1、第五章 班轮运价(Liner freight rate) CHINA OCEAN FREIGHT TARIFF NO.6(1) 第一节 总则(General principles) 一、 Scope applicable This Tariff is applicable to all cargoes shipped to and from the ports of the People’Republic of China and ports in the areas where sailings are covered by this Tariff. All terms and
2、 conditions provided herein should be considered incorporated with the articles of the Bill of Lading and should be adhered by both the Ship and Cargo Interests. 二、 Currency All rates, additional charges or fees in this Tariff are in USD. and nett. 三、 Payment of freight 1. Method of Payment (1
3、)Prepayable. All freight and other charges should be paid before the issuance of Bill of Lading. (2)Payable at Destination. All freight and other charges should be paid before delivery of the cargo. 2. Payable in currency other than USD. Irrespective whether freight and other charges are prepay
4、able at loading port or payable at destination or payable in a third place. It should be in transferable currency. In case, freight is payable at a third place, the cargo interests should provide the name and detailed address of the payer in due time. 3. Freight Must Be Prepaid for the Following c
5、argo (2).(下列商品运费必须预付) Deck cargo, Refrigerated Cargo, Bulk Oil, Bulk Latex(散装胶浆), Livestock, Fresh Cargo, Personal Effects, Household Goods and Perishable cargo. 4. Freight must be prepaid at loading port on all cargo for transshipment Bill of Lading, except otherwise agreement arranged. 四、 Conv

7、by the Government or Local Port Authority of the port of transshipment of discharging cargo should be borne by the Consignees and they should effect payment before taking delivery of the cargo. 2. Notice of amendment would be distributed accordingly for alteration of rates, increase or decrease of
8、 additionals, insertion or deletion of commodities and adjustment to standard of calculation or class of commodity. 六、 Amendment of freight (运费更正) Amendment of freight must be put forward to Carrier or its Agents within four months after Ship’s departure. After it is checked and found actually w
9、rong, Carrier or its agents should draw up an amendment note and arrange for the refund or collection. 七、 Limitation of liability (超额责任) In case Carrier is requested to be responsible for value in excess of Bill of Lading limitation of liability for carriage of valuable goods including Ad Valo
10、rem cargo, Shippers should declare price of cargo (FOB price) on the shipping order and pay an additional of 1% of cargo value. 八、 Issuance of Bill of Lading (提单的编制及签发) 1. “Shipped” Bill of Lading to be issued by the Master or Agents entrusted by Carrier against Mate’s Receipt after goods loaded o
11、n board(3). 2. “Order” Bill of Lading: The name and detailed address of the “Notify Party” to be endorsed on the copy of the Bill of Lading by the shipper. 3. “Transhipment” Bill of Lading: “Transhipment”or “To be Transhipped at…..” must be clearly remarked. 4. Concrete name of the commodity sh
12、ould be indicated. Lumping under “Cargo”, “General cargo” or “….. cargo etc.” is not allowed. 5. Concrete packing should be indicated, for instance, packed in bags, packed in drums or packed in cases, instead of lumping under “Packages”. 6. With the exception of unpacked cargo or bundled cargo or
13、 bulk cargo, marks of cargo must include port of discharge or final destination. 7. Following regulations fixed by relevant ports to be observed at Shippers’ discretion. (1) Loading Party or Bank which issue L/C should not appear on Bill of Lading as Consignees or Notify Party. (2) Whether quan
14、tity (gross or net) or measurement is to be indicated on original Bill of Lading. (3) Shippers are to sign on the left side of the Bill of Lading manifesting confirmation of its contents. (4) Whether the Consulate’s testification is required on shipping documents. 8. Bills of Lading should not
15、 be noted or stamped with the following clauses(4): (1) conditions of Packages “New cases” ; “New bags”; “Strong seaworthy carton”; “Strong carton/cases” etc. (2) Conditions of Loading: “Goods clean on board”; “Stow away from engine room”; “Stow in c
16、ool and dry place”; “Stow in the shade and keep dry” ; “Stow below waterline” ; “To be stowed or shipped under deck”; “Not to be stowed in hold with….”; “Keep from freezing” ; “Keep cold and dry”; “On deck shipment prohibited” ; “Block stowage for over
