1、房 屋 租 赁 合 同Tenancy Agreement房 屋 租 赁 合 同Tenancy Agreement一.出租人:(以下简称“甲方)Landlord: (hereinafter referred to as Party A)代表人二.承租人:(以下简称“乙方)Tenant :(hereinafter referred to as Party B)三.租赁范围及用途:Tenancy:甲方同意将其所有的位于 中国上海 室房屋及其设施(包括附 件 一 所 列 家具和电器)在良好及可租赁的状态下租给乙方居住使用租赁房屋的面积总计约 平方米。Party A hereby agrees to l

2、ease its property located at Unit , Shanghai, PRC, and the related facilities (including furniture and appliances) in good and tenantable condition to Party B for residential use. The size of the leased property is approximately m2.乙方指定物业使用者为 。The said Occant is n. 四、租赁:Term of Tenancy:4.1 租赁为 年自 年

3、月 日至 年 月 日。 The above property is hereby leased for a term of 1 year(s), mencing on and expiring on . 4.2租赁满甲方有权收回全部租赁房屋乙方应如交还。乙方如要求续租须在本合同满日前二个月向甲方提出书面申请除了双方衷诚地协议续租的年及租金外双方将按于本合约一样的条款另行签订续租合同。On expiry of the tenancy, Party A has the right to take back the entire leased property, and Party B shall

4、deliver the leased property to Party A. If Party B asks for renewing the lease, Party B shall give Party A 2 months written application in advance before the expiration date, and get the renewal agreement signed by both parties on the same terms and conditions as this Agreement save and except that

5、the Parties shall negotiate and agree on in good faith, the renewal terms and monthly rental.4.3 在租赁满十个月后乙方可以提早二个月书面甲方终止此合同,并同意甲方在此间安排潜在客户参观该物业。After the tenth month of the tenancy, the Tenant may terminate this said Agreement by giving the Landlord two (2) calendar months notice in writing, and agr

6、ee the landlord to show the apartment to potential tenant. 在乙方付清本合同项下规定其应该支付的费用后十五个工作日内全额无息将二个月保证金如数归还乙方。如乙方在已经了退房手续支付所有的费用后十五个工作日内未收到甲方归还的全额押金那么视为逾未归还押金每逾一天超出归还日后未支付乙方须按日加付租金 0.33 的滞纳金。The two months deposit shall be returned to Party B in full within 15 working days after the eck-out procedure has

If Party B did not receive the full amount of deposit after Party B has already paid all the relevant expenses within 15 working days, Party A should be liable to pay a penalty fee equal to 0.3 of the rent per day. 五、租金:Rent:5.1 双方议定租金为每月人民币 圆整包括 物业理费税金有线电视和卫星电视安装和使用费 及宽带的安装费用。The ren

8、t agreed to by both parties during the lease term is RMB per month inclusive of management fee, invoice tax, cable TV and satellite TV installation usage fee, telephone installation, broadband installation fee.5.2 乙方应提早支付甲方每月的租金应在每月的第 天或以前汇至甲方指定的银行帐支付租金日以乙方汇出日为准。乙方应以人民币形式支付租金。甲方需提供租金的付款单予乙方。Party B

9、hereunder shall pay ea months rent in advance, on or before the day of ea calendar month, by transferring the amount of su rent to a bank account designated by Party A. The date of transfer shall be the date of payment. Party A shall provide debit note on rental. 乙方须于 年 月 日或在此之前支付从 年 月 日起至 年 月 日(包括首

10、尾两日)的首租金人民币 On or before , Party B shall pay to Party A the rental for the period from to (inclusive), in the amount of RMB .5.3 如租金逾支付每逾一天超出付款日后七天仍未支付乙方须按日加付租金0.33 的滞纳金。如超过三十天15天未付那么视为乙方自动退租构成违约甲方有权收回出租房屋并追究乙方违约责任。If the rent shall be unpaid for seven (7) days after the rent shall bee due and payab

11、le, Party B shall be liable to pay a late penalty fee equal to 0.3 of the rent per day. If the rent has not been paid more than 30 15 days after the due date, Party B will be deemed to have automatically terminated the tenancy resulting in a brea of this Agreement. Party A will then be entitled to t

