6、anagement Regulations第一条为了预防、控制和消除建设项目可能产生的职业病危害, 根据中华人民共和国职业病防治法(以下称职业病防治法),制定本办法。Article 1 These Regulations are formulated for the purpose of preventing, controlling and eliminating possible occupational disease hazards caused by construction projects according to The Peoples Republic of China Oc
7、cupational Disease Prevention Law (hereinafter referred to as the Occupational Disease Prevention Law).第二条本办法所称的建设项目,是指可能产生职业病危害的新建、扩建、改建建设项目和技术改造、技术引进项目。Article 2 The construction projects referred to in these Regulations are the new, expanded, renovated construction projects and technological tran
8、sformation and technology import projects which may produce possible occupational disease hazards. 第三条可能产生职业病危害项目是指存在或产生职业病危害因素分类目录所列职业病危害因素的项目。Article 3 Projects which may cause potential occupational disease hazards refer to those where occupational disease hazards listed in the Occupational Disea
9、se Hazard Elements Categories exist or produce. 可能产生严重职业病危害的因素包括下列内容:Elements which may cause serious occupational disease hazards include the following:(一)高毒物品目录所列化学因素;(I) Chemical factors listed in the List of Highly Toxic Substances;(二)石棉纤维粉尘、含游离二氧化硅10%以上粉尘;(II)Asbestos fiber dust, dust containin
10、g more than 10% free silica;(三)放射性因素:核设施、辐照加工设备、加速器、放射治疗装置、工业探伤机、油田测井装置、甲级开放型放射性同位素工作场所和放射性物质贮存库等装置或场所;(III) Radioactive elements: devices and locations such as nuclear facilities, radiation processing equipment, accelerators, radiotherapy equipment, industrial defectoscopes, oil field well logging
11、devices, Class A open radioisotopes workplace and radioactive material storage; (四)卫生部规定的其他应列入严重职业病危害因素范围的。(IV) Other elements which should be included in the scope of serious occupational disease hazards elements provided by the Ministry of Health.第四条建设项目的备案、审核、审查和竣工验收实行分级管理。Article 4 A graded appr
12、oach shall be implemented in the filing, auditing, review and final acceptance of construction projects. 卫生部负责下列建设项目的备案、审核、审查和竣工验收:Ministry of Health is responsible for the filing, auditing, review and final acceptance of the following construction projects:(一)由国务院投资主管部门和国务院授权的有关部门审批、核准或备案,总投资在50亿人民
13、币以上的建设项目;(I) Construction projects reviewed, approved or filed by the investment authorities of the State Council and relevant departments authorized by the State Council and with a total investment of more than 5 billion yuan; (二)核设施、绝密工程等特殊性质的建设项目;(II) Construction projects of special nature such
14、as nuclear facilities, top-secret works; (三)跨省、自治区、直辖市行政区域的建设项目。(III) Construction projects crossing provinces, autonomous regions and municipalities directly under the Central Government. 其他建设项目的备案、审核、审查和竣工验收,由省级卫生行政部门根据本地区的实际情况确定。Other construction projects record, audit, review and final acceptan
15、ce are determined by the provincial-level health administrative department according to the actual conditions in the region. 第五条上级卫生行政部门可以委托下级卫生行政部门负责有关职业病危害建设项目的备案、审核、审查和竣工验收。Article 5 Higher level health administrative departments can commission the lower health administrative departments to be re
16、sponsible for the record, audit, review and final acceptance of occupational disease hazard construction projects. 第六条国家对职业病危害建设项目实行分类管理。对可能产生职业病危害的建设项目分为职业病危害轻微、职业病危害一般和职业病危害严重三类。Article 6 Classified management is implemented for occupational disease hazards construction projects. The construction
17、projects with possible occupational disease hazards are divided into projects with mild, general or serious occupational disease hazards.(一)职业病危害轻微的建设项目,其职业病危害预评价报告、控制效果评价报告应当向卫生行政部门备案;(I) For the construction projects with mild occupational disease hazards, the occupational disease hazard evaluatio
18、n report and the control effect evaluation report should be filed to the administrative department of health;(二)职业病危害一般的建设项目,其职业病危害预评价、控制效果评价应当进行审核、竣工验收;(II) For the construction projects with general occupational disease hazards, review and final acceptance should be performed for the occupational
19、disease hazard evaluation and control effect evaluation; (三)职业病危害严重的建设项目,除进行前项规定的卫生审核和竣工验收外,还应当进行设计阶段的职业病防护设施设计的卫生审查。(3) For construction projects with serious occupational disease hazards, in addition to the review and final acceptance provided in the foregoing article, the health review of the occ
20、upational health protection facility design in the design phase should also be carried out. 第七条对存在或可能产生职业病危害因素的建设项目的职业病危害评价报告实行专家审查制度。Article 7 An expert review system is executed for the occupational disease hazards evaluation report of the construction projects where occupational disease hazards e
