第一条 国家规定的社会保险及基金
Article 1 Social Insurance and Funds Stipulated by Government
1.1 员工正式聘用之日起,公司将根据政府的有关规定,按月为其向当地社会保险中心缴纳公司部分的社会
保险金,并按规定替员工代扣代缴个人部分。
According to government policy, the Company pays social insurance premiums to local Social Insurance Center (SIC) for employees from the first month of employment. The Company is also entitled to withhold personal part of insurance from employees’ monthly salary and pay to SIC.
1.2 公司按政府规定按月为员工缴纳住房公积金,并替员工代扣代缴同样比例的个人缴纳部分。
According to government policy, the Company pays Housing Provident Fund premium for employees. Company is also entitled to withhold personal part from employees’ monthly salary and pay to the appointed bank.
1.3 新入职员工的基本工资为社保和公积金基数,基数每年7月调整一次,调整基数为6月份的基本工资。
The new employees’ basic salary is the base of social insurance and housing fund. Annual base adjusts according to latest basic salary as the new base.
第二条 公司提供的额外保险
Article 2 Extra Insurance Paid by Company
公司将根据公司经营状况、员工需要及职位实际情况,为所有员工购买相关商业保险,有关保险费用由公司支付。
The company will pay commercial insurance for all employees according to business situation, employee needs and the actual requirements of the position.
第三条 公司内部福利
Article 3 Internal Benefits of Company
3.1 交通、话费、住房补贴 /Transport& cell phone Allowance
3.1.1 公司将根据公司经营状况,员工需要及职位实际情况,为员工提供交通,话费,住房补贴。
The company will pay transport, cell phone, housing allowance employees who passed probation period according to business situation, employee needs and the actual requirements of the position.
3.1.2 每月提供100元交通补贴, 凭当月交通发票(公交发票,汽油票)。
The company will pay monthly transport allowance 100RMB, with bus or gasoline invoice.
3.2 工作餐 /Working Meal
3.2.1 公司向员工提供免费工作午餐/晚餐。在公司无法提供工作餐的情况下,员工可报销不超过人民币10元/
次的盒饭。如因工外出(不含出差)无法在公司用餐的,可报销人民币15元/次以下的餐费。
The Company offers free working lunch/dinner to employees on working day. If company can’t provide working meal, box meal no exceeding RMB 10 can be reimbursed to the employee. Employee could reimburse meal expenses no exceeding RMB15 for each dinner/lunch when has out business(not including business trip).
3.2.2 公司向上深夜班的员工提供免费的早餐。
The Company offers free breakfast to employees on night shift work.
3.3 国家规定的补贴 /Statutory Subsidy
3.3.1 所有员工在本公司服务期间均可享受国家规定的各项补贴、津贴。为便于操作,公司将这些补贴、津贴
计算在员工的工资总额之中。
All regular employees are entitled to various subsidies stipulated by government. The subsidies are
included in employees’ salary.
3.3.2 夏日高温补贴 /High temperature subsidies
A. 所有员工每年6-9月,享有四个月的高温补贴
All regular employees are entitled to high temperature subsidies from June to September every year.
B. 办公室人员每月130元,车间一线员工及保洁人员每月200元,仓库每月300元
Office staffs get 130RMB/M, front line operators get 200RMB/M, and warehouse workers get 300RMB/M
3.4 体检 /Annual Physical Examination
公司每年五月份安排一次职业病健康检查。
The company arranges one time physical examination for every employee in May.
3.5 出差补贴 / Business trip subsidies
公司为员工因工出差,提供补贴。详情见《出差及招待费用管理制度》 FIN-001。
The company offers business trip subsidies. The details please see travel reimbursements.
第四条 各类假期
Article 4 Leaves
4.1 请假手续 /Application Procedures
4.1.1 员工申请各类假期均需填写“假期申请表”HR-002-R1。
“Leaving Requisition Form” HR-002-R1 is necessary for every leave.
4.1.2 除病假、丧假及工伤假外,所有假期都必须提前三天得到部门经理的批准。
The leaves, except sick leave, funeral leave and work-related injury leave should be approved by line Manager 3 days in advance.
4.1.3 四天及以上的假期,除非不可抗拒因素,必须提前一周申请由总经理申批同意后方可休假。
1 week forehand approval by General Manager is necessary for the leave above 4 days.
