建设工程招投标的必要性及建议 摘要：建筑工程招投标是建筑工程中最重要的流程环节直接关乎建筑工程的公开公平，并与建筑工程质量的好坏有着直接或间接的联系。因此，本文就建筑工程招投标的的利弊进行讨论，并给与一定的建议。 关键词：建筑工程；招投标；建议 1 工程招投标的必要性 1.1 工程招投标的意义、目的 工程建设实施招投标制度是目前国际上广泛使用的分派建设任务的主要交易方式。招投标制度是我国从计划经济过渡到社会主义市场经济的必要产物，其既不同于那种单纯地用行政手段分配建设任务的方法，也不同于建设单位自行寻找施工企业，把经国家批准的工程任务，自行委托施工单位的“自行联系”的方法。招投标行为，本质上是一种法律行为。招投标工作能鼓励竞争，防止垄断。在招标工作中应坚持依法办事，平等互利，协商一致，诚实信用的原则。鼓励投标单位以技术水平，管理水平，社会信誉和合理报价等优势开展竞争，不受地区、部门限制。 工程建设招投标的目的是为了适应社会主义市场经济体制的需要，是建设单位和施工企业进入建设工程市场，进行公平交易、平等竞争，从而达到确保工程质量，控制施工周期，降低工程造价，提高投资效益的目的。 我国在实行招标投标制以前, 国内的工程建设项目也有按发包制来进行的, 当时的承发包制是指一个建设单位甲方将其承担的某项目工程发包给一个施工单位乙方,但甲方和乙方不是买卖关系, 而是由有关领导部门布置任务,施工单位接受任务,不存在竟争, 这样订立出来的合同称之为计划内合同, 它是计划内经济的产物。计划合同的订立和履行有强制性, 有悖于平等互利、协商一致的合同订立原则。而招标投标制则和以上所说的承发包制是有很大的区别, 它是发生在业主和投标人承包人之间的一种平等买卖行为, 且具有商业上激烈竞争的特点, 要经过公布价格条件一开价一磋商和讨价还价一成交签订合同的过程。 1.2 招标投标的作用 建设工程实行招标投标制是适应我国社会主义市场经济的需要。招投标工作的开展, 促进了社会生产力水平的提高, 促进了社会主义市场经济体制在建设市场的建立和完善, 促进了建设者市场的统一和开放, 有利于培育和发展建设市场, 规范建设市场。自从招投标制实行以来, 取得了明显的经济效益和社会效益， 具体表现在： 1.2.1促进基本建设工作按程序办事。 根据招投标的有关规定, 工程项目的建设单位只有具备了招标条件后才能发招标通知书, 而招标条件中很大一部分工作是基本建设的准备工作, 故此有效地促进建设单位必须按基本建设程序办事, 促进施工准备工作的完善，有效地减少了“ 三边” 工程的出现。 1.2.2有利于保证和提高工程质量 招标文件中有技术规范篇, 明确提出了各项工程应达到的质量标准和验收办法。投标人不仅要尽量满足规范要求, 有时为了获得投标竞争的胜利, 还主动提出提高质量标准的措施, 既保证了工程质量, 又为今后投标打下了良好的信誉基础。 1.2.3有利于缩短施工工期，降低造价和提高投资效益 建设单位在投标书中把建设工期以合同形式固定下来, 承包人若延期误工将受罚, 提前完成了得奖, 促使承包人按时或提前完成。“ 预算超概算、决算超预算” 是工程建设实施过程中屡见不鲜的事, 其原因虽然是多方面的, 但建筑业缺乏竞争机制却是重要原因之一。实行招标承包制后, 工程造价通过各投标人投标竟争, 一般均有节余, 有的工程节余幅度还比较大, 即使有些投标报价超过标底价, 也往往由于实行招标投标制, 通过投标、开标、评标或议标和定标, 使其报价达到合理的要求, 从而为减少建设单位与施工单位双方扯皮现象的发生, 为降低工程造价, 为节约建设资金提供了条件。缩短建设工期, 可以提前投产或交付使用, 使建筑工程尽早发挥投资效益。降低工程造价,不仅可以减少建设中的资金投人,还可以减少工程投产后的贷款利息和该项工程折旧费的摊销。招投标制把竞争机制引进到建设工程管理中来, 变压力为动力, 促使各施工企业改善经营管理, 提高劳动生产率, 节约材料, 降低成本。所有这些, 既是提高投资效益的原因, 也是提高投资效益的一个方面。 1.2.4有利于促进施工企业的技术进步 招标投标制改变了企业过去向上级要任务的计划管理模式, 企业为了其自身的生存和发展, 就必须提高其竞争能力, 提高其中标率, 提高其社会信誉, 这就需要企业不仅加速自身经营管理体制和经营方式的改革, 而且还要抓企业内部的技术进步和施工队伍的全员素质, 以适应市场竞争的需要。实践证明, 企业只有不断改革经营方式, 加强内部管理的经济承包, 重视经济活动分析, 自觉地遵守基本建设程序和承包合同, 注重社会效益, 才能在激烈的市场竞争中立于不败之地。1.2.5简化工程结算手续 在实行招投标制以前, 建设单位和施工单位之间经常存在着因工程结算、预算、材料、工期、质量等问题上的相互扯皮, 有时甚至影响到工程按期投人使用, 造成一些不应有的损失。实行投标承包制后, 由于有了法律依据,标价和工程款的支付办法均按招标文件规定办理, 从而大大简化了双方的工程预算和结算手续。