the exchange shall sign the Contract for
38、the amendment of the lease and continue to enforce this Contract. 8-4在租赁期内, 甲方如需出售该房屋, 应提前三个月通知乙方。乙方在相同条件下有优先购置权。若乙方无意购置该物业, 本租赁协议继续生效。 During the lease term, if Party A shall sell the Property, it shall notify Party B 3 months in advance. Party B shall have the priority to purchase under the
39、 same conditions. 九、 解除本协议条件 Conditions for Terminating this Contract 9-1甲、 乙双方同意在租赁期内, 有下列情形之一, 本协议终止, 双方互不负担责任: Party A and Party B have agreed that during the lease term, this Contract shall be terminated under any of the following circumstances and both parties shall not be held resp
40、onsible as a result thereof: (一) 该房屋占用范围内土地使用权依法提前收回; The right to use of land within the scope of the Property was early resumed in accordance with the laws; (二) 该房屋因社会公共利益被依法征用; The Property was resumed for public interests; (三) 该房屋因城市建设需要被依法列入房屋拆迁许可范围; The Property has been classified
41、as premises to be demolished according to the law for the need of town planning; (四) 该房屋毁损、 灭失或者被判定为危险房屋; Damages, fire hazards occurred to the Property or otherwise been classified dangerous premises; (五) 甲方已通知乙方该房屋出租前已设定抵押, 现被处分。 Penalty as a result of the mortgage created over the Property a
42、s notified to Party B by Party A before the lease; 9-2甲、 乙双方同意, 有下列情形之一, 一方可书面通知另一方解除本协议。违反协议一方, 应向另一方按月租金 2 倍支付违约金; 给对方造成损失, 支付违约金不足抵付一方损失, 还应赔偿造成损失与违约金差额部分: Party A and Party B have agreed that one party may terminate this Contract by written notice to the other party under any of the foll
43、owing circumstances. The party in breach shall pay to the other party a penalty of 2 times of the rent per month; if damages is caused to the other party and the penalty is not sufficient to offset the damages of the other party, the party in breach shall also compensate for the difference bet
44、ween the penalty and the damages caused: (一)甲方未按时交付该房屋, 经乙方催告后 7 日内仍未交付; Party A fails to deliver up the Property accordingly and remain fail to deliver within 7 days after demand given by Party B; (二)甲方交付该房屋不符合本协议约定, 致使不能实现租赁目; 或甲方交 付房屋存在缺点, 危及乙方安全。 The Property delivered up by Pa
45、rty A falls short of the agreement of this Contract, causing failure to realize the purpose of the lease; or the Property delivered by Party A is defective and affects the safety of Party B; (三)乙方未取得甲方书面同意改变房屋用途, 致使房屋损坏; Party B alters the use of the Property without the written consent of Part
46、y A, causing damages to the Property; (四)因乙方原因造成房屋主体结构损坏; Damages caused to the main structure of the Property attributable to Party B; (五)乙方私自转租该房屋、 转让该房屋承租权或与她人交换各自承租房屋; Party B subleases the Property, assigns the Property to or exchanges the Property with the third party without consent
47、 (六)乙方逾期不支付租金累计超出 壹 月; Party B fails to pay rent for over 1 months; 十、 违约责任 Liabilities for Breach of Contract 10-1该房屋交付时存在缺点, 甲方应自交付之日起 日内进行修复, 逾期不修复, 甲方同意降低租金并变更相关租金条款。 For defects exist at the time of delivery of the property, Party A shall perform the repair work wi
48、thin days after the delivery, in the event of delay and non-repair, Party A agrees to reduce the rent payable and alters the relevant rental provisions. 10-2因甲方未通知乙方, 该房屋出租前已抵押或产权转移已受到限制, 造成乙方损失, 甲方应负责赔偿。 Party A shall be liable to compensation for loss incurred by Party B due to Party A’s
49、 failure in notifying Party B of the restriction of the Property under mortgage or assignment of interests before the lease of the Property. 10-3租赁期间, 甲方不立刻推行本协议约定维修、 养护责任, 致使房屋损坏, 造成乙方财产损失或人身伤害, 甲方应负担赔偿责任。 During the lease term, if Party A fails to perform the duties of maintenance and repair u
50、nder this Contract, causing damages or losses to the Property and/or personal injuries to Party B, Party A shall be liable to compensation. 10-4租赁期间, 非本协议要求情况, 甲方私自解除本协议, 提前收回该房屋, 甲方应按月租金 2 倍向乙方支付违约金。若违约金不足抵付乙方损失, 甲方还应负责赔偿。 During the lease term, if Party A terminates this Contract and takes