4.1.4 申请病假、丧假及工伤假的员工若未能依照上述手续事前请假,则应在当日上班两小时内亲自或委托人
电话通知部门经理,说明请假事由,经批准后,方为有效。然后于上班后两日内补办请假手续。
Employee who applies for sick leave, funeral leave and work-related injury leave should personally or authorize other people to call Department Manger within 2 hours of the leaving day for the approval and submit Leaving Requisition Form after return to work.
4.1.5 请假单应及时送至人事部审核存档。如证明材料不足,人事部有权视为事假或旷工处理。
Leaving Requisition Form should be send to HR department promptly for reviewing and filing. If HR finds no enough certificates to support the leaves, HR are entitled to treat leaves as non-pay leave or leave of absence.
4.1.6 请假需附以下证明(证明可假后补交,但是必需的) /Certificates as following:
A. 病假:乡级以上医院出具的休假证明 /Sick Leave: hospital certificates;
B. 婚假:本人结婚证 /Marriage Leave: Marriage certificates;
C. 产检假:医院证明 /Maternity Check Leave: Hospital Certificates;
D. 产假:本人生育证 /Maternity Leave: Hospital Certificates;
E. 护理假:本人结婚证、妻子的生育证及婴儿出生医学证明 /Child Bearing Leave: Marriage certificates, baby’s birth certificates
F. 工伤假:工伤证明及医院的休假证明 /Work injury Leave: Government & hospital certificates.
4.1.7 部门经理接到下属的请假申请时,应迅速处理,并给予明确答复。
The line managers once get leave application, has to reply clearly and promptly.
4.2 国定假日,共计11.5天 /Statutory Holidays, all together 11.5days
公司所有员工均享有以下国定假日:
All employees are entitled to the holidays stipulated by government as follows:
A. 元旦: 放假1天(1月1日) /New Year Day 1 day (Jan 1st);
B. 春节: 放假3天(大年夜,农历正月初一,初二), Spring Festival 3 days (Luna Calendar: Dec 31th Jan 1st 2nd)
C. 妇女节:女职工放假半天(3月8日) /Women day half day(March 8th)
D. 清明节:放假1天(4月5日)/ Tomb-sweeping Festival 1day (April. 5th)
E. 劳动节:放假1天(5月1日) /Labor Day 1 day (May 1st);
F. 端午节:放假1天(农历5月初五)Dragon Boat Festival 1 day (Luna Calendar: May 5th)
G. 中秋节:放假1天(农历八月十五)Mid-Autumn Festival 1day
H. 国庆节:放假3天(10月1日,2日,3日) /National Day 3 days (October 1st 2nd 3rd ).
4.3 年假规定 /Annual Leave regulations
4.3.1 本公司工作满6个月的所有员工,返聘人员除外,可以享受公司的年假。
Employees are entitled to annual leave after the completion of 6 months of service time in this company.
4.3.2 员工进入公司,第一年,员工享有3个工作日年休假,第二年可享受7个工作日的年假,第三年起,员工享有10个工作日的年休假。此后每年度可增加2天年休假,最多增加5个工作日的年休假,一年享有15个工作日的年休假。
First service year, staffs are entitled to 3 working day for annual leave. Second service year, Staffs are entitled to have 7 working days as annual leave, Starts from the third service year, Staffs are entitled to 10working days. Then each year add two days extra, till the top is 15 working days for annual leaves.
4.3.3 员工申请年假一次至少半天或以上。
Annual leave should be applied for at least half day for once
4.3.4 各部门应当根据生产,工作的具体情况,并考虑职工本人意愿,统筹安排职工年休假,但不得因休假
而影响工作。
Department shall according to production, work situation and preference of employees to co-ordinate
arrangements for annual leave of employees, but shall not affect the work due to vacation.
4.3.5 本年度的年假最迟可以使用至次年的3月31日,届时未使用的年假均视为自动放弃,无任何补偿。
The annual leave of 1 calendar year can be used till March 31 of the next calendar year and is invalid
after that. No payment will be made to unused holiday.
4.3.6 员工享受年假无故超假的,将作为旷工处理。
Overstaying of annual leave without approval will be handled as the absent from work.
4.3.7 员工在退休、辞职、被辞退或终止合同时仍未使用其当年年假的,公司将根据当年已服务时间计算未
休年假,并按相当于本人工资100%的金额计算补偿。
In case of retirement, resignation, dismissal or contract termination, employee is entitled to the
payment equivalent to 100% of his salary in lieu of the outstanding annual leave (it is calculated on the
basis of 1/12th of the annual leave for each completed month of service in the calendar year).
