根据《中华人民共和国劳动法》、《中华人民共和国劳动合同法》及其它相关法律法规的规定，甲乙双方本着自愿平等、协商一致的原则，同意签订本劳动合同，并共同遵守本合同所列条款：
第一条 &nbsp;合同期限及试用期
（一）合同期限
本合同为固定期限合同，合同期限从 &nbsp; &nbsp; &nbsp; 年 &nbsp; &nbsp; &nbsp; 月 &nbsp; &nbsp; &nbsp; 日起
至 &nbsp; &nbsp; &nbsp; 年 &nbsp; &nbsp; &nbsp;月 &nbsp; &nbsp; &nbsp;日止。
（二）试用期
试用期为一个月，从 &nbsp; &nbsp; &nbsp;年 &nbsp; 月 &nbsp; 日起至 &nbsp; &nbsp; &nbsp;年 &nbsp; 月 &nbsp; 日止。在试用期间如乙方不符合甲方的录用标准，甲方可以随时解除本劳动合同；如乙方需解除本劳动合同，必须提前三天书面通知甲方。
第二条 &nbsp;工作岗位和要求
（一） 根据甲方工作需要，乙方同意在甲方暂时安排的 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;
从事 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; 工作。
（二）在合同履行期间，鉴于甲方生产经营的特殊性以及乙方的工作能力、工作表现，甲方可以适时、合理调整乙方的工作岗位和工作区域，乙方应服从甲方的正常人事管理和工作调动安排。
（三）乙方应按甲方的要求，按时完成规定的工作数量，达到规定的质量标准，服从甲方对其工作成果的监督、考核等处理，并遵守甲方的规章制度。
第三条 &nbsp;工作时间和休息休假
（一）甲方依据我国现行的劳动法律法规安排乙方的工作时间和休息时间，乙方应服从甲方安排的工作时间和休息时间。
（二）因甲方行业的特殊性，确定乙方的工作时间为综合计算工时制。
（三）在节假日安排乙方工作的，甲方将根据考勤记录安排乙方补休同等时间或计发加班工资。
第四条 &nbsp;劳动报酬
（一）甲方根据政府有关薪资管理规定和乙方所担任的职务确定其相应的劳动报酬。具体的薪资标准为：
（1）乙方在试用期内工资为 &nbsp; &nbsp; &nbsp; &nbsp; 元/月。
（2）经甲乙双方协商一致，乙方按照甲方考核转正后，甲方对乙方实行基本工资和加班工资相结合的内部工资分配办法，乙方的基本工资确定为每月 &nbsp; &nbsp; &nbsp; &nbsp; 元/月，加班工资 &nbsp; &nbsp; &nbsp; &nbsp; 元，工资总额为 &nbsp; &nbsp; &nbsp; &nbsp; 元/月。
（3）乙方同意遵照甲方《员工手册》和《员工绩效考核管理制度》的有关规定进行考核，乙方如果连续两个月绩效考核不合格，甲方有权对其做出再培训或调岗安排。如经培训或调岗后考核仍不合格的，则甲方有权对乙方做出降薪、降职和解除劳动合同且不做任何经济补偿和赔偿。
（二）甲方以银行转账形式支付工资并按月发放，发薪日期定为每月20日，逢节假日时将顺延。
（三）甲方有权按照公司的薪资标准和考核制度合理调整乙方工资。甲方实行新的工资制度或乙方的工作岗位发生变动时，甲方可以按照公司的相关规定适时、合理地调整乙方的工资待遇。
第五条 &nbsp;劳动保护和劳动条件
（一）甲方为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品。
（二）乙方在劳动过程中必须严格遵守甲方所规定的安全操作规程。
第六条 &nbsp;劳动纪律和规章制度
（一）甲方依法根据我国现有的相关法律法规、政策制定的各项规章制度（包括《员工手册》）作为本劳动合同的附件，乙方签订本合同时，已阅知并理解甲方的各项规章制度及《员工手册》，乙方接受甲方各项规章制度（包括《员工手册》）的约束。 &nbsp; &nbsp;
（二）乙方应严格遵守甲方的各项规章制度，服从甲方的管理和指挥，按时优质完成劳动任务，提高职业技能，遵守劳动纪律和职业道德，执行劳动安全卫生规程。如乙方违反劳动纪律，甲方可依据本单位规章制度及《员工手册》，给予相应的行政处罚、经济处罚等直至解除本合同。
&nbsp; （三）乙方离职时应按照甲方的规定办理相关离职交接手续，若因此造成甲方损失的，乙方应予以足额赔偿。
第七条 &nbsp;劳动合同的变更、解除、终止、续订
（一）有下列情形之一的，甲乙双方可以变更、终止本合同：
（1）在不损害国家、集体和他人利益的情况下，双方协商一致的；
（2）本合同订立时所依据的客观情况发生了重大变化，经与乙方协商一致的；
（3）由于不可抗力的因素致使本劳动合同无法完全履行的；
（4）劳动合同订立时所依据的法律、法规已修改的；
（5）法律、法规规定的其他情形。
（二）乙方有下列情形之一的，甲方可以解除本合同：
（1）在试用期间，不符合甲方录用条件的；
（2）女员工在试用期内怀孕的；
（3）严重违反甲方规章制度的；
（4）严重失职，营私舞弊，给甲方利益造成损害的；
（5）同时与其他用人单位建立劳动关系，对完成甲方工作任务造成严重影响，或者经甲方提出，拒不改正的；
（6）以欺诈、胁迫的手段或者乘人之危，使甲方在违背真实意思的情况下订立或者变更劳动合同的；
（7）被依法追究刑事责任的。
（三）有下列情形之一的，甲方应当提前三十日以书面形式通知乙方或额外支付乙方一个月的基本工资后，可以解除本合同：
（1）乙方患病或者非因工负伤，医疗期满后不能从事原工作，也不能从事由甲方另行安排之工作的；
（2）乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的；
（四）本合同期满前，甲乙双方应提前30天协商劳动合同续订事宜，协商一致的，续签新的劳动合同。协商未成的，本合同到期后自动终止。
（五）如乙方在本合同履行期限内提出解除合同，除本合同另有约定外，甲方不向乙方承担任何补偿或者经济赔偿责任。
第九条 &nbsp;法律责任
甲乙双方应严格履行本劳动合同，任何一方违反劳动合同中约定的事项，给对方造成经济损失的，应根据损失情况和责任大小依法赔偿对方的经济损失。
第十条 &nbsp;劳动争议的处理
（一）甲乙双方发生劳动争议后，应先协商解决。协商不成的，任何一方可以自劳动争议发生之日起向有管辖权的劳动争议仲裁委员会申请仲裁。对仲裁不服的，可向人民法院提起诉讼。
（二）甲乙双方发生劳动争议期间，甲方不得有恶意处分、惩罚乙方的行为，乙方不得有故意损害甲方利益、形象的行为。
第十一条 附则
（一）本合同一式二份，甲乙双方各持一份，具有同等法律效力。
（二）本合同自双方签字盖章之日起生效。
（三）本合同未尽事宜甲乙双方可另行签订书面的补充协议。
