2、this letter and its conditions, will operate commencing from the “Start Date”. Set out below are the basic terms which are to apply to your engagement. These terms are to be read together with the award /agreement. Together, these two documents will govern your employment. We recommend that you
3、acquaint yourself with this award/agreement if you have not already done so. 1. Start Date a. You employment with the company will commence on 12 February 2018 (the “start date”) and you will have 3month probation period ,your commencement of you appointment is conditional and subject to: i
4、 Our completion of all pre-employment screening processing to the satisfaction of the Company in its absolute discretion, including without limitation reference check or verification of the certificates and/or testimonials/ reference in relation to your personal background, academic education, prof
5、essional qualification and/or past employment; and ii. You successfully applying for and being granted all necessary and appropriate visas permitting you to stay and work in Hong Kong during your appointment from the Immigration Department of the Hong Kong Special Administrative Region (the “visa
6、) and/or any other applicable authority. b. If you are approved to commence work prior to the finalization of the pre-employment screening and unsatisfactory result or verification is discovered by the Company afterward, your employment may be terminated by the Company without notice during the
7、first month of your probation period, if any, and thereafter on seven (7) days’ notice or payment in lieu of notice. 2. Position and Division / Department Title: Division / Department: Operation Department The Company shall be entitled to transfer or second you to other division(s) /
8、department(s). 3. Duties In this employment, you will be expected to undertake such reasonable duties as the Company shall from time to time determine in respect of the role and responsibilities of your position. Your duties include but are not limited to: . 4. Hours of work Your
9、normal hours of work are from 9:00 a.m. to 6:00 p.m. or 10am to 7:00pm Monday to Friday with a one hour lunch breaks per day (“your normal weekly hours”). 5. Remuneration a. Basic Salary Your basic salary will be HK$25,000 per month on a 13-month per year basis. The salary is payable in a
10、rrears on the last day of each month (or on any other day as designated by the Company). b. Discretionary Bonus You may be considered for an annual discretionary bonus to be awarded at the sole and absolute discretion of the Company. Whether you will be awarded a discretionary bonus will be
11、determined based on a number of factors, including but not limited to the internal human resources policies, the financial performance of your relevant business unit, department or division, and your own individual performance which will be assessed by reference to both your financial performance an
12、d other non-financial factors including but not limited to your continued compliance with all regulatory and legal requirements, policies and procedures of the Company. You acknowledge and agree that you do not have a contractual entitlement to receive a discretionary bonus award. The award of a
13、discretionary bonus in any year shall not give rise to an expectation of payment or amount of any bonus in any future year of employment and you acknowledge that you may receive a nil bonus. The Company reserves the right to review, amend, modify and terminate its discretionary bonus scheme fro
14、m time to time as it may require. c. Quarterly Bonus Each quarterly bonus around HK 6000 6. Annual Leave In addition to the general holidays (excluding Sundays) published in the Government Gazette in accordance with the General holidays Ordinance, you are entitled to take up to 8 working d
15、ays’ paid annual leave (inclusive of statutory annual leave) for each calendar year, which will be the leave year. Your annual leave entitlement will be pro-related from the Start Date. Annual leave is to be taken at times mutually agreed in advance with the Company. The Company reserves the rig
16、ht to require that annual leave in excess of your statutory annual leave be taken at times determined by the Company. Annual leave (other than statutory annual leave) may not be carried forward from one leave year to the next unless as notified and/or agreed in writing by the Company. For the avo
17、idance of doubt, you will be deemed to have taken your entitlement to statutory leave first in any leave year. No payment in lieu will be paid for annual leave not taken. However, on termination of your employment, you will be entitled to payment in lieu of any accrued leave entitlement outstanding
18、for that leave year calculated on a pro-related basis. If on the date of termination you have taken holiday in excess of your accrued entitlement you agree to reimburse such excess to the Company, calculated on the same basis. 7. Benefits a. Mandatory Provident Fund Scheme: You will be eligibl
19、e to participate in the Company’s Mandatory Provident Fund Scheme after sixty (60) days of employment or according to the statutory requirement. b. Medical and Disability: You will also be entitled to participated in the Company’s medical benefits scheme and personal accident insurance scheme sub
20、ject to the applicable terms and conditions. c. Other benefits will be provided in accordance with the Company’s policy as amended from time to time. The Company reserves the right, in its sole and absolute discretion, to amend, reduce or remove any benefits referred to in this letter and/or o
21、ther relevant internal human resources polices at any time. If any scheme provider (including but not limited to any insurance company) refuses for any reason to provide any benefits to you, the Company shall not be liable to provide any such benefits itself or any compensation in lieu. 8. Taxati
22、on You shall be personally responsible for all the salaries taxes required by the government of any country for the services you render to our Company, associate affiliate or parent of the Company during the course of our employment. 9. Termination of Employment a. Upon appointment, you sh
23、all be placed as a permanent staff member of the Company in writing, your employment may be terminated by either party giving at any time not less than (1) one month’s notice in writing of termination or (1) one month’s wage in lieu of notice. b. At any time during your employment with the Compan
24、y, your service may be terminated summarily without any notice or payment in lieu of notice if you: i. Conduct yourself in a manner inconsistent with the due and faithful discharge of your duties or are guilty of misconduct, fraud, dishonesty; ii. Willfully disobey a lawful and reasonable order;
25、 iii. Become bankrupt or enter into an arrangement with your creditors; iv. Are convicted of any criminal offence in Hong Kong or elsewhere (except minor traffic offences); v. Commit any serious breach of any terms of this letter; or vi. On any other ground on which the Company would be entitled
26、 to terminate your employment without notice at common law. c. Should the Company terminate your employment for any reason, all of your post termination obligations contained in this agreement in particular the confidentiality and further undertaking provisions shall remain in full force and effe
27、ct. 10. Miscellaneous a. The expiration or termination of this letter howsoever arising shall not operate to effect such of the provisions hereof as in accordance with their terms are expressed to operate or have effect thereafter. b. In the event of any variation of the remuneration payabl
28、e to you hereunder being made by consent of the parties hereto such variation shall not constitute a new agreement but your employment hereunder shall continue subject in all respects to the terms and conditions of this letter with such variation as aforesaid. c. If at any time any provision of t
29、his letter is or becomes illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of this letter shall not be affected or impaired thereby. The terms of this letter shall in all and every aspects be governed by and construed accor
30、ding to the laws of Hong Kong and shall supersede all previous agreements, whether verbal or in writing, if any, between us in relation to the matters dealt with herein and represent the entire understanding between us in relation to your employment. The Company reserves the right to vary the terms
