中华人民共和国固体废物污染防治法中英对照中华人民共和国固体废物污染防治法Law of the Peoples Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste第一条为了防治固体废物污染环境，保障人体健康，促进社会主义现代化建设的发展，制定本法。 Article 1 This Law is enacted for the purpose of preventing and controlling environmental pollution by solid waste, safeguarding human health and promoting the development of socialist modernization drive. 第二条本法适用于中华人民共和国境内固体废物污染环境的防治。 Article 2 This Law shall apply to the prevention and control of environmental pollution by solid waste within the territory of the Peoples Republic of China. 固体废物污染海洋环境的防治和放射性固体废物污染环境的防治不适用本法。 This Law shall not apply to the prevention and control of marine environmental pollution by solid waste or of environmental pollution by radioactive solid waste. 第三条国家对固体废物污染环境的防治，实行减少固体废物的产生、充分合理利用固定废物和无害化处置固体废物的原则。 Article 3 The State shall, in preventing and controlling environmental pollution by solid waste, implement the principles of reducing the discharge of solid waste, fully and rationally utilizing solid waste, and making it hazardless through treatment. 第四条国家鼓励、支持开展清洁生产，减少固体废物的产生量。 Article 4 The State encourages and supports clean production and reduced discharge of solid waste. 国家鼓励、支持综合利用资源，对固体废物实行充分回收和合理利用，并采取有利于固体废物综合利用活动的经济、技术政策和措施。 The State encourages and supports the comprehensive use of resources, full recovery and rational utilization of solid waste, and adopts economic and technical policies and measures that facilitate the comprehensive use of solid waste. 第五条国家鼓励、支持有利于保护环境的集中处置固体废物的措施。 Article 5 The State encourages and supports adoption of measures for centralized treatment of solid waste in favor of environmental protection. 第六条县级以上人民政府应当将固体废物污染环境防治工作纳入环境保护规划，并采取有利于固体废物污染环境防治的经济、技术政策和措施。 Article 6 The peoples governments at or above the county level shall include the prevention and control of environmental pollution by solid waste into their environmental protection programs and adopt economic and technical policies and measures to facilitate the prevention and control of environmental pollution by solid waste. 第七条国家鼓励、支持固体废物污染环境防治的科学研究、技术开发、推广先进的防治技术和普及固体废物污染环境防治的科学知识。 Article 7 The State encourages and supports scientific research, technological development, and dissemination of advanced prevention and control technology as well as of scientific knowledge in the field of prevention and control of environmental pollution by solid waste. 第八条各级人民政府对在固体废物污染环境防治工作以及相关的综合利用活动中作出显著成绩的单位和个人给予奖励。 Article 8 The peoples governments at various levels shall give awards to units and individuals that have achieved outstanding successes in the prevention and control of environmental pollution by solid waste and in its comprehensive use. 第九条任何单位和个人都有保护环境的义务，并有权对造成固体废物污染环境的单位和个人进行检举和控告。 Article 9 Any unit and individual shall have the obligation to protect the environment and shall have the right to report or file charges against units or individuals that cause environmental pollution by solid waste. 第十条国务院环境保护行政主管部门对全国固体废物污染环境的防治工作实施统一监督管理。 Article 10 The competent administrative department of environmental protection under the State Council shall conduct unified supervision and management of the prevention and control of environmental pollution by solid waste throughout the country. 国务院有关部门在各自的职责范围内负责固体废物污染环境防治的监督管理工作。 The relevant departments under the State Council shall be responsible for supervision and management of the prevention and control of environmental pollution by solid waste within their respective functions and responsibilities. 县级以上地方人民政府环境保护行政主管部门对本行政区域内固体废物污染环境的防治工作实施统一监督管理。 The competent administrative departments of environmental protection of the local peoples governments at or above the county level shall conduct unified supervision and management of the prevention and control of environmental pollution by solid waste within their administrative areas. 县级以上地方人民政府有关部门在各自的职责范围内负责固体废物污染环境防治的监督管理工作。 The relevant departments of local peoples governments at or above the county level shall be responsible for supervision and management of the prevention and control of environmental pollution by solid waste within their respective functions and responsibilities. 国务院建设行政主管部门和县级以上地方人民政府环境卫生行政主管部门负责城市生活垃圾清扫、收集、贮存、运输和处置的监督管理工作。 The competent administrative department of construction under the State Council and the competent administrative departments of environmental sanitation of the local peoples governments at or above the county level shall be responsible for supervision and management with regard to cleaning up, collection, storage, transportation and treatment of urban house refuse. 第二章 固体废物污染环境防治的监督管理 CHAPTER II SUPERVISION AND MANAGEMENT OF THE PREVENTION AND CONTROL OF ENVIRONMENTAL POLLUTION BY SOLID WASTE 第十一条国务院环境保护行政主管部门建立固体废物污染环境监测制度，制定统一的监测规范，并会同有关部门组织监测网络。 