Statement
l 用人单位在与职工签订劳动合同时，双方应认真阅读劳动合同。劳动合同一经签订具有法律效力，双方必须严格履行。
The Labor Contract comes into effect upon establishment and shall be read carefully by the Parties once entered into by and between the Employer and Employee.

l 劳动合同必须由用人单位（甲方）的法定代表人（或委托代理人）和职工（乙方）亲自签字盖章，并加盖用人单位公章（或劳动合同专业章）方为有效。
The Labor contract shall be signed with stamp by legal representative or entrusted agent of the Employer (referred as Party A) and the Employee (referred as Party B). The contract comes into effect only if it is affixed with official seal or particular seal for labor contract of the Employer.

l 合同参考文书中的空栏，由双方协商确定后填写清楚；不需要填写的空栏，请打上“/”。
All blank columns in the reference of the Contract shall be filled with clear and corresponding information on basis of consultancy and confirmation of the Parties, or filled with “/” as it may not to be filled.be the case that it need no fill-out.

l 填写聘用合同书一律用蓝、黑墨水书写，字迹清晰、工整。涂改处必须加盖校对章或打手印，否则无效。
The Contract shall be signed by and filled with clear and neat, blue or black writing. Any correction in the contract shall be affixed with proofreading stamp or fingerprint, otherwise such correction is invalid.

l 本聘用合同书须由聘用单位和受聘人员双方当时人亲自签订，因故需要他人代签的，需被代签者本人出具授权委托证明书，否则代签无效。
The Contract shall be signed by the Employer and the Employee themselves. In case of allograph, the signatory shall obtain certificate of authorization issued by the authorizing Party, otherwise the allograph is invalid.

l 本聘用合同书内的年、月、日一律使用公历，除落款日期外，均用阿拉伯数字填写。工资报酬等金额一律使用大写。
All dates presented in the Contract, except the date under signature which is written in Arabic Numerals, shall be written in accordance with solace calendar. Amount Numbers of salary and reward shall be all written in words.
l 根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》等国家相关法律和本公司有关规定，甲、乙双方按照《中华人民共和国合同法》以公平、公正、平等、自愿协商一致、诚实信用的原则订立本合同。
The Contract is entered into by following Parties on? and comes into effect from the day when the Agreement is signed on basis of equity, justice, equality, and honesty through amicable consultation according to laws and regulations of Labor Law of People’s Republic of China, Labor Contract Law of People’s Republic of China as well as Contract Law of People’s Republic of China.

一、 序言
1、 鉴于，甲方筹划并主持一档旅游娱乐节目（下称“演出”），详见附件A；甲方希望在本协议期间内聘请乙方在表演中提供专有服务（以下称为“服务”），就演出而言，乙方希望仅向甲方提供服务，乙方保证其拥有提供上述服务所需的技能，并保证根据甲方制定的目标提供服务；双方希望对乙方向甲方提供服务时适用的条款和条件做出规定；故经双方协商达成本协议，保证共同遵守。

2、 协议由合同双方签订， 年 月 日起生效。

Article I Preamble

1.1 Whereas Party A is planning a tourism entertainment show (hereinafter is referred as the Show), as detailed in Appendix A and Party A would like to employ Party B to provide with exclusive service (hereinafter referred as the Service) in the Show. As to the Show, Party B would like to provide Party A with the Service and ensure its essential skills to provide aforesaid service so as to reach the goals set up by Party A. The Parties would like to stipulate provisions and conditions applicable on Party B’s implementation of providing service. Therefore, the Agreement is entered into by and between and shall be abided by both Parties.