4.3.8 职工有下列情形之一的,不享受当年的年休假:
Employees has following conditions, do not have annual leave of that year
A. 本公司累计工作不满10年的职工,请病假累计3个月及以上的;
Service years, less than 10years, have more than 3 months sick leave;
B. 本公司累计工作不满15年的职工,请病假累计6个月及以上的。
Service years, less than 15years, have more than 6months sick leave.
4.3.9 年假期间,月工资、补贴照发不扣。
Employees are entitled to annual leave with full pay.
4.4 工伤假(工伤医疗期)规定 / Work-related Injury Leave Regulations
员工如发生因工负伤,公司将按国家相关工伤规定和程序处理,并享受规定的工伤假。
Employee who suffers from work-related injury and needs medical treatment is entitled to work-related injury leave in accordance with relevant government regulations.
4.4.1 工伤假的批准由总经理、安全管理部门共同审批方可生效。
Work-related Injury Leave has to be approved both by safety department and General Manager.
4.4.2 员工工伤假享受基本工资待遇,但不计补贴及业绩奖金。
Employees are entitled to salary, with no allowance and performance bonus.
4.5 病假规定 / Sick Leave Regulations
4.5.1 门诊病假须凭二级以上医院出具的病假证明。急诊者可向公司提交就诊医院签发的病假单。如果公司对
员工提供的病假证明有疑义,将要求员工在公司指定的医院进行复检,以复检后的病假证明为最终依据。
Sick leave should be supported by the medical certificate of over Grade-II hospital. In case of
emergency, employee should provide sick leave certificate issued by the hospital later. If the medical
certificate is doubted by company, the second round checking is required in appointed hospital, medical
certification of which will be used as the final reference.
4.5.2 有薪病假 /Sick Leave with Pay
员工每年可享受7个工作日有薪病假,但不能跨年度累计使用。有薪病假不扣月工资。员工申请有薪病假必须提供乡级以上医院出具的病历诊断记录或开具的病假诊断书申请病假(急诊除外) 。
Employee is entitled to sick leave up to 7 working days every calendar year without the deduction of salary. Sick leave with pay can’t be transferred to next calendar year. Employee should have medical certificate issued by over Grade-II hospital (except emergency) to support the leave.
4.5.3 非有薪病假 /Sick Leave
4.5.3.1 员工年累积病假超过7个工作日的,病假期间的月工资,按本人基本工资的70%计算,补贴,绩效不影
响。
When employees’ sick leave exceeds 7 working days accumulated yearly, his salary during sick leave
period, is 70% of his/her basic salary,with varies allowance and performance bonus.
4.5.3.2 员工申请非有薪病假,一次至少一小时或以上。
Sick Leave should be applied for at least one hour or above for once.
4.6 婚假规定 /Marriage Leave Regulations
4.6.1 员工在领取结婚证书后,凭结婚证明,可申请婚假。
Employee can apply for marriage leave after getting marriage certificates.
4.6.2 婚假一般可以申请3天,但符合晚婚初婚条件者(男≥25周岁,女≥23周岁)可以申请10天,初婚年龄的
计算以结婚证书上批准日期为准。
Employee is eligible for marriage leave of 3 working days. 10 calendar days marriage leave is granted
to late and first marriage (Man: above 25 years old; Female: above 23 years old).
4.6.3 员工享受婚假,其工资和各项补贴照发。
Employee can get full pay, including salary and various allowance during marriage leave.
4.6.4 员工享受婚假所需交通费由员工自理。
Employee will bear the transportation expenses during marriage leave.
4.6.5 婚假自登记之日起计算,三个月内一次性休完。
Marriage leave has to use in three months starts from the marriage date.
4.6.6 婚假包括公休假,不含法定假。
Marriage leaves includes weekends, not including Statutory Holidays.
4.6.7 再婚的可享受法定婚假,不能享受晚婚假。
Second marriage leave can has 3 days leave, no late marriage leave
4.6.8 婚假为带薪假,享受补贴和绩效。
Marriage Leave get full pay.
4.7 产假及哺乳假 /Maternity Leave and Breast-feeding Leave
4.7.1 产检假/Maternity check Leave
女性员工在 妊娠期间,凭市/区级医院为孕妇建立的待产手册上规定的时间,申请产检假,每次4小时;
Employees can apply maternity check leave with hospital certificates, Every time can apply 4 hours, with full pay.