Article 11 The competent administrative department of environmental protection under the State Council shall establish a system for monitoring environmental pollution by solid waste, formulate unified monitoring standards and, in conjunction with relevant departments, set up a monitoring network. 第十二条建设产生工业固体废物的项目以及建设贮存、处置固体废物的项目，必须遵守国家有关建设项目环境保护管理的规定。 Article 12 Construction of projects which discharge solid waste and of projects for storage and treatment of solid waste must be carried out in compliance with the relevant State regulations concerning the management of environmental protection in respect of construction projects. 建设项目的环境影响报告书，必须对建设项目产生的固体废物对环境的污染和影响作出评价，规定防治环境污染的措施，并按照国家规定的程序报环境保护行政主管部门批准。 In the statement of the effect to be occasioned on the evironment by a construction project must include an assessment of the pollution of and effect on the environment by the solid waste to be discharged by the construction project and measures for the prevention and control of environmental pollution, and the statement must be submitted, according to the procedure prescribed by the State, to the competent administrative department of environmental protection for approval. 环境影响报告书经批准后，审批建设项目的主管部门方可批准该建设项目的可行性研究报告或者设计任务书。 The competent authorities for the examination and approval of construction projects may ratify the feasibility study report or the design plan descriptions of the construction project only after the statement of environmental effect has been approved. 第十三条建设项目的环境影响报告书确定需要配套建设的固体废物污染环境防治设施，必须与主体工程同时设计、同时施工、同时投产使用。固体废物污染环境防治设施必须经原审批环境影响报告书的环境保护行政主管部门验收合格后，该建设项目方可投入生产或者使用。对固体废物污染环境防治设施的验收应当与对主体工程的验收同时进行。 Article 13 The necessary supporting installations for the prevention and control of environmental pollution by solid waste specified in the statement of the effect of the construction project must be designed, built and put into operation simultaneously with the main part of the project. The construction project may be put into production or use, only after the installations for the prevention and control of environmental pollution by solid waste are examined and considered up to standards by the competent administrative department of environmental protection that examined and approved the statement of environmental effect. The installations for the prevention and control of environmental pollution by solid waste must be checked and accepted at the same time as the main part of the project is checked and accepted. 第十四条县级以上人民政府环境保护行政主管部门和其他固体废物污染环境防治工作的监督管理部门，有权依据各自的职责对管辖范围内与固体废物污染环境防治有关的单位进行现场检查。 Article 14 The competent administrative department of environmental protection of the peoples government at or above the county level and other supervisory and administrative departments for the prevention and control of environmental pollution by solid waste shall, in accordance with their respective functions and responsibilities, have the right to conduct on-the-spot inspection of units within their jurisdiction that have to do with the prevention and control of environmental pollution by solid waste. Units under inspection shall truthfully report the situation and provide the necessary information. 被检查的单位应当如实反映情况，提供必要的资料。检查机关应当为被检查的单位保守技术秘密和业务秘密。 The inspection authorities shall keep confidential the technological know-how and business secrets of the units inspected. 检查人员进行现场检查，应当出示证件。 Inspectors shall show their identification papers when they conduct on- the-spot inspection. 第三章 固体废物污染环境的防治 CHAPTER III PREVENTION AND CONTROL OF ENVIRONMENTAL POLLUTION BY SOLID 第一节 一般规定 SECTION 1 BASIC PROVISIONS 第十五条产生固体废物的单位和个人，应当采取措施，防止或者减少固体废物对环境的污染。 Article 15 Units and individuals that discharge solid waste shall adopt measures to prevent or reduce environmental pollution by solid waste. 第十六条收集、贮存、运输、利用、处置固体废物的单位和个人，必须采取防扬散、防流失、防渗漏或者其他防止污染环境的措施。 Article 16 Units and individuals that collect, store, transport, utilize or treat solid waste must take measures to prevent the scattering, running off, leaking and seeping of solid waste, as well as other measures against environmental pollution. 不得在运输过程中沿途丢弃、遗撒固体废物。 It is not allowed to discard or let drop solid waste on the road during its transportation. 第十七条产品应当采用易回收利用、易处置或者在环境中易消纳的包装物。 Article 17 Products shall be packaged with materials that are easy to be recycled or treated, or easy to dissolve or be absorbed in the environment. 产品生产者、销售者、使用者应当按照国家有关规定对可以回收利用的产品包装物和容器等回收利用。 Producers, sellers and users of products shall, in accordance with the relevant State regulations, recycle the packaging materials and containers of products that can be recycled. 第十八条国家鼓励科研、生产单位研究、生产易回收利用、易处置或者在环境中易消纳的农用薄膜。 Article 18 The State encourages research institutions and production units to research and manufacture agricultural film that is easy to be recycled or treated, or easy to dissolve or be absorbed in the environment. 使用农用薄膜的单位和个人，应当采取回收利用等措施，防止或者减少农用薄膜对环境的污染。 Units and individuals that use agricultural film shall take measures to recycle it or other measures to prevent or reduce environmental pollution by agricultural film. 