12、ake back the leased property and have recourse against Party B for brea of contract.六、保证金:Security Deposit:6.1 为确保租赁房屋及其设施之平安与完好及租赁内相关费用之如结算乙方应在甲方提供该租赁房屋的产权证复印件(或预售/预租容许证)支付给甲方二个月租金额及理费的租赁保证金计人民币 圆整做为乙方确保合同履行之保证金保证金的支付日不得晚于起租日。乙方可以人民币形式支付保证金。甲方应在收到保证金的七个工作日内提供相应的正式收据给乙方。To ensure the welfare and goo

13、d condition of the leased property as well as the prompt payment and settlement of all related arges during the term of the tenancy, Party B agrees to pay Party A security deposit equal to two months rent and management fee in the amount of RMB as security for Party Bs hereunder once the copy of own

14、ership certificate (or pre-sell / pre-lease permit) of the premises is provided. Party A shall provide the formal receipt to Party B within 7 working days after receiving the deposit.6.2 除合同另有约定之外甲方应于租赁满或此合同提早终止之日且双方确认该租赁房屋的归还和乙方付清所有相关费用后的十五个工作日内将保证金全额无息退还乙方。Unless otherwise provided in this Agreeme

15、nt, Party A shall return to Party B the entire security deposit without interest in 15 working days after expiration of the tenancy or early determination of this Agreement and both parties have confirmed the return of the premises and Party B has paid all related outstanding fees. 6.3 甲方因乙方违犯本合同的规定

16、而受的损失可在保证金中扣抵合理数目缺乏部乙方必须在接到甲方付款后十天内补足。Party A may deduct a reasonable amount of security deposit towards payment of any actual damages Party A shall have incurred or suffered as a result of Party Bs brea of this Agreement. If the security deposit is not sufficient to cover su amounts, Party B must p

17、ay the deficiency within 10 days of the receipt of a demand from Party A.七、其他费用:Other arges:乙方应承担租赁内的水、电、煤气、 费、宽带月租费等并按上海公共事业的帐单如缴纳。Party B is responsible for paying water, gas, electricity, telephone arges and broadband monthly fee. Su arges shall be paid when due according to the bills from Shangh

18、ai Utility Bureau therefor received by Party B. 八、出租人的责任: Landlords Obligations:8.1甲方须按时将租赁房屋以良好可租赁状态交付乙方使用。办 理 交 房 手 续 前甲乙双 方 必 须 清 查 该 物 业 及 其 内 部 所 有 设 施 的 运 行 情 况。 如 有 任 何 设 施 无 法 正 常 运 作 那么 应 被 视 为未 能 按 时 交 房 直 至 视 察 时 所 有 设 施 及 设 备 均 呈 正 常 运 作 状 况。 在 此 情 况 下 双 方 应 签 署 一 份 视察 情 况 记 录 一 式 两 份 并

19、且 作 为 本 合 同 的 一 部 分 以 示 房 屋 交 接 完 毕。Party A shall deliver on sedule to Party B the leased property in good and tenantable condition for Party Bs use. Prior to hand over both parties shall participate in a walk through inspection of the premises to inventory all facilities therein and ensure their pr

20、oper working condition. Should any of the facilities or fixtures not be in working order the hand over will be deemed inplete until su a time as they are in correct working order and inspected. The inventory / hand over inspection record will be made in dlicate and forms an integral part of this agr

21、eement.8.2租赁内甲方不得无故收回租赁房屋。(除非本合同另有规定)Party A shall not take back the leased property, without cause, during the term of the tenancy (unless otherwise stipulated in this Agreement).8.3在乙方遵守本合同的条款及支付租金的前提下乙方有权于租赁内回绝甲方或其别人扰(法律规定除外)而安静享用租赁房屋。在租赁内租客将在租开始时搬入自己的家具并在租完毕时搬出并承担此费用。该条款在合同的其他条款适用。Provided that

22、Party B paying the rent and performing and observing Party Bs terms and conditions herein contain shall peaceably hold and enjoy the leased property throughout the term of this Agreement without any interrtion by Party A or any other person save and except as required by the law of the Peoples Repub

23、lic of ina.During the leased term, furniture and goodsof the occant will bedelivered to the apartment in the beginning of the Lease Term, and taken out of the apartment, at its end by his own expense and respecting the other provisions of the Agreement.8.4 甲方应维修并保持约定之物业外墙和主体构造电力供应系统有线电缆下水道地板水和外部窗架在良