1.2 The Contract is entered into by the Parties and comes into effect on .

Article II Parties of the Contract
Party A: Great Xingdong International Performing Arts Co. Ltd. with its registered address in Sector F, Leigongpo, Group 4 of Xintianzai Village, Biayan Town, Puding County, Anshun City, Guizhou, China;
Party B: , with its registered address in

双方于安顺市xx旅游城就 演出达成该演出协议。如合同双方同意演出其他表演、延长演出档期，本合同项下的“演出档期”及“演出费用”应分别讨论并通过双方确定。
The Parties would like to establish the Contract in order to perform shows in Great Xingdong Tourist City located in Anshun. If the Parties agree to perform other shows besides that stipulated above, or extend duration of the Show, the items hereunder, namely schedule for the Show or Remuneration for the Show shall be discussed respectively and determined by the Parties.
三、 表演日期及演出安排
1、 演职员需于 年 月 日到达 （地点）， 月 日前完成道具装配及舞台搭建，于 月 日出发返回。
2、 乙方经许可展出此表演， 年 月 日起至 年 月 日止，不包括演员旅程、道具运输时间及舞台搭建时间。
3、 每天演出 场，一天两场表演需间隔至少3小时（从幕落至开幕）。
4、 如此行程有变则需于90天前提出、经双方同意并书面告知，由合同双方签字后方生效。
Article III Performance Schedule and Arrangement
3.1 The cast and staff shall arrive at on , and complete assembly of props and erection of stage before return on .
3.2. Party B shall perform approved shows from to , and duration of the shows does not cover the time spent on artists’ trip, props transportation and stage erection.
3.3 Party B shall perform shows a day, and interval between two shows each day (from curtain down to curtain up) shall be no less than three hours.
3.4 In case of alteration of the schedule, either Party shall propose such alteration and inform the other Party in writing for approval 90 days in advance. Alteration of the schedule is effective when it’s signed by the Parties.
四、 乙方提供服务与配合
Article IV Party B’s Service and Cooperation
1、 甲方为实现本协议规定的目的聘请乙方在本协议期间内提供专有服务，乙方应当在本协议期间内向甲方提供下述专有服务。
4.1 Party A, in order to reach the goal as stated in the Contract, would like to employ Party B to provide exclusive service and Party B shall provide Party A with following service.
2、 乙方应当在甲方的艺术总监或者艺术总监指定的代表人的监督下提供服务。
4.2 Party B shall provide the Service under surveillance of Party A’s art director or the representative assigned by Party A’s art director.
3、 乙方应当自付费用提供履行服务所必需的所有服装、配饰、道具或者工具（视具体情况而定统称为“道具”）。如果表演中使用的道具发生正常磨损，甲方应当付费保养并维修道具，未经甲方事先做出书面同意，乙方不得擅自决定对道具进行处理，以致产生保养和维修费用。如果在本协议期间内有必要替换表演中使用的任何道具，按照双方之间的约定由其中一方进行替换，被替换的任何道具及其中的任何权利和利益应当归属于实施替换的一方。提供服务所需的非应由乙方提供所有服装、配饰、道具或者工具应当由甲方提供，由甲方承担所需费用，不得要求乙方为此承担任何费用。
4.3 Party B shall at its own cost provide all costumes, accessories, properties or tools (all hereinafter referred as Properties as the case may be) which are essential for performing its duties hereof. In the event of normal wear and tear of Properties, Party A shall maintain and repair these Properties and bear the expenses. Should any of the Properties for the Show need replacement, replacement may be conducted by either of the Parties, and ownership, rights or any interest of the replaced Property shall belong to the Party that conducts the replacement. Party A shall at its own cost provide all costumes, accessories, properties or tools which are essential for performing its duties and not provided by Party B, and occur no cost to Party B.
4、 基于本协议规定的所提供服务的性质，在甲方提出要求之后，乙方应向甲方提交体检报告，对乙方的医学检查由甲方确认的具备资格的专业人士实施，并由乙方承担相关费用。乙方授权该专业人士出具医学检查报告，由甲方依据检查结果决定是否予以聘用。
4.4 In consideration of the nature provided hereunder, Party B shall submit physical check reports of its cast team to Party A and such physical check shall be conducted by qualified experts who are recognized by Party A at cost of Party B. The experts are authorized to issue physical check reports of which the result is considered by Party A as an essential factor to prove a cast’s qualification.
5、 基于本协议规定的实施的表演和提供的服务性质以及较高的服务标准，乙方应当在本协议持续的期间内保持其订立本协议时具备的外形，身体艺术美感和杂技技能，并遵守甲方提出的与表演相关的技术、特技和艺术要求（以下称为“必要技能”）。
4.5 In consideration of the nature and high standard of the Show and Service as specified hereunder in term of the Contract, Party B shall maintain and keep its figure, aesthetical physical appearance and acrobatics skills which the Contract is established on, and abide by related requirements of technology, tricks and artistic requirements proposed by Party A (hereinafter referred as Necessary Skills).
6、 乙方在其整体的表演评估中有权考虑其是否符合必要技能。
4.6 Party B owns the right to take into consideration whether it attains the Necessary Skills in overall performance assessment.
7、 乙方应当根据甲方的指示提及的所有服务。首次演出之后的彩排暂定时间表、公开演出时间、训练及彩排周期规定，甲方可以在本协议期间内根据需要随时修改彩排暂定时间表、公开演出时间、训练及彩排周期。对于乙方参与的付费彩排周数和乙方出席或者参与的演出次数，甲方不作任何保证。
4.7 Party B shall provide Service as per instructions of Party A. Provisional timetable of rehearsals, and schedule of public shows, as well as requirements of training and rehearsal period after the first show may be altered any time by Party A as needed. Party A makes no warranty as to number of weeks of paid rehearsal which Party B participate in or number of shows Party B attend or participate in.
8、 表演乙方创作的动作（甲方可以对该动作做出修改）的其它特定动作和角色；
4.8 Party B shall perform all movements, other movements and characters which are produced by Party B and such movements, other movements and characters may be modified by Party A;
9、 参与整体的舞台演出（包括舞台中的“节”表演和舞台下的“提示”）；
4.9 Party B shall participate in overall stage shows (including acts on stage and cues off the stage);
10、 在甲方提出要求时参与入场活动并在表演中露面；
4.10 Party B shall make appearance in entrance activities and shows as per requested by Party A
11、 在甲方提出要求时参与演出前的观众见面活动；
4.11 Party B shall participate in interaction activities with audience before shows.
12、 准时出席甲方召开的公司会议和见面会；
4.12 Party B shall attend in time Party A’s company meeting and presentation meeting.
13、 配合甲方安排、热身、训练、试穿、化妆活动；
4.13 Party B shall follow with Party A’s arrangement of warm-up, training, dress fitting and make-up.
14、 参与表演彩排和带妆彩排，以及有观众出席的一般彩排；
首次演出之后参加训练和研习会，以实现甲方制定的目标，并使表演保持较高的专业水平、扩充乙方的知识并完善其必要技能；
4.14 Party B shall participate in costume rehearsal and dress rehearsal as well as rehearsals with audience and participate in training and symposiums to reach goals set up by Party A, to maintain Party B’s show at a high level, to enrich Party B’s knowledge and to consummate Necessary Skills.
15、 在甲方提出要求时同意担任队长；
4.15 Party B shall act as team lead as per requested by Party A.
16、 如果本协议在协议期满之前终止，若甲方提出要求，乙方应协助甲方培训其替补人员；
4.16 Before expiration of the Contract, Party B shall assist Party A in training substitutions as per requested in the Contract.
17、 根据甲方提出的要求参与并配合全部或者部分改编自表演或者以表演为灵感来源的纪录节目、商业广告、电影、电视制作或者其它视听作品或者改编纪录节目、商业广告、电影、电视制作或者其它视听作品；
4.17 Party B shall participate in and cooperate with documentaries, business advertisement, movies, television or other visual and audio works wholly or partly adapted from or inspired by Shows or adapted from other documentaries, business advertisement, movies, television or other visual and audio works.
18、 公司规则和政策构成本协议的一部分，并附于本协议之后，自协议生效之日起，乙方应当一并遵守。
4.18 Party A’s company regulations and policies constitute the Contract as attachment and shall be abided by Party B since the date when the Contract comes into effect.

