一、本合同适用于全日制劳动者，即在本行政区域内的企业、个体经济组织、民办非企业单位、国家机关、事业单位、社会团体和与其建立劳动关系的劳动者，在订立、履行、变更劳动合同时使用。
二、填写劳动合同第四条中劳动者岗位时，属于劳务派遣工的，一律明确填写岗位属性，即临时性岗位、辅助性岗位或替代性岗位。同时对劳务派遣工应当签订二年以上固定期限劳动合同。
三、劳动合同试用期：劳动合同期限三个月以上不满一年的，试用期不得超过一个月；劳动合同期限一年以上不满三年的，试用期不得超过二个月；劳动合同期限三年以上的，试用期不得超过六个月。
四、本合同一式三份。应由劳动者持有的一份不得由用人单位代为保管。用钢笔或签字笔填写，字迹清楚、文字简练、准确，不得涂改。

&nbsp; 根据《中华人民共和国劳动合同法》和有关法律、法规,用人单位与劳动者双方遵循合法、公平、平等自愿、协商一致、诚实信用的原则订立本合同,共同遵守本合同所列条款。
一、劳动合同双方当事人基本情况

第三条 本合同期限经双方协商一致，采取下列第 &nbsp; &nbsp; &nbsp; 种形式：

三、工作内容和工作地点
第四条 用人单位根据工作需要，安排劳动者在 &nbsp; &nbsp; &nbsp; &nbsp; 岗位工作（劳务派遣工的岗位属性为： &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; ），工作地点为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 。经双方协商同意，可以变更工作岗位。 &nbsp; &nbsp; &nbsp; [薇袇羃芀薃袇膅肃葿]

第六条 劳动者按照用人单位安排的工作内容及要求，认真履行岗位职责，按时完成工作任务，遵守用人单位依法制定的规章制度。
四、工作时间和休息休假 &nbsp; &nbsp; &nbsp; [腿莈莆蚁膈肈薁薇螅]
第七条 用人单位安排劳动者执行下列第 &nbsp; &nbsp; &nbsp;种工时制度。
（一）执行标准工时制度的，劳动者每天工作时间不超过8小时，每周工作不超过40小时。 &nbsp;
（二）执行综合计算工时工作制度的，分别以周、月、季、年等为周期综合计算工作时间，但其周期内总的实际工作时间不应超过法定标准工作时间。
（三）执行不定时工作制度的，用人单位在保障职工身体健康的基础上，应采取轮休调休、弹性工作时间等适当方式，确保职工的休息休假权利和生产、工作任务的完成。
实行综合计算工时或者不定时工时的，由用人单位报人力资源社会保障行政部门批准后执行。
第八条 用人单位依法保证劳动者的休息休假权利。
五、劳动报酬 &nbsp; &nbsp; &nbsp; [芃莃羄袄芅蒈蚀膆芈]
&nbsp; &nbsp;第九条 用人单位结合本单位的生产经营特点和经济效益，依法确定本单位的工资分配制度。劳动者的工资水平，按照本单位的工资分配制度，结合劳动者的劳动技能、劳动强度等确定，实行同工同酬。
第十条 用人单位按下列第 &nbsp; &nbsp; &nbsp; 种形式支付劳动者工资。

六、社会保险及其他保险福利待遇
第十三条 用人单位和劳动者双方按国家和青海省有关规定参加社会保险。用人单位为劳动者办理有关社会保险手续，并承担相应社会保险义务。
第十四条 劳动者在合同期内，患病、患职业病或因工负伤的按国家有关规定执行。 &nbsp; &nbsp; &nbsp; [蚂螂袁膃薅螈罿肃薇]

七、劳动保护、劳动条件和职业危害防护
第十六条 用人单位根据生产岗位的需要，按照国家有关劳动安全、卫生的规定对劳动者进行必要的培训和配备必要的安全防护措施，发放必要的劳动保护用品。
第十七条 用人单位根据国家有关法律、法规，建立安全生产制度；劳动者应当严格遵守用人单位的劳动安全制度，严禁违章作业，防止劳动过程中的事故，减少职业危害。
第十八条 用人单位违章指挥、强令冒险作业，危及劳动者人身安全的，劳动者有权拒绝。劳动者对危害生命安全和身体健康的劳动条件，有权对用人单位提出批评、检举和控告。 &nbsp; &nbsp; &nbsp; [膅肇薄羆羇蒆薄蚆芃]
八、劳动合同的履行、变更 &nbsp; &nbsp; &nbsp; [羃膁螄袂膅膄蝿羁肄]
第十九条 用人单位和劳动者双方按照本合同的约定，依法、全面履行各自的义务。
第二十条 用人单位变更名称、法定代表人、主要负责人或者投资人等事项，不影响本合同的履行。 &nbsp; &nbsp; &nbsp; [蒁螆羂薀薇羄芄蒂薂]
第二十一条 用人单位发生合并或者分立等情况，本合同继续有效，由继承其权利和义务的单位继续履行。 &nbsp; &nbsp; &nbsp; [膀薄螃螀肆薃蒂羆肂]
第二十二条 经用人单位和劳动者双方协商一致，可以变更本合同约定的内容，并以书面形式确定。
九、劳动合同的解除、终止和经济补偿
第二十三条 用人单位和劳动者双方解除、终止劳动合同，应当依照《劳动合同法》第三十六条、三十七条、三十八条、三十九条、四十条、四十一条、四十二条、四十三条、四十四条的规定执行。
第二十四条 用人单位和劳动者双方解除、终止本合同，符合《劳动合同法》第四十六条情形的，用人单位依法向劳动者支付经济补偿。
第二十五条 用人单位应当在解除或者终止本合同时，为劳动者出具解除或者终止劳动合同的证明，并在十五日内为劳动者办理档案和社会保险关系转移手续。
用人单位和劳动者应当按照双方约定，办理工作交接。应当支付经济补偿的，在办结工作交接时支付。
十、当事人约定的其他内容
第二十六条 用人单位为劳动者提供了专项培训费用，对其进行专业技术培训，双方可以订立专项协议，约定服务期，作为本合同的附件。
第二十七条 劳动者负有保密义务的，双方可以订立专项协议，约定竞业限制条款，作为本合同的附件。
第二十八条 用人单位与劳动者双方约定本合同增加以下内容：

第二十九条 用人单位和劳动者双方因履行本合同发生争议，可以协商解决。协商不成的，可以依法申请仲裁、提起诉讼。
第三十条 本合同未尽事宜按国家和青海省有关规定执行。