24、好及可使用状态下供居住人使用。租赁房屋的根本设施和构造(包括非乙方原因损坏的家具和电器)损坏时甲方有修缮的责任并承担有关的费用并对其作定修保。假设修缮三7天后此租赁房屋仍无法居住甲方应提供乙方一个同等于租赁房屋每日租金的房屋或酒店使用。 To maintain and keep or cause to be maintained and kept the outside building main walls of the said premises and the said building and the main structure, electricity sply cables, d

25、rains, floors, manholes, water pipes and exterior window frames of the said building at all times in a proper state of repair and condition. Party A is responsible for repairing and maintaining the basic facilities (including furniture and appliances not damaged by Party B), the structure of the lea

26、sed property and for bearing all costs related thereto. During the repair period, Party A shall provide Party B another premise or hotel at the same daily rent if the leased property is not livable after 7 days. 8.5甲方谨在此声明及保证甲方为租赁房屋的合法拥有人并有合法 地位出租此租赁房屋予乙方。就本合同及出租此租赁房屋予以乙方之事甲方已获得所有有关机构的批准包括批准及抵押权人的同意

27、(如适用)。Party A hereby represents and warrants that Party A is legal owner of the leased property and has the necessary legal capacity to lease the property to Party B. Party A has also obtained all the necessary authorizations from all relevant authorities in the Peoples Republic of ina in respect of

28、 this Agreement and the leasing of the property to Party B, including government approval and / or mortgage consent (if applicable). 8.6 如在租赁内租赁房屋发生所有权全部或部转移、和其他影响乙方权益的事情时甲方应保证所有权人或其他影响乙方权益的第三者能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者所影响或损害甲方须负责补偿乙方的所有损失、损害、支出及费用。假设甲方该租赁房屋那么乙方承诺将放弃优先购置权。If during the term

29、 of the tenancy, all or part of the leased property is transferred or Party Bs right to use leased property is affected, Party A shall ensure that su transferee or third party having an effect on Party Bs right to use the leased property will continue to abide by the terms of this Agreement. Party A

30、 shall keep Party B indemnified against any costs, expenses, losses and damages incurred to or suffered by Party B as a result of any of Party Bs interests herein are affected or prejudiced by su transferee or third party. Party B hereby agrees to give the priority of purasing if Party A sells the l

31、eased property.87 在 租 赁 间甲 方 保证 提供 乙方承 租 的 房 屋是平安的 且不会 因甲方的原因干 扰 乙 方 的 正 常 居 住。如 因甲方的原因出现 周 围 房屋 的 影 响,导 致 乙 方 不 能 居住 ,乙 方 有 权 终 止 合 约。乙方须承受并遵守物业理处之理公约.During the lease term Party A mustguarantee that Party B can live safely in the rented premises and that Party A will not disturb Party Bs regular d

32、welling . PartyBhastherighttoterminatetheagreementshouldthegeneral livingconditionssurroundingthePremisesaffectthePremisesinsu degreethatapeacefullivingcannotbeobtained. Party B shall accept and abide by all rule and regulations of the Premises management.8.8甲方应根据的税法规定负责缴纳对因乙方支付租金而可能产生所有与租赁房屋有关的一切税项

33、包括但不限于土地使用费房产税印花税营业税及企业所得税。 甲方必须在收到租金后的七个工作日内向乙方开具印有监制章的正式。如假设拖欠有关乙方有权延付租金。Party A shall be responsible to pay all taxes in respect of the leased property (including but not limited to land use fee, real estate tax, business tax, stamp duty and enterprise ine tax) in accordance with the Peoples Repu

34、blic of ina tax laws and regulations. Party A shall provide to Party B the official invoice printed under the authorization of the relevant tax bureau in the PRC within 7 working days after receiving the rental. In case Party A fails to do so, Party B shall have the right to withhold any rental paym

35、ent.8.9任何由于非乙方忽略而造成房屋内由甲方提供的如水、电、煤供应设施、供应设备或电子仪器包括空调在内的电器无法正常工作乙方应及时甲方。甲方必须维修恢复其正常使用甲方应承担由此而引起的费用。但因乙方忽略或使用不当而引起的该等保养、维修费用甲方将不负责。Should any of the services or facilities su as water, electricity and gas splies and splied meanical or electrical apparatus or appliances, including air conditioners, pro