17、side delivery”. (3) Handling Requirements “Use no hooks”; “Do not stack upside-down ”; “Glass with care”; “Handling with care”; “No hay or straw used (for dunnage or separation)” “Avoid dampness”. (4) Place and Method of Loading/Discharging “Loading at Shipper’s wharf”;
18、 “Discharging at Consignee’s wharf”; “Under ship’s tackle”; “Under tackle”; “Overside to lighters”; “Overside to railway wagons”. 九、 Packing 1. Packed in plastic bags, paper bags or single layer bags: Loss of or damage to cargo packed in this manner would not be compensated by
19、 Carrier. 2. Cement or Fertilizer packed in bags: Shippers are allowed to ship, free of charge, empty bags equivalent to 5% of the total quantity of bags as reserve to change torn bags together with shipment of cargo. Remaining bags, if any, should be delivered to the Consignees. 3. Cargo in bundl

24、 杂货运输规定及说明 ( Notes and conditions for breakbulk shipments) 一、 Notes and conditions in this section are only applicable to breakbulk shipment. 二、 Basic freight rate and additionals 1. Basic Freight Rate: Including all class rates, Ad Valorem rates, refrigerated cargo rates, open rated cargo rate
25、s and livestock rates for various areas. 2. Various Additionals: (1) Additional on Heavy Lifts: Each piece exceeding 5 metric tons in grosss weight is considered as heavy lifts and Scale of Additional in this Section is applicable. Where loading or discharging is arranged by Cargo Interests, all
26、 damages including those sustained by Ship or other cargo or to third party including personal injury and death arising therefrom should be borne by the party who arranged the loading/discharging. (2) Additional on Long Length: Each piece exceeding 9 meters in length is considered as long lengt
27、h and Scale of Additional in this Section is applicable. Note: Where each piece is a heavy lift and a long length as well, then only one additional, whichever greater, should be collected. (3) Direct Additional: Where the quantity of shipment destined to any one of the nonbase ports per voyage of
28、 the carrying vessel is up to or exceeds 1,000 revenue tons, the freight thereof shall be collected on the basis of the direct calling irrespective of whether it calls directly or not and the base rate plus direct additional therein provided for the various lines is applicable. (4) Transhipment Add
29、itional: 1) Transhipment Additional for various areas is applicable to transshipment made to nonbase ports. 2) In case of heavy lift or long lengths, an additional is to be collected for each transshipment made. (5) Port Additional: Scale of Port Additional for var
30、ious areas in this Tariff is applicable. 三、 Description of Shipment: Shippers should supply detailed description of each consignment embracing name of commodity, port of destination marks, gross weight(kilo), measurement (cubic meters up to decimal three fractions) , piece/package, packing, FOB p
31、rice (for Ad Valorem), method of freight payment, cargo with special specifications as well as other descriptions relating to the shipment. 四、 Unit for calculation of freight All freight, with the exception of Ad Valorem, should be calculated in metric system, metric ton or cubic meter. 1. Item
32、s marked with “W” : To be calculated per metric ton(gross), where it is less than one metric tons, decimal three fractions should be taken. 2. Items marked with “M” : To be calculated according to its measurement per cubic meter, where it is less than one cubic meter, decimal three fractions shoul
33、d be taken. 3. Items marked with “W/M” :To be calculated per whichever is greater. 4. Items marked with “Ad Val.” : To be calculated per whichever is greater. 5. Items marked with “Ad Val. Or W/M”: To be calculated per whichever is greater. 6. Different articles contained in one package: To be c
34、alculated at the rate which produces the highest revenue to the carrier. 7. For same articles with different packing freight to be calculated per different rate and class, shippers should indicate gross weight or measurement separately according to different packings, otherwise it would be take
35、n the one that produces the highest revenue to the carrier. 8. In case of two or more than two kinds of commodities are included in one Bill of Lading, the shippers should supply the gross weight and measurement of the different commodities separately, Otherwise the freight shall be charged on
