11、ity of上海市排污费征收管理办法第一条(目的和依据)为做好本市排污收费工作,加强征收管理,规范征收程序,根据国务院排污费征收使用管理条例,国家发展和改革委员会、财政部、环保总局等部门排污费征收标准管理办法、排污费资金收缴使用管理办法、关于减免及缓缴排污费等有关问题的通知、关于排污费征收核定有关工作的通知等文件精神,特制定本办法。第二条(征收主体)市环保局负责本市的排污费征收管理工作,市、区(县)环保部门实行分级征收。市环保局负责征收重点污染源的排污费,即对日排1000吨以上废水的直排水体单位、接纳中心城区污水的污水处理厂和使用20蒸吨以上锅炉的单位(包括电厂)征收排污费(含污水、废气、噪声

12、等排污费)。其他污染源的排污费,由所在区(县)环保部门负责征收。具体征收工作,由市、区(县)环保部门委托所属的环境监察机构负责实施。第三条(征收对象)本市范围内直接向环境排放污染物的单位和个体工商户(以下称排污者),应按规定缴纳排污费。市环保局对本市现有污染源企业户管实行一次划定,分市、区(县)两级征管。今后凡新增企业的排污费征收户管由市环保局按照本办法第二条有关标准划分决定.市环保局负责征收排污费企业的名单附后(附件1).第四条(征收项目及标准)(一)本市环境监察机构应按下列排污费项目向排污者征收排污费:1、污水排污费.对向水体排放污染物的,按照排放污染物的种类、数量计征污水排污费;超过国家

13、和地方规定的水污染物排放标准的,按照排放污染物的种类、数量和排污费征收标准管理办法(附件2)规定的收费标准计征的收费额加一倍征收超标准排污费。污水排放纳入城市污水集中处理设施的排污者,已按规定缴纳城市污水处理费的,不再缴纳污水排污费。对城市污水集中处理设施接纳符合国家规定标准的污水,其处理后排放污水的有机污染物(化学需氧量、生化需氧量、总有机碳)、悬浮物和大肠菌群超过国家或地方排放标准的,按上述污染物的种类、数量和排污费征收标准管理办法规定的收费标准计征的收费额加一倍向城市污水集中处理设施运营单位征收污水排污费,对氨氮、总磷暂不收费。对城市污水集中处理设施达到国家和地方排放标准的水,不征收排污

14、费。2、废气排污费。对向大气排放污染物的,按照排放污染的种类、数量计征废气排污费.对机动车、飞机、船舶等流动污染源暂不征收废气排污费。3、固体废物及危险废物排污费。对没有建成工业固体废物贮存、处置设施或场所,或者工业固体废物贮存、处置设施或场所不符合环境保护标准的,按照排放污染物的种类、数量计征固体废物排污费。对以填埋方式处置危险废物不符合国务院环境保护行政主管部门规定的,按照危险废物的种类、数量计征危险废物排污费。4、噪声超标排污费.对环境噪声污染超过国家环境噪声排污标准,且干扰他人正常生活、工作和学习的,按照噪声的超标分贝数计征噪声超标排污费。对机动车、飞机、船舶等流动污染源暂不征收噪声超

15、标排污费。(二)排污费征收标准及计算办法按照国家颁布的排污费征收标准管理办法的规定执行。对国家标准中未规定的项目,本市将另行制定地方排污费收费标准。第五条(征收管理)市环保部门按月征收排污费,区(县)环保部门根据实际情况按月或按季征收排污费。各级环境监察机构具体负责排污申报登记,核定排污数量、种类,确定排污费的数额并发布公告,填制排污核定通知书和非税收入一般缴款书(电脑版本)并及时送达排污者等工作。排污者对市、区(县)环境监察机构核定的污染物排放种类、数量有异议的,自接到排污费核定通知书之日起日内,可以向发出通知的环境监察机构申请复核;环境监察机构应当自接到复核申请之日起10天内,作出复核决定

