&nbsp; 根据《中华人民共和国合同法》、《中华人民共和国城市房地产管理法》及其他有关法律、法规的规定,甲、乙双方遵循自愿、公平和诚实信用的原则,共同委托丙方代理并见证甲、乙双方之间的买卖行为,经甲、乙、丙三方协商一致,共同订立本合同,以兹各方共同遵守。 第一条 &nbsp; 房屋基本情况 &nbsp; &nbsp; &nbsp;(一)甲方所售房屋坐落为:座落西安市 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;区 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 路 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 号(建筑物名称 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; ) &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;幢 &nbsp; &nbsp; &nbsp; &nbsp;单元 &nbsp; &nbsp; &nbsp;室。该房屋建筑面积约为: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;平方米(该房地产按套出售,具体面积以该房地产产权证为准)。 &nbsp; &nbsp; &nbsp;(二)该房屋规划设计用途为: &nbsp; &nbsp; &nbsp; A、 住宅 &nbsp; &nbsp; &nbsp; B、商业 &nbsp; &nbsp; &nbsp; C、商住 &nbsp; &nbsp; &nbsp; &nbsp; D、其它: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;(三)随同转让的附属设施、设备 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;,若有,详见附件 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 。(固定装修不动) 第二条 &nbsp; 房屋权属情况 &nbsp; &nbsp; &nbsp;(一)房屋所有权证编号:房权证 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;区字第 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;号 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;《商品房买卖合同》登记号 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;。 权利人 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; (甲方房屋为共有房屋时,无论是否有共有权证均需提供该房屋共有权人的同意出售声明,若甲方无法提供,将承担因此产生的法律责任) &nbsp; &nbsp; &nbsp;(二)该房屋性质为下列选项中 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 情形: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;A、商品房; &nbsp;B、向社会公开销售的经济适用房; &nbsp;C、安居工程房; D、房改房; &nbsp;F、其他房屋。 &nbsp; &nbsp; &nbsp;(三)该房屋的抵押情况为: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 。 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;A、该房屋未设定抵押; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;B、该房屋已经设定抵押的,甲方应于 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 年 &nbsp; &nbsp; &nbsp;月 &nbsp; &nbsp; &nbsp;日之前办理抵押注销手续。 (四)该房屋的租赁情况为:【该房屋未出租】【该房屋已经出租】。 甲方已将该房屋出租的,需保证承租人已放弃优先购买权,并能够积极配合房屋交易过程中的评估、 房屋交验过程,若因此导致合同无法履行或被撤销,视为甲方违约。剩余租金和租期约定: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 第三条 &nbsp; 成交价格、付款方式及资金划转方式 (一) 经甲乙双方协商一致,该房屋成交价格为: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 元整(大写)(¥ &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 元)。该房价款包含该房地产所有房款及现有已缴纳和已发生之全部费用(包括但不限于天然气(管道煤气)初装费、有线电视初装费、电话初装费及入住费、专项维修基金等)。 &nbsp;乙方应于本合同签订当日将定金人民币 &nbsp; &nbsp; &nbsp;拾 &nbsp; &nbsp; &nbsp;元整(大写)(¥ &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 元)存入西宁市房屋管理行政机关指定的房屋买卖资金监管账户进行资金监管,待产权转移登记完成,资金解除监管,由监管银行自动划转到甲方银行账户。 