单位委派留学协议书
The Study Aboard Agreement of Unit Assignment

 甲方的法定代表人(姓名)________委托本单位_______ (姓名)为代理人与_____ (单位、姓名、性别、出生年月、住址)(简称乙方)，就甲方派遣乙方出国留学事宜，签订如下协议：
The legal representative of first party (Name)_____entrust our unit____ (Name)as his/her agent to make following agreements with____(Unit、 Name、 Gender、 Date of birth、 Address)(The second party) for the relevant matters of her/his appointment to study aboard:
 第一条 甲方根据人才培养和事业发展的需要，派遣乙方出国留学培训，乙方接受甲方的派遣。
Article 1 The first party assigned the second party to study aboard based on the requirement of personnel training & career development and the second party take this assignment.
 第二条 甲方派遣乙方以______ 身份赴______ 国留学，期限为______ 年______ 个月(自出国之日起计算)。
Article 2 The first party assigned the second party as____to study aboard at____and the term of this assignment will be_______(starts from the date went aboard).
 第三条 甲方在乙方出国留学期间，指定__________(姓名、单位、职称)对乙方给予必须的业务指导。
Article 3 The first party appoints _____(Name、Unit、Title) to provided the second with integrant guidance during study aboard.
 第四条 甲方对乙方留学期间在国内的直系亲属，根据国家的政策、规定，给以必要的关心和帮助。
Article 4 According to related national policy and regulation, the first party should be concerned with the domestic lineal relative of the second party during study aboard.
 第五条 甲方在乙方回国后，负责安排乙方的工作，并积极创造必要的工作和生活条件，发挥乙方的作用。
Article 5 After returned, the first party is obliged to arrange suitable job for the second party with integrant living conditions for fully played of her/his ability
 第六条 乙方保证按本协议书第二条、第三条的规定，在国外努力完成学业，并按期回国服务。留学期间每____ 个月向甲方报告一次学习情况。
Article 6 The second party promise to work hard and back to work after accomplish her/his study in accordance with Article 2 & 3 of this agreement. Every____month, the learning record should be submitted to the first party for review.
 第七条 乙方抵达留学所在国后，一个月内向中国驻该国使、领馆报到。乙方在国外期间，保证遵守中国法律对出国留学人员的规定，遵守所在国的法律。
Article 7 After arrived at host country, the second party have to register at Chinese embassies or consulates within one month. The second party promised to comply with the provisions of Chinese laws on staff studying overseas and also the laws of the host country.
 第八条 乙方无论因何种理由需中止、延长留学期限或改变留学内容，均应至少提前3个月通过中国驻留学所在国使、领馆向甲方提出书面申请，未经甲方批准，不得改变。
Article 8 No matter what kinds of reason the second party wants to terminate/extend the term or even change the contents of study, an written application have to be submitted to the first party through Chinese embassies or consulates at least three months in advance. The original plan should not be changed without the ratification
 第九条 乙方留学期满回国后，应在一个月内向甲方报到，按甲方规定办理有关手续。乙方须根据本协议书第三条的规定，向甲方提交书面的留学总结、学术报告(或科研论文、科研成果报告)。
Article 9 After complete her/his study, the second party should report for duty within one month and deal with relevant formalities as require. The written study summary /academic report (or research paper/achievement report) should be submitted by the second party in accordance with Article 3 of this agreement
 第十条 乙方有责任回国后至少在甲方工作____ 年。缩短工作年限，由甲方决定。
Article 10 The second party is obliged to work for the first party at least____years after returning. The shorten of working period can only determined by the first party.
 第十一条 甲方在认为必要时，有权决定将本协议书的副本经由我驻外使、领馆提交乙方留学所在国的有关部门或个人。
Article 11 The first party have the power to decide to submit copy of this agreement to the authorities or individual concerned of host country through Chinese embassies or consulates if necessary.
 第十二条 甲方违反本协议书时，乙方有权向甲方的上级主管部门提出申诉，要求甲方的上级主管部门责成甲方执行本协议书，赔偿损失等。必要时，乙方可向中国的司法机关起诉，追究甲方的法律责任。
Article 12 The second reserve the right to appeal to the superior departments in charge of the first party for the execution of the agreement or compensation of loss if violation occur and caused by the first party. The second party can prosecute to the Chinese judiciary authorities and apply investigation for legal responsibility of the first party if necessary.
 乙方违反本协议书时，甲方将根据乙方违约情况，对乙方批评教育，或给予行政处分，或停薪留职，或要求乙方赔偿损失；必要时，甲方可将乙方违约的事实通知乙方留学所在国的有关部门或个人，或向司法机关起诉，追究乙方的法律责任。
The first party will throw the the second party with criticism and education or administrative sanction or leave without pay or ask for compensation of loss on the basis of her/his default. The first party can notify the default of the second party to the authorities or individual concerned of host country or prosecute to the Chinese judiciary authorities and apply investigation for legal responsibility of her/him.
 第十三条 甲方与保证人因保证事项而发生纠纷时，经双方同意，可由甲方的上级主管部门裁决。
Article 13 If disputes occur for guarantee issues between the first party and the guarantor, they can ask for adjudication of the superior departments in charge of the first party with both agree.
 第十四条 本协议书自公证之日起生效，签字各方保证遵照执行。有效期限至本协议书第十条规定的工作年限期满时止。
Article 14 This Agreement shall come into force from the date of signature notarized and all the parties ensured for compliance.The effective period of this agreement until the provision date of Article 10.
 必要时，经甲方、乙方、保证人三方协商一致后，可对本协议书进行修改或补充。
With the consensus of the first party、the second party and guarantor, they may carry out the revision or supplement for this agreement if necessary.
 本协议书正本一式四份，甲方持两份，乙方和乙方的保证人各持一份，具有同等效力。
Four original agreements will be issued, the first party will hold two of them and the rest will be kept by the second party and the guarantor, both of them have the same effect.