19、 乙方应当根据甲方提出的要求参加与演出有关的团体活动，包括但不限于安装、拆除、装卸、准备、核实与演出有关的艺术设备。
4.19 Party B shall participate in collective activities related to shows including but without limitation installing, dismantling, loading, preparing and inspecting artistic equipments related to shows.
20、 在不限制乙方根据本协议承担的排他性义务的情况下，乙方不得直接或者间接地单独通过合伙企业或者与任何其它人员、公司或者社团共同参与演出、经营业务、担任演出代理人或者实施表演活动以及实施与本协议项下的活动类似的活动，但乙方已收到甲方明确做出的具有相反意思表示的书面同意的除外，上述义务在本协议期间内有效。
4.20 Without restriction to the exclusive liabilities which Party B shall assume in accordance with the Agreement, Party B shall not, directly or indirectly, through joint venture or any third individual, company or community, wholly or partly, participate in performances, business, act as agent of performances or conduct any performance activities or activities familiar with those hereunder, unless otherwise approved by Party A in an explicit writing of an opposite direction. The aforesaid liability is valid in term of the Contract.
21、 乙方承诺在甲方提出要求的专业协会（视具体情况而定）中拥有良好声誉。
4.21 Party B promises to possess good reputation in professional associations designated by Party A (as the case may be).