2、甲、乙、丙三方约定: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;佰 &nbsp; &nbsp; 拾 &nbsp; 万 &nbsp; 仟 &nbsp; &nbsp;佰 &nbsp; &nbsp;拾 &nbsp; &nbsp;元整(大写)(¥ &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 元)存入西宁市房屋管理行政机关指定的房屋买卖资金监管账户进行资金监管,待乙方领取《房屋产权证》后,资金解除监管,由监管银行将全部房款自动划转到甲方银行账户。 B:甲、乙、丙三方约定: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 2、①、乙方选择【商业贷款】 【公积金贷款】 【组合贷款】申办贷款支付剩余房款 &nbsp; &nbsp; &nbsp; &nbsp;人民币 &nbsp; &nbsp;仟 &nbsp; &nbsp;佰 &nbsp; &nbsp;拾 &nbsp; &nbsp;万元整(大 写)(¥ &nbsp; &nbsp; &nbsp; &nbsp;元)。 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; ②、经办理的银行审批,乙方符合贷款条件的,贷款银行依据银行放贷规则及流程将款项一次性划至西宁市房屋管理行政机关指定的房屋买卖资金监管账户进行资金监管。 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;③、经办理贷款的银行审批,乙方因自身原因尚不符合贷款条件的,三方协商同意:选择下述 &nbsp; &nbsp; &nbsp;方式解决: &nbsp;a、自银行做出不予批贷决定之日起 &nbsp; &nbsp; &nbsp; &nbsp;日内,乙方自筹资金,按照现金支付形式向甲方付清全部房款,并承担在此期间发生的各项费用; b、乙方申请其他银行贷款,取得银行贷款后将款项支付甲方,并承担在此期间发生的各项费用; &nbsp; (注)如因国家法律或政策调整导致贷款机构未对乙方批准贷款,且乙方无法支付该房屋成交总价款的,本合同终止。甲方返还乙方累计已付购房款,甲乙双方互不承担违约责任。 C、其他约定方式: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 第四条 &nbsp; &nbsp;房屋产权及具体状况的承诺 &nbsp; &nbsp; &nbsp;1、甲方保证该房屋没有权属纠纷(此次房屋买卖行为已征得房屋共有权人、抵押权人、承租人等的同意和授权),因甲方原因造成该房屋不能办理产权登记或发生债权债务纠纷的,由甲方承担相应赔偿责任。 &nbsp; &nbsp; &nbsp;2、甲方保证已如实陈述该房屋权属状况、附属设施设备、装饰装修情况和相关物品,附件所列的该房屋附属设施设备及其装修装饰随同该房屋一并转让给乙方,乙方对甲方出售的该房屋具体状况充分了解,自愿买受该房屋。 &nbsp; &nbsp; &nbsp;3、甲方保证自本合同签订之日起至该房屋验收交接完成,对已纳入附件的各项房屋附属设施设备及其装饰装修保持良好的状况。 &nbsp; &nbsp; &nbsp;4、在房屋交付日以前发生的【物业管理费】【供暖】【水】【电】【燃气】【有线电视】【网络】: &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 费用由甲方承担,若有剩余则由乙方将剩余未用完之费用折合现金给予甲方,交付日以后(含当日)发生的费用由乙方承担。 第五条 &nbsp; &nbsp;关于税费 交易过程中,甲、乙双方应按照国家及西安市相关规定缴纳各项税、费。 1、甲、乙双方约定甲方名义之税、费按第 &nbsp; &nbsp; 种方式支付: &nbsp; 壹:甲方自行支付 &nbsp; 贰:乙方自愿代替甲方支付 2、乙方名义之税、费按第 &nbsp; &nbsp; 种方式支付: &nbsp; 壹:甲方自愿代替乙方支付 &nbsp; 贰:乙方自行支付 3、签署本合同后,如遇政府及相关部门调整税、费,对于增加部分,按第 &nbsp; &nbsp; &nbsp; 种方式 &nbsp; 支付: &nbsp; 壹:全部由甲方支付 &nbsp; 贰:全部由乙方支付 &nbsp; 叁:按照政府及相关部门规定各自支付 4、若该房地产转让价款低于房地产交易中心对于该房地产评估的价格,则甲、乙双方均 &nbsp; 同意按照房地产交易中心评估的价格为申报价支付税、费。但乙方的付款义务仍以本合 &nbsp; 同约定的转让价款为准。 第六条 &nbsp; &nbsp;房产过户手续的办理及代办费 &nbsp; &nbsp; &nbsp;1、甲、乙双方以本合同第五条约定内容履行房产过户的各项缴纳义务,同时过户当日甲方应将房屋专项维修基金过户给乙方,如甲方未交则由甲方承担此费用,未做约定的,以房地产交易主管部门的规定为准。 &nbsp; &nbsp; 2、甲、乙双方需保证所提供资料真实有效,并且积极配合丙方办理过户相关手续。 &nbsp; &nbsp; &nbsp; &nbsp; 2、在甲乙双方权属过户、申请按揭贷款过程中,为甲乙双方办理相关首付提供咨询,根据合同约定为甲乙双方联系居间方权证中心签订金融(包括但不限于代办按揭贷款、担保、资金监管业务)、房屋产权过户相关协议。 &nbsp; &nbsp; 3、若甲乙双方通过丙方办理交易环节中的金融服务(服务包含但不限于以下内容:贷款、涉及交易房款的资金借贷服务等)的,丙方应积极协助办理。若非甲乙双方中任何一方原因,因丙方操作拖延及失误等导致交易环节中的金融服务(如贷款等)未能按期成功完成,造成逾期的,则丙方应向甲乙双方(居间报酬支付方)每日支付居间报酬千分之五的滞纳金。若金融服务未成功,丙方应退还甲乙双方(居间报酬支付方)全部居间报酬服务费用。 4、协助甲乙双方办理物业交割手续。 第十一条 &nbsp;