4.7.2产假 /Maternity Leave
女性员工一经确诊为怀孕,应立即告知部门经理与人力资源部。
Female Employees once get diagnosed pregnant, should inform line managers and HR department immediately.
女性员工生育前后,凭市/县级医院为孕妇建立的待产手册申请产假90天,其中产前15天,产后75天。
Maternity Leave-90days (of which 15days for pre-natal leave and remain 75 days for post natal leave)
4.7.2.1晚育者(年满24周岁的初育)追加30天;难产者(或剖腹产者)再追加15天;多胎者,再追加15天。
For those who have first baby later than 24 years of age, they will receive additional 30days; for those
who encounter difficulty during pregnancy an additional 15days will be allowed; multiple births gets
additional 15days
4.7.2.2 流产假 Miscarriage Leave
自然流产或宫外孕的女员工凭医院诊断证明书申请相应的流产假,根据医生建议,给予15天至20天。
Miscarriage leave are allowed with hospital certificates, for 15 to 20days
4.7.2.3产假假期核算包括公休日和法定假日。
Maternity Leaves including public holidays
4.7.2.4 产假需经总经理和人事部门批准,方可生效。
Maternity Leaves need general manager and HR department both approval.
4.7.3 哺乳假 /Breast-feeding Leave
女职工产假期满,婴儿在1周岁以内,可以申请哺乳假,每天一小时。但绝不允许将哺乳假积攒待休。
After maternity leave, employees are entitled to apply breast feeding leave one hour/ day. Do not allow accumulated breast feeding leave.
4.7.4生育护理假 Child bearing leave
男性员工(非再婚者)之配偶生育时,可凭医院证明申请护理假5天;配偶晚育时,凭医院证明,可申请护理假10天, 含周末, 不含法定假日。
Husband is entitled 5 days leave (must be first marriage); for those wife have their child later than 24 years of age, husband accompany childbearing leave for 10 days, including weekend, not including statutory holidays.
4.7.5 产检假,产假,哺乳假,流产假,护理假享受全薪,含补贴和奖金
Maternity check Leave,Maternity Leave,Breast-feeding Leave, Miscarriage Leave,Child bearing leave get full pay.
4.8 丧假 /Funeral Leave
4.8.1 员工如遇亲属(父母、配偶、子女;岳父母、公婆、祖父母、外祖父母)去世,可申请一次为期3天的丧
假。
Employee is eligible for funeral leave of 3 days by bereavement of a Line relative (including spouse,
parents and children father/mother in law, grandfather/mother)
4.8.2因路途较远者,可酌情给1~2天路程假,路费自理。
If need to travel long to attend funeral, can spare extra 1-2 day transport leave, depending on how far
the road, company does not cover transport fee.
4.8.3 丧假自亲属死亡当日或次日起计算,含公休日与法定假日。
The date starts from the death date, including weekend and public holidays.
4.8.4 享受全薪,含补贴和奖金。
Funeral Leave get full pay.
4.9 事假 /Non-pay Leave
4.9.1 员工因个人原因不能上班,可以按照请假手续向部门经理申请事假,经批准后才能享受假期。除非总
经理特别批准,否则4个工作日以上的事假将不获批准。
Employees can apply for Non-pay Leave if he / she can’t go to work for personal reason. The
application should be approved by Department Manager in advance. Non-pay Leave can exceed 4
consecutive working days only with the approval of General Manager.
4.9.2 事假员工申请年假一次至少半小时或以上。
Non-pay Leave should be applied for at least half an hour or above for once.
第五条 旷工
Article 5 Absent from Work
员工未经批准擅自缺勤,事后无正当理由补假或谎报、伪造证明,以不正当手段骗取或于请假期满仍未复工而无合理解释者,均按旷工处理:
Employee who commit absenteeism, falsify documents for the leave, or exceed the approved days of leave without reasonable explanations will be treated as absent from work. The punishments are as follows:
A. 旷工一次(一天及以上,扣当月补贴,绩效,另发书面警告);
Absent from work once Monthly allowance and performance bonus deducted (one day or more) plus
written warning;
B. 连续旷工3天或累计旷工5天,经严重书面警告后重犯者,视为严重违反劳动纪律,公司可以单方面终止劳动合同并不支付各项补偿。
Absent from work for 3 Termination of employment consecutive day; for 5 days accumulated; Absence recurs after receiving strong written warning; treat as severely against the working disciplines, The Company reserves the right to terminate labor relationship with no compensation.