五、 演出费用
Article V Remuneration for Shows
甲方同意支付乙方服务费用 人民币（下文统称演出总费用）。依据合同第六条列出的付款计划，演出总费用将以人民币结算。演出总费用不包含税费或与当地法律或税收相关的其他费用。
Party A agrees to pay Party B remuneration RMB for the Service (hereinafter referred as General Remuneration). According to terms of payment in Article VI, General Remuneration shall be paid in RMB and not include taxes or other expenses pursuant to regional laws or taxation.
六、 付款方式
1、 甲方应按照下列安排直接支付乙方演出费用 人民币：
2、 协议生效前或当日、道具运输日期之前支付乙方演出总费用的30%，即 人民币；

Article VI Terms of Payment
6.1 Party A shall pay Party B remuneration RMB as follows;
6.2 Party A shall, the day when the Contract comes into effect and before the date of transportation for Properties, pay Party B 30% of the General Remuneration, namely, RMB .
6.3 Party A shall pay Party B remaining balance of payment before .

乙方在此承认并同意，若该合同没有另行具体陈明，甲方无需直接或间接支付乙方额外款项及/或补贴，或其他任何形式的费用。
Herein, Party B guarantees and agrees, unless otherwise specified, Party A doesn’t need to pay Party B directly or in directly, extra amount and/or subsidy, or expenses of any form.
七、 前提条件
Article VII Prerequisites
甲方向乙方额外支付下列费用及款项：
Party A shall pay Party B for following items:
1、 道具运输清单
乙方负责处理从俄罗斯到 的道具及表演相关设备的单程运输，并支付运费。乙方应直接挑选并聘请运输公司，并安排从俄罗斯仓库（具体地址： ）到各个表演场地及/或彩排地点的运输。（为保证道具安全及准时到达，建议使用甲方指定的运输公司）。为消除疑问，甲方无须支付乙方工作人员及表演者个人物品的运输费。
7.1 Inventory of Property transportation
Party B undertakes one-way transportation of properties and related equipments for performance from Russia to , and pay freight of such transportation. Party B shall select and employ carriers and arrange transportation from the warehouse in Russia (detailed address is ) to all performance or rehearsal spots. In order to ensure safety of properties and punctuality, carriers designated by Party A are recommended. It is clarified that Party A does not need to bear freight for personal staff of Party B’s personnel and cast.
2、 签证
甲方需负责乙方所有成员的签证，并支付相应费用。
7.2 Visa
Party A shall apply visa for all personnel of Party B and bear related expenses.
3、 机票
甲方负责乙方人员的机票费用，其中包括 人的经济舱机票。
7. 3. Flight tickets
Party A shall buy flight tickets of all personnel of Party B, of which are economic class tickets.
4、 住宿
1) 甲方同意为乙方演员及工作人员（最多六十五人）提供公寓式酒店住宿。
2) 在酒店/宿舍与场地间的必要交通应由甲方提供。
3) 甲方无需负责乙方演职人员用于个人目的的当地交通。
7.4 Accommodation
7.4.1 Party A agrees to provide accommodation for Party B’s actors and personnel (no more than sixty-five people) in apartment hotel.
7.4.2 Necessary transportation between hotel/residence to performance spot shall be provided by Party A.
7.4.3 Party A assumes no responsibility for personal transportation of Party B’s personnel.
5、 洗衣服务
甲方应在表演期间每场演出结束后提供演出服清洗服务，但不包含乙方演职员的私人衣物。
