XUE YU SI EDUCATION Employment Agreement
I.The two parties of agreement.

Party A（signature）：_________　 Party B（signature）：_________

II._______has engaged_________(nationality) ________（English name）________（Chinese name）as_________teacher，Both parties, in line with the principles of legality, fairness, equality, mutual agreement, honesty, and trustworthiness, on a voluntary basis, and in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill all the obligations stipulated hereinafter.

III. The duration of service is from ___,___,_____to ___,_

IV. The Party A pays the Party B a salary of RMB 150 per hour. Each class lasts two hours with a 5-10 minutes break. The class time is from 10 to 12 a.m. on Saturday morning.

V.Party A’s Obligations:
　　 1．Party A shall provide Party B with necessary working conditions.
　 2．Party A shall conduct regular supervision, inspection and review of Party B’s working performance.
3. Party A shall pay Party B’s salary as scheduled, settlement should be made at the end of the month every month, Party A shall pay Party B’s salary before the 10th of next month.

VI. Party B’s Obligations:
1.Party B shall fulfill the tasks assigned to him/her with high standards within the prescribed timeframe.
2.If party B is unable to perform this contract due to special reason, Party B has the responsibility to introduce another foreign teacher for party A, until the foreign teacher meets party A’s satisfaction.
3.If there are unexpected events happen to Party B, such as: Party B get otherthings to do, sick leave or other activities, which result in normal teaching can not be guaranteed. Party B should inform Party A at least two days in advance.Otherwise, Party A can deduct at least RMB 200 from Party B’s salary every time.

VII. Revision, Cancellation and Termination of the Contract:
1．Both parties shall abide by the contract and shall refrain from revising, canceling, or terminating the contract without mutual consent.
2．This contract can be revised, canceled and terminated with mutual consent. Before both parties have reached an agreement, the contract shall be strictly observed.
3.Under the following conditions, Party A shall have the right to inform Party B in writing of the cancellation of this contract:
a. Party B fails to fulfill this contract or the obligations and agreed conditions as herein stipulated, and fails to amend his/her actions after Party A has pointed it out;
b. On the basis of the physician’s diagnosis, Party B fails to resume normal work after a sick leave for a period of successive 30 days　
4. If Party A fails to pay Party B as scheduled, Party B has the right to inform Party A in writing of the cancellation of this contract

Ⅷ. Under the following conditions, Party A shall have the right to deduct RMB50-200 from Party B’s salary in that month, if the circumstances are serious, Party A may unilaterally terminate the contract:
a. Be late for class,left early, absence, or leave the classroom optionally.
b. Not to perform procedures, change or suspend the class without authorization.
c. Suspending the class more than two times (including two times )with normal procedure
d. Giving lectures without teaching plan.
e. Fail to perform the contract or break the rules of the training center.
Ⅸ. This contract shall take effect upon being signed by both parties and shall be automatically terminated upon expiration. When either party requires signing a renewed contract, it shall forward its request to the other party 60 days prior to the expiration of this contract, and both parties shall sign the new contract through consultations and mutual consent.
This contract is signed by both parties on___,___,_____ (date).This contract is in duplicate, each in both Chinese and English versions, and both shall take effect upon being signed at the same time.

学与思教育聘用外籍教师协议
1. 协议双方
甲方（签字）：__________ 乙方（签字）__________-
2. ____________聘用________(国籍) ___________(英文名)_________(中文名)_________ 作为一名英语教师。双方在合法，公平，平等，互利以及诚实，互信，在双方自愿的基础上，秉承友好合作的精神，同意签署该协议以此督促双方完成各自协议中所规定的义务和职责。
3. 聘用期期限_____ _____ ______到 ______ _______ ________
4. 甲方支付给乙方每个小时______ 人民币，每次课按两个小时标准。每周一次课。上课时间为周六上午10点至12点。
5. 甲方义务
a． 甲方提供乙方必要工作条件。
b． 甲方定期考察，监督，审核乙方的工作表现。
c． 甲方准时支付给乙方工资，每月月底支付，最迟不超过次月10日。
6. 乙方义务
a. 乙方须在规定时间内保质保量的完成分配工作。
b. 如果由于特殊原因，乙方不能履行合同，乙方须找另外一名外籍教师接替，该名教师须符合校方要求。
c. 如果乙方有特殊情况发生，如有其它事情，生病或其它安排导致教学不能正常进行，乙方应提前两天告知甲方，否则，甲方有权将每次扣除乙方工资200元人民币。
7. 更改、取消和终止该协议：
a. 双方应遵守该协议，未取得双方同意，不得修改、取消、或终止协议。
b. 该协议在双方同意的情况下，可更改、订正和终止。在双方取得一致意见前，应继续严格执行该协议。
c. 在以下情况下，甲方有权以书面形式告知乙方终止合同：
i. 乙方未履行该合同，或合同规定的义务和协商条款，并且在甲方郑重指出乙方问题时，乙方仍不修正。
ii. 基于健康诊断书，乙方请病假持续30天而未进行正常教学工作。
d. 如果甲方未准时支付乙方工资，乙方有权以书面形式告知甲方终止合同。
8. 以下情况，甲方有权从乙方一个月工资中扣除50-200元，如情节严重，甲方将单方面终止该协议：
a. 上课迟到，早退，缺席或擅自自由出入教室。
b. 不依照程序上课，私自更改，暂停课程。
c. 未按照正常程序，私自停课2次以上（包含两次）。
d. 未准备课程就授课。
e. 不履行协议，违反学校规定。
9. 该协议将在双方签订之后立即生效，到期自动终止。如须续签，须在到期之日前60天告知另一方，双方须经协商和征得双方一致同意的情况下签订合同。
10. 该份合同签署于_____ _____ _____(日期), 该协议一式两份，每份包含中文和英文版，两份在签署之日起同时生效。