36、the commodity whichever produces the greater revenue to the carrier. 五、 Special cargo 1. Hazardous Cargo All hazardous cargo should be only loaded on Carrier’s approval. It is essential that shippers should indicate clearly on all shipping documents the characteristics of the cargo, UN No. and
37、page No. in IMDG code and matters of attention for loading/ discharging and cargo must be labeled in accordance with the IMDG regulations(1). “Receivers to take delivery of cargo according to regulations prevailing in discharging port” should be stamped on the Bill of Lading. 2. Refrigerated Cargo
38、 (1) For carriage of refrigerated cargo, a Contract of Affreightment may be signed if considered necessary by Shippers and Agents of the ship after consultation, in which case the Bill of Lading is to be endorsed with “subject to the terms and conditions of the Contract of Affreightment dated….” (
39、2) It is not allowed to specify the temperature and moisture of refrigerated holds and chambers on the Bill of Lading. 3. Bulk Cargo “Quantity said to be …..” should be shown on the Bill of Lading. For bulk goods or goods without marks or goods with the same marks Bill of Lading to be claused:
40、Where bulk goods or goods without marks or goods with the same marks are shipped to more than one consignee, the consignees or owners of the goods shall jointly and severally bear any expense or loss in dividing the goods or parcels into pro rata quantities and any deficiency shall fall upon them i
41、n such proportion as the carrier or their agents shall decide”. 4. Bulk oil: (1) For carriage of Bulk Oil, a Contract of Affreightment may be signed by Shippers and Agents of the Ship according to necessity, in which case the Bill of Lading is to be endorsed with “Subject to the terms and conditio
42、ns of the Contract of Affreightment dated…”. (2) “Quantity said to be …” should be shown on the Bill of Lading. (3) Charges for Cleaning Tanks: An additional of USD3.80 per freight ton is to be collected. (4) Optional Destination: In case of optional delivery within two ports, an additional of US
43、D1.30 per freight ton is to be collected; whereas in the case of more than two ports, USD1.9 per freight ton is to be collected. 5. Steels loaded loosely or in bundles: Shippers must have (1) Clear and lasting marks painted on each piece of steel. (2) Each bundle of steel tied tightly and painte
44、d with clear and lasting marks as well as labeled with clear and lasting marks, so that each piece or bundle could be distinguished clearly at discharging port, otherwise the ship is not responsible for correct delivery. Charges incurred at discharging port due to loosen bundles or unclear marks sho
45、uld be borne by the Consignees. 6. Cargo with strange smell: For carriage of cargo with a strong smell which could not be dispersed easily, Shippers should have its specification and characteristics clearly remarked on the shipping order to avoid contamination to other cargo or cargo hold. 六、 OTHE
46、RS 1. Optional Destinations Optional destinations are limited to ports of call for the voyage subject to the following freight and additionals: (1) For optional delivery within 3 ports, an additional of USD1.4 per freight ton would be collected. (2) For optional delivery at more than 3 ports, an
47、 additional of USD 1.90 per freight ton would be collected. (3) Freight for optional delivery would be collected per the highest freight rate of the optional ports. (4) A minimum additional of USD 1.30 for optional delivery would be collected per Bill of Lading. Discharging port must be declared
48、to Agents of Ship 48 hours before ship’s arrival at first optional discharging port, otherwise the cargo would be discharged at the first or one of the optional ports at Carrier’s discretion and liability of carriage would be considered terminated. 2. Alteration of Discharging Port: At the
49、 request of a Holder of the full set of original Bill of Lading for alteration of discharging port, Ship’ s agreement should also be obtained after relevant Customs Authority’s approval granted and following charges shall be collected: (1) Service charges for alteration of discharging port: USD1.5
50、per freight ton, but a minimum of USD 1.90 per Bill of Lading. (2) In case freight rate for altered discharging port exceeded that of original destination, the difference in freight shall be collected in supplement, but not refunded otherwise. (3) Extra charges and losses incurred due to restowing