第十九条对收集、贮存、运输、处置固体废物的设施、设备和场所，应当加强管理和维护，保证其正常运行和使用 Article 19 Management and maintenance of installations, equipment and places for collection, storage, transportation and treatment of solid waste shall be improved so as to ensure their normal operation and function. 第二十条禁止擅自关闭、闲置或者拆除工业固体废物污染环境防治设施、场所； Article 20 It is forbidden to close down, leave idle or dismantle, without authorization, installations or places for the prevention and control of environmental pollution by industrial solid waste. 确有必要关闭、闲置或者拆除的，必须经所在地县级以上地方人民政府环境保护行政主管部门核准，并采取措施，防止污染环境。 Where it is necessary to do so, prior verification and approval shall be obtained from the competent administrative department of environmental protection of the local peoples government at or above the county level, and measures shall be taken to prevent environmental pollution. 第二十一条对造成固体废物严重污染环境的企业事业单位，限期治理。 Article 21 If an enterprise or institution causes severe environmental pollution with solid waste, it shall be required to bring it under control within a time limit. 被限期治理的企业事业单位必须按期完成治理任务。 The enterprise or institution must complete the task within the specified period of time. 限期治理由县级以上人民政府按照国务院规定的权限决定。 The decision on the control of pollution within a specified period of time shall be made by the peoples government at or above the county level in accordance with the limits of authority as prescribed by the State Council. 第二十二条在国务院和国务院有关主管部门及省、自治区、直辖市人民政府划定的自然保护区、风景名胜区、生活饮用水源地和其他需要特别保护的区域内，禁止建设工业固体废物集中贮存、处置设施、场所和生活垃圾填埋场。 Article 22 Within the nature reserves, scenic spots or historical sites, and areas of source of drinking water as designated by the State Council, the relevant competent department under the State Council and the peoples governments of provinces, autonomous regions and municipalities directly under the Central Government and other zones that need special protection, it is forbidden to construct installations or use the places for centralized storage and treatment of industrial solid waste or garbage-fill ground. 第二十三条转移固体废物出省、自治区、直辖市行政区域贮存、处置的，应当向固体废物移出地的省级人民政府环境保护行政主管部门报告，并经固体废物接受地的省级人民政府环境保护行政主管部门许可。 Article 23 Transport of solid waste out of the administrative region of a province, autonomous region or municipality directly under the Central Government for storage or treatment shall be reported to the competent administrative department of environmental protection of the peoples government at the provincial level in the region where the solid waste is to be moved out, and shall be subject to the permission of the competent departments of administrative environmental protection of the peoples government at the provincial level in the region where the solid waste is to be accepted. 第二十四条禁止中国境外的固体废物进境倾倒、堆放、处置。 Article 24 It is forbidden for solid waste from abroad to be dumped, piled up or treated in the territory of China. 第二十五条国家禁止进口不能用作原料的固体废物；限制进口可以用作原料的固体废物。 Article 25 The State forbids the import of solid waste that cannot be used as raw material, and restricts the import of solid waste that can be used as raw material. 国务院环境保护行政主管部门会同国务院对外经济贸易主管部门制定、调整并公布可以用作原料进口的固体废物的目录，未列入该目录的固体废物禁止进口。 The competent administrative department of environmental protection under the State Counicl shall, in conjunction with the competent administrative department of foreign ecconomic relations and trade under the State Council, prepare, readjust and publish a catalog of solid waste which may be imported as raw material. The solid waste that is not included in the catalog is forbidden to be imported. 确有必要进口列入前款规定目录中的固体废物用作原料的，必须经国务院环境保护行政主管部门会同国务院对外经济贸易主管部门审查许可，方可进口。 If it is really necessary to import as raw material the solid waste that is included in the catalog stipulated in the preceding paragraph, examination must be conducted by the competent administrative department of environmental protection in conjunction with the competent administrative department of foreign economic relations and trade under the State Counicl and permission must be obtained from them in advance. 具体办法，由国务院规定。 Specific measures therefor shall be formulated by the State Council. 第二节 工业固体废物污染环境的防治 SECTION 2 PREVENTION AND CONTROL OF ENVIRONMENTAL POLLUTION 第二十六条国务院环境保护行政主管部门应当会同国务院经济综合主管部门和其他有关部门对工业固体废物对环境的污染作出界定，制定防治工业固体废物污染环境的技术政策，组织推广先进的防治工业固体废物污染环境的生产工艺和设备。 Article 26 The Competent administrative department of environmental protection under the State Council shall, jointly with the competent department in charge of comprehensive administration of economic affairs under the State Council, define the environmental pollution by industrial solid waste, work out technical policies regarding the prevention and control thereof, and organize the dissemination of advanced production techniques and equipment for the prevention and control of environmental pollution by industrial solid waste. 第二十七条国务院经济综合主管部
