根据《中华人民共和国邮政法》、《中华人民共和国合同法》、《中华人民共和国消费者权益保护法》等有关法律、法规的规定，甲乙双方按照平等、自愿、公平、诚实信用的原则，就快递服务的有关事宜协商一致，签订本合同。本合同自甲方、乙方之收寄人员在快递合同上签字或盖章后成立并生效。

第一条 上门收寄或营业场所收寄
甲方可以自愿选择以下一种收寄方式：（1）乙方收寄人员到达甲方约定的地点，上门收取快件。（2）甲方直接到乙方所在办公地点，向乙方交付快件。

第二条 快递服务合同的收件人
收件人（丙方），是本合同的第三人，其名称为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; ，身份证号码（或法定代表人）为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; ，住所为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;，联系电话为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;。

第三条 快递合同寄递的快件信息
1、快件的品名为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;，快件的数量为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;（件），快件的重量 &nbsp; &nbsp; 为 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;（千克）。
2、甲方应对快件的价值进行声明，其价值为人民币 &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;（元），声明价值与实际价值应相一致。 &nbsp; &nbsp;
3、乙方提示：甲方应根据自己的需要和快件的价值，特别是贵重物品，选择保价服务。

第四条 包装的方式
1、甲方选择以下的一种方式：（□甲方自行包装；□乙方有偿包装）作为快件的封装形式。
2、乙方有偿包装，将采取如下的包装措施： &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;。

第五条 快递服务费用
1、根据甲方快件的种类，重量，寄送服务的方式等因素，甲方应向乙方支付运费人民币 &nbsp; &nbsp;（元），甲方若选择有偿包装，还应支付包装费人民币 &nbsp; &nbsp; （元）；甲方若选择保价服务，（□选择保价；□不选择保价），甲方应支付保价费人民币 &nbsp; &nbsp; （元）；其他费用的项目名称为 &nbsp; &nbsp; ，需支付该费用人民币 &nbsp; &nbsp; （元）。以上费用共计人民币 &nbsp; &nbsp; （元）。
2、甲方选择支付以上费用的方式为：□甲方当场支付；□丙方支付。注意：其中保价费的支付必须由甲方先行支付。

第六条 快递的时限
1、根据双方的约定，甲方于 &nbsp; &nbsp; 年 &nbsp; &nbsp; 月 &nbsp; &nbsp; 日（上午/下午） &nbsp; 时 &nbsp; 分将快件交付于乙方，乙方将于 &nbsp; &nbsp; 年 &nbsp; &nbsp; 月 &nbsp; &nbsp; 日（上午/下午） &nbsp; 时 &nbsp; 分或在此日期之前，将快件送达到丙方住所处。
&nbsp; 2、没有约定送达期限的，从快递服务标准。

第七条 送达
1、乙方将快件送达丙方，登记丙方有效证件号，经丙方签章，视为送达。丙方是单位的，由单位收件人员签章，加盖该单位收发章，视为送达。
2、丙方不在住所，乙方应通过与丙方沟通并取得丙方的同意，将快件寄递给丙方指定的代收人，该代收人签收后，视为送达。但合同明确约定，必须由丙方亲自签收的除外。

第八条 甲方的权利和义务
1、甲方的权利：
（1）甲方有权向乙方要求查询快件当前所处服务环节及所在位置。
（2）甲方因乙方的违约行为，受到损害，有权向乙方索赔。乙方应向甲方提供自收寄快件之日起一年内的索赔期限。
2、甲方的义务：
（1）甲方应向乙方如实告知丙方的名称或姓名，快件的名称、性质、重量、数量，收件地点等有关快递运输的必要情况。甲方不得以隐瞒、夹寄等方式寄递国家禁寄或限寄的物品。
（2）甲方选择自行包装的方式，应采取足以保护快件的措施，适于乙方进行运输。
（3）甲方支付快递服务费用的义务。在双方签订合同之后，甲方有按照约定支付运费、保价费以及其他快递服务费用的义务。若甲方选择了丙方支付的方式，则由丙方进行支付。

第九条 乙方的权利和义务
1、乙方的权利：
（1）因甲方寄递国家禁寄或限寄的快件，或者甲方采用了不适合运输的包装方式，乙方有权拒绝运输。
（2）乙方因提供快递服务，有权收取包括运费在内的相关快递服务费用。
（3）甲方或者丙方不支付运费、保管费以及其他快递服务费用的，乙方对相应的快件享有留置权，但当事人另有约定的除外。快件在快递过程中因不可抗力灭失，未收取运费的，乙方不得要求支付运费；已收取运费的，甲方可以要求返还。
&nbsp; （4）乙方对无法派送或无法退回的快件，在采取完合理措施之后，有提存的权利。
2、乙方的义务：
（1）乙方有义务将甲方交寄的快件按时、安全运输至约定的地点。
（2）乙方收取甲方的快件时，有义务询问和验视快件的性质和种类。若是法律、法规规定禁寄物品，应拒收并向寄件人说明原因；若是限寄物品，应告知寄件人处理方法及附加费用；乙方不得随意开拆已经包装好的快件，侵犯甲方的通信自由和通信秘密权。若乙方在运输过程中发现快件属于禁寄或限寄物品，应采取法律法规规定的方式进行处理。
（3）乙方有义务告知寄件人，贵重物品宜购买保价或保险服务。
（4）乙方对甲方选择自行包装的方式，有协助的义务；对甲方选择有偿包装的方式，有义务提供与包装费用相当地服务，防止快件变形、破裂，防止伤害顾客、快递服务人员或其他人，防止污染或损毁其它快件，以确保快件的质量和安全。
（5）乙方有义务向甲方提供查询快件服务，查询期为乙方收寄快件之日起一年内。
（6）乙方在将快件交付丙方时，应有义务告知丙方当面检验快件之后进行签收，不得采取“先签后验”的方式，侵害丙方的权益。
（7）乙方在提供快递服务过程中，因联系不到丙方和甲方，无法履行合同义务时，除不易保存的物品外，有义务对快件保存3个月，保存期满后，仍无法联系到丙方和甲方的，乙方可以按照相关规定提存快件或拍卖、变卖快件后，提存所得的价款。
（8）乙方在提供快递服务过程中，对甲方和丙方均有通知的义务，它们包括但不限于如下的情形：
(a)乙方有义务在投递前，主动通知丙方收取快件。
(b)若首次无法投递时，乙方应主动通知丙方再次投递的时间及联系方法；若再次仍无法投递，应通知丙方采用自取的方式，并告知丙方自取的地点和工作时间；丙方仍需要乙方投递的，应告知额外费用；
(c)若联系不到丙方，乙方应在约定的时限到达之前联系甲方，协商处理办法和费用，主要包括：甲方放弃快件的，应在乙方的放弃快件声明上签字，乙方凭函处理快件；甲方需要将快件退回的，应支付退回的费用。
(d)因不可抗力等各种原因导致快件损毁、灭失的，乙方无法履行合同的，应当及时通知甲方，以减轻可能给甲方造成的损失，并应当在合理期限内提供证明。