36、vided by Party A in the Premises fail to function normally, provided that su mal-function is not the result of the improper use or the negligence of Party B. Party B shall promptly notify Party A, and Party A shall restore the normal functioning of the services and facilities and Party A shall be re

37、sponsible for the expenses incurred. But Party A shall not be responsible for maintaining and repairing the said conduits and pipelines resulting from the improper use or the negligence of Party B.九、承租人的责任Tenants Obligations:9.1乙方应按合同的规定按时支付租金保证金及其它各项应付费用。Party B shall promptly pay all rent, securit

38、y deposit and other arges payable by it in accordance with the terms of this Agreement.9.2 乙方经甲方事先同意(甲方不得无理回绝或延迟给予乙方该同意)可在租赁房屋内进展软装饰装修及添置设备。租赁满必须恢复原状正常损耗除外并承担其合理费用经甲方验收认可后归还甲方。Party B may, with the prior consent of Party A (su consent shall not be unreasonably or delayed), renovate and install addit

39、ional facilities in the leased property. on expiry of the tenancy, the leased property shall be returned to Party A in its original conditions (fair wear and tear excepted) whi is accepted by Party A, and all reasonable expenses arising therefrom shall be borne by Party B.9.3乙方应保护使用租赁房屋如因乙方的过失或过错致使租

40、赁房屋及设施受到损坏正常损耗除外乙方应负赔偿责任。Party B shall treat the leased property with care. If, as a result of party Bs negligence or misconduct, the leased property and the related facilities suffer any damage (fair wear and tear excepted), Party B shall be responsible for pensating Party A for su damages.9.4乙方应按本

41、合同的约定合法使用租赁房屋不得擅自改变使用性质不应存放法律下所制止的危险的物品如因此发生损害乙方应承担全部责任。Party B shall use the leased property legally as agreed in this Agreement and may not ange su use on its own. Party B shall not store any dangerous items whi are prohibited by the laws of the Peoples Republic of ina in the leased property and s

42、hall be fully responsible for any damages or losses as a result thereof.9.5 未经甲方事先同意乙方不得将租赁房屋转租或分租给其他的第三方乙方本人员除外。Without Party As prior consent, Party B may not assign the tenancy or sublet the leased property to a third party, save and except any associated person of Party B.9.6假设无甲方的书面同意不得在所租赁物业内饲

43、养任何宠物或动物。Not without the written consent of Party A to keep any pets or any livestock in the said premises.9.7 保持该物业非构造性部的良好状态(合理的损坏除外)包括:地板;内墙地板天花板的石灰或粉刷及甲方安装在该物业内的固定设备附件及所有的门窗电器设备电线洁具和所有设备上所列的物件。To keep in good and tenantable repair and condition (excepting fair wear and tear) the interior non-str

44、uctural part of the said premises including the flooring and interior plaster or other finishes or rendering to walls, floors and ceilings and the Landlords fixtures and fittings therein and all doors, windows, electrical installations and wiring, and sanitary and water apparatus and all other fixtu

45、res and additions thereto and the items listed in the Inventory.十、违约处理:Brea of Agreement:10.1 甲、乙任何一方如未按本合同的条款履行构成违约应承担相应的违约责任双方同意违约方应赔偿另一方之直接损失(间接和结果性损失除外)。甲方假设有违约并内未予补救乙方那么有权延付租金。If either Party A or Party B fails to perform its obligations hereunder, it shall constitute a brea of this Agreement a

46、nd the defaulting party shall undertake the liabilities for su brea. The parties agree that the party in brea shall pay the other party the direct loss and damage (excluding indirect and consequential loss and damages). If party A is in brea of this Agreement and does not rectify the said brea withi

47、n 7 days, then Party B is entitled to withhold the rent.10.2 乙方有以下行为之一的甲方有权终止本合同收回租赁房屋并且保证金不予退还。Party A shall have the right to terminate this Agreement, re-possess the leased property and forfeit the security deposit if Party B mits one of the following:(a)在未经甲方的同意下将租赁房屋擅自转租但转租给乙方本人员除外;without obtaining Party A