招投标制同时对工期、质量和材料的采购供应方式等作了明确规定, 双方责权利清楚, 互相扯皮现象显著减少。 2改进和完善现行招投标工作的办法 长期以来，我国的投资制度因透明度低、投资效益低，资金运作中腐败浪费现象时有发生。目前我国招投标中主要存在的问题有：行业管理不规范，某些从业人员素质还有待提高，行业政策、法规导向性不足等。针对这些问题，提出以下建议： 2.1 实行招标负责人终身负责制，解决串、陪标现象 作为招标一方的代表，多为建设单位的领导人，某些投资项目所用的钱都是国家的，建设工程质量的好坏，工程价款的多少和自己切身利益没有关系。从而给一些施工企业有了可乘之机。负责招标的人由于得到了种种好处，不可能对工程质量、造价问题有足够的认识，从而施工方可以邀请一些同行 ，对其实已经“内定”下来的工程进行招投标，这也是“陪标”现象的“症结”所在。本人认为，要杜绝此类问题的发生，应对招标负责人实行其对工程质量的终身负责制，如果工程质量出现问题，则可以对其进行惩罚。这样就可以预防一些行政干预的因素，避免了招标投标中的“陪标现象”。从源头上杜绝工程腐败现象的形成，减少类似虹桥的“豆腐渣”工程。 2.2提高监理成效，杜绝“转包”问题 针对当前建筑市场当中的“转包”现象，监理工程师应当充分发挥监理职能。从质和量的两个方面加以分析，确定中标人是否存在转包现象。 2.3采取新的评标办法，减少串标行为 成都市招标办根据工程类别的不同，对技术标和商务标设置不同的权重。对技术、性能没有特殊要求的市政基础设施推行现场抽签中标法： 即投标人不用做技术、商务标，只要在评标专家委员会确定的优惠幅度范围内，现场填写报价费率即可。评标办法也在开标时由投标代表现场抽签决定，这种评标办法的推行，对遏止串标起到了一定作用。2.4 加大对招标代理机构的培育和发展 利用各种业务培训的时机，加强对招标代理机构单位工作人员的法制教育和执业道德教育。必须加强对招标代理单位机构的约束，促进其规范从业。要依法加强对招投标程序和过程的监督，对招标文件的重要条款要严加掌握，防止招标人设立背离三公原则，要及时查处各种违法行为，保证招投标工作的依法进行。建议将已代理的工程项目由业主评价代理水平，纳入招标代理机构的从业水平考核范围。发挥监察局共同参与的监督职能作用，进一步规范和约束业主的行为，减少对招标代理的干扰，规范国有投资及国有投资占主导地位工程业主的行为，促进招标代理行业的有序竞争和发展。 2.5 强化行政责任追究制度，加强部门协作，加大对违法违规行为的处罚力度。 对于查出的违法违规行为，要做到违法必究，执法必严。由政府出台文件，由管理部门依据法律、法规，依法对有串标、挂靠行为查处，根据情况可停止投标人一年至二年内在建设市场的交易活动。 2.6 压证施工 完善的招投标制度应该是按照“公开、公正、公平”和诚实信用的原则，建立起统一、开放、竞争、有序的建筑市场。针对当前招投标过程中存在的问题，采取完善法规、明确职责、健全机构，强化过程监督等措施，才能更好地规范建筑市场秩序，从源头上遏止腐败，净化建筑市场，促进建筑市场秩序逐步走向规范化，法制化的轨道，不断提高工程招投标工作的质量和水平。 综上所述, 工程招投标制是建设工程实施的重要手段。无论是业主或承包商都应按基本建设程序, 完善各自的工作。在实践中, 应不断完善和改进《招标投标法》，以避免一些弊端的出现。 参考文献： 王生玉，工程招标的必要性及报价策略，青海交通科技，2000,4 张虹，浅谈工程招投标的意义及存在的问题，中国新技术产品，2011.
由于种种历史原因，招标投标制度在我国起步较晚。我国的招标投标制度发展大致经历了探索与建立、发展与规范和完善与推广3个阶段。从建国初期到1978年中国共产党十一届三中全会以前，由于我国实行的一直是计划经济体质，因为招标也曾一度被中止。在十一届三中全会以后，中国开始实行改革开放政策，计划经济体制也有所松动，相应的招标投标制度开始获得发展。但是，20世纪80年代，我国的招标投标主要侧重在宣传和实践，还处于社会主义计划经济体制下的一种探索与建立阶段。20世纪80年代中期到20世纪90年代末，我们的招标投标制度经历了试行-推广-兴起的发展过程。1984年11月，《建设工程招标投标暂行规定》的制定拉开了招标投标制度的序幕，更是在20世纪90年代初期到中后期，招标方式已经从以议标为主转变为以邀标为主。1994年，我国进口体制实行了重大改革，使得专职招标机构开始逐步向市场化的自由竞争转型，至此，我国的招标投标制度开始与国际接轨且完成了发展和规范阶段。2000年1月1日，《中华人民共和国招标投标法》正式颁布实施，标志着我国投标制度的发展进入了全新的历史阶段，我国的招标投标制度从此走上了完善的轨道。与此同时，各高校也开设了与招标投标有关的专业和课程，开始培养相关人才。我国正处于改革开放的年代，正在努力实现社会的科学发展、和谐发展。为了使我国能够实现经济增长方式根本转变，加强科技创新和资源配置能力的培养是非常必要的，而招标投标具备这一功能。因此，在现阶段推行招标投标机制具有十分重要的现实意义。