第十条 丙方的义务
（1）丙方在收到乙方的通知后，有义务及时提货。丙方逾期提货的，应当向乙方支付保管费。
（2）甲方选择由丙方支付快递服务费用的方式，丙方有义务进行支付。
（3）乙方交付快件予丙方时，丙方有当场检验货物的义务。验收无异议后，丙方或丙方的代收人应确认签收。

第十一条 合同的变更或解除
1、在乙方将快件交付丙方之前，甲方可以请求变更快递服务合同中如下具体内容：
（1）要求乙方变更到达地；
（2）要求乙方将快件交付给其他收件人，即变更收件人。
2、在乙方将快件交付丙方之前，甲方可以请求解除本合同。
3、甲方因上述原因，变更或解除合同的，应承担因此给乙方造成的合理损失。
4、合同解除后，本合同的争议解决方式，不受影响。

第十二条 违约责任
1、甲乙双方均应当全面履行本合同的约定，一方违约给另一方造成损失的，应当承担违约责任。
2、甲方告知不实、违规交寄、夹寄禁寄或限寄物品、隐瞒快件的真实内容或填写合同有误、遗漏重要信息，造成快件延误、无法送达或无法退还，或因甲方自行封装不善造成快件延误、毁损、灭失的，由甲方承担相应的责任。但乙方未尽询问、验视义务，协助义务的，也应承担相应的责任。
3、甲方选择由丙方支付快递服务费用的，丙方若拒绝支付或未支付全部费用的，甲方不仅应支付丙方未支付的部分，而且还应承担因此给乙方造成的其他合理损失。
4、乙方有偿代为封装的，承担因封装不善造成的延误、毁损、灭失的责任。
5、乙方在服务过程中造成快件延误、毁损、灭失的，应承担赔偿责任。具体赔偿项目如下：
&nbsp; &nbsp;（1）快件丢失赔偿应主要包括：快件发生丢失时，免除本次服务费用（不含保价等附加费用）；购买保价（保险）的快件，快递服务组织按照被保价（保险）金额进行赔偿；对于没有购买保价（保险）的快件，根据权利义务一致原则，按照《邮政法》、《合同法》等相关法律法规进行赔偿。
&nbsp; &nbsp;（2）延误的赔偿应为免除本次服务费用（不含保价等附加费用）。由于延误导致内件直接价值丧失，应按照快件丢失或损毁进行赔偿。
&nbsp; &nbsp;（3）快件损毁赔偿应主要包括：完全损毁，指快件价值完全丧失，参照快件丢失赔偿的规定执行；部分损毁，指快件价值部分丧失，依据快件丧失价值占总价值的比例，按照快件丢失赔偿额度的相同比例进行赔偿。
&nbsp; &nbsp;（4）内件不符赔偿应主要包括：内件品名与寄件人填写品名不符，按照完全损毁赔偿；内件品名相同，数量和重量不符，按照部分损毁赔偿。
6、乙方对快递过程中快件的毁损、灭失承担损害赔偿责任，但乙方证明快件的毁损、
灭失是因不可抗力（保险快件除外）、快件本身的自然性质或者合理损耗、或者寄件人、收件人的过错造成的，又或者甲方自交寄快件之日起满一年未查询又未提出赔偿要求的，不承担损害赔偿责任。
7、一方违反合同的其他约定，另一方均有权要求其赔偿因违约造成的损失；双方另有
约定的除外。

第十三条 合同争议的解决方法
本合同项下发生的争议，由双方当事人协商解决或向消费者权益保护组织投诉、向行政部门申诉；协商或调解解决不成的，按下列第 &nbsp; &nbsp; 种方式解决。
1、依法向人民法院起诉；
2、提交深圳仲裁委员会仲裁。

第十四条 本合同下列用语的含义
1、快件，是指乙方递送的信件、包裹、印刷品等。
2、声明价值，是指甲方在签订合同时对快件的主观估算的价值。
3、实际价值，是指快件本身所具有的客观价值。
4、快递服务费用，是指乙方向甲方或丙方收取的服务费用，包括运费，保价费等与快递运输有关的费用。

第十五条 &nbsp;合同未尽事宜及生效
双方可协商解除本合同。未尽事宜双方应另行以书面形式补充。
本合同一式两份，甲乙双方各执一份，具有同等法律效力，自双方签字或盖章之日起生效。