16、。排污者对复核结果仍有异议的,应当先按照复核的污染物排放种类、数量缴纳排污费,并可以依法申请行政复议或者提起行政诉讼。第六条(排污费的缴纳)排污者接到非税收入一般缴款书后,应当在指定的限缴日期前将排污费通过本单位开户银行缴入财政国库,未设银行帐户的排污者以现金方式缴纳的排污费,由负责征收的环境监察机构使用市财政局统一监制的上海市排污费专用收据收取,并于收款当日汇总填制非税收入一般缴款书(集中汇缴版本)将收取的排污费缴入同级国库。收缴排污费的环境监察机构应当根据非税收入一般缴款书回联,认真核对排污费的缴款数额,及时与国库对帐,并将非税收入一般缴款书回联与对应的“排污费缴费通知单”存根一并立卷归档

17、.第七条(违规处理)排污者在规定的期限内未足额缴纳排污费的,由负责征收的环境监察机构责令限期缴纳,并从滞纳之日起,按日计收2的滞纳金.环境监察机构自缴纳期限届满之日起7日内向排污者下达排污费限期缴纳通知书。排污者拒不按照前款规定缴纳排污费和滞纳金的,按照排污费征收使用管理条例的有关条款规定予以处罚.第八条(减免、缓缴排污费)排污者遇不可抗力遭受重大直接经济损失的,可以自遇到不可抗力之日起30日内,向征收排污费的环保部门及同级财政、价格部门提出减免缴纳排污费的书面申请。其中减免排污费数额在500万元以上的,由市财政、价格主管部门会同环保部门提出审核意见,报国务院财政、价格主管部门和环保部门审批。

18、减免排污费数额在50万元以上500万元以下(含500万元)的,由市财政、价格主管部门会同环保部门审批.减免排污费数额在50万元以下(含50万元)的,按征收管理权限,由同级财政、价格主管部门会同环保部门审批.申请减免排污费的最高限额不超过1年的排污费应缴额.经负责征收排污费的环保部门核准后,非盈利性社会公益事业单位污染物达标排放的可以免缴排污费.在申请、批复减免排污费期间或者企业经营困难处于破产、倒闭、停产、半停产状态的,排污者可以向负责征收排污费的环保部门提出缓缴排污费的书面申请。排污者申请缓缴排污费的最长期限不超过3个月.在批准缓缴后1年内不得重新申请.减免、缓缴排污费的具体审批程序按照财政

19、部、国家发展改革委、国家环保总局关于减免及缓缴排污费等有关问题的通知(附件3)规定执行。批准减免或缓缴排污费的排污者名单,由市、区(县)环保部门会同同级财政、价格主管部门每半年公告一次。第九条(入库及退库管理)排污费资金缴入国库后,国库部门负责按1:9的比例,分别缴入中央国库和地方国库。即市环保局征收的排污费收入,10缴入中央国库,作为中央级预算收入;90缴入市级国库,作为市级预算收入.区(县)环保部门征收的排污费收入,10%缴入中央国库,作为中央级预算收入;90缴入区(县)级国库,作为区(县)级预算收入。符合排污费收入退库范围需要办理退库的,由排污者提供原始缴费凭证,向执收的环境监察机构提出

20、退库申请;由区(县)环保主管部门或市环境监察总队报市环保局会同市财政局核定后送财政部驻上海财政监察专员办事处,由其按有关规定核准后,开具“收入退还书”送同级国库部门办理退库.排污者通过商业银行直接缴纳的排污费直接退付给排污者;以现金方式由执收的环境监察机构代缴的排污费,通过执收的环境监察机构退付给排污者,环境监察机构应当及时足额退付,不得截留、挤占或挪用。第十条(收费及票据管理)市、区(县)环保部门应当向同级财政、价格主管部门申领、变更登记购买证及收费许可证,并分别领取非税收入一般缴款书(电脑版本和集中汇缴版本)和购买上海市排污费专用收据。第十一条(实施日期)本办法自2003年7月1日起实施。