21、xist or may produce. 卫生部和省级卫生行政部门应当分别建立国家和省级专家库,专家库按职业卫生、辐射防护、卫生工程、检测检验等专业分类,并指定机构负责管理。Ministry of Health and provincial-level health administrative departments shall establish national and provincial expert pools whose disciplines include occupational health, radiation protection, public health eng
22、ineering, inspection and testing, and an agency should be designated to be responsible for the management. 专家库专家应当熟悉职业卫生相关法律法规、具有较高的专业理论水平、实践经验和建设项目评价相关的专业背景以及良好的职业道德。专家参与建设项目职业病危害评价报告审查,应当遵循科学、客观、公正的原则,并对审查意见负责。Experts from expert pool should be familiar with occupational health related laws and re
23、gulations, and should be very professional and knowledgeable, with practical experience, construction project evaluation related professional background and good work ethic. When reviewing occupational disease hazard evaluation report, experts should follow the scientific, objective, impartial princ
24、iple and be responsible for the comments. 专家库有关规定另行制定。Expert pool related regulations will be formulated separately.第八条职业病危害预评价、职业病危害控制效果评价应当由依法取得资质的职业卫生技术服务机构承担。Article 8 Occupational disease hazard pre-evaluation and occupational disease hazard control effect evaluation shall be undertaken by qual
25、ified occupational health service organizations. 由卫生部负责备案、审核、审查和验收的建设项目,其职业病危害预评价和职业病危害控制效果评价应当由取得甲级资质的职业卫生技术服务机构承担。For the construction projects whose record, audit, review and final acceptance is responsible by the Ministry of Health, the occupational disease hazard pre-evaluation and occupational
26、 disease hazard control effect evaluation shall be undertaken by occupational health service organizations obtaining Class A certification. 第九条职业卫生技术服务机构应当依据建设项目的可行性论证报告或设计文件,按照职业卫生有关技术规范、标准进行职业病危害预评价和职业病危害控制效果评价,并出具评价报告,评价报告应当公正、客观。Article 9 Occupational health service organizations shall perform t
27、he occupational disease hazard pre-evaluation and occupational disease hazard control effect evaluation based on the construction project feasibility study report or design documents and in accordance with occupational health-related technical specifications and standards, and issue the evaluation r
28、eports which should be fair and objective.评价报告的形式根据建设项目规模和职业病危害因素的复杂程度确定。投资规模较大、职业病危害因素复杂的应当编制评价报告书,其它项目可编制评价报告表。评价报告规范另行颁布。Evaluation report forms are determined according to construction project size and complexity of occupational disease hazards. Evaluation reports shall be prepared for the proje
29、cts with a large investment and complex occupational disease hazards, and evaluation report form can be prepared for other construction projects. Evaluation report standard will be promulgated separately.第十条职业卫生服务机构应当根据建设项目是否存在严重职业病危害因素,工作场所可能存在职业病危害因素的毒理学特征、浓度(强度)、潜在危险性、接触人数、频度、时间、职业病危害防护措施和发生职业病的危
30、(风)险程度等进行综合分析后,对建设项目的职业病危害进行分类。Article 10 Occupational health service organizations shall conduct a comprehensive analysis of toxicological characteristics, concentration (intensity), potential risk, exposure people number, frequency, time, occupational disease hazard protection measures and the ris
31、k of occupational diseases as for whether occupational disease hazards exist at construction projects or possibly exist at workplaces before classifying occupational disease hazards of construction projects. 建设项目职业病危害的分类标准另行规定。The classification criteria for construction projects occupational diseas
32、e hazards will be provided separately.第十一条职业卫生技术服务机构应当组织5名以上专家,对评价报告进行技术审查。审查专家应当具有与所评价的建设项目相关的专业背景,一般由相关专业的专家和相关行业专家组成,其中从专家库抽取的专家数不少于参加审查专家总数的3/5。Article 11 Occupational health service organizations shall organize over five experts to conduct technical review of the evaluation report. Review exper
33、ts should have the professional background related to the construction project to be evaluated, generally experts of relevant professions or industries, and experts from the expert pool shall not be less than 3/5 of all experts participating in the review.卫生部审批的项目,从国家专家库抽取专家。审查专家实行回避制度,参加评价报告编制、审核人员
34、不得作为审查专家。For Ministry of Health approved projects, experts shall be drawn from national expert pool. Review experts shall comply with the challenge system, participants in the preparation and review of evaluation reports shall not be review experts. 职业卫生技术服务机构应当如实、客观地记录专家审查意见。审查意见应当由专家组全体人员签字。专家审查意见
35、、意见采纳情况及审查专家名单应当作为评价报告的附件。Occupational health service organizations shall accurately and objectively record the comments of the experts. The review comments shall be signed by all the experts. The expert review comments, adoption of the comments and the list of experts shall be annexed to the evalua
36、tion report. 对建设项目有管辖权的卫生行政部门必要时可以指派人员参加审查会并监督审查过程。Health administrative departments having jurisdiction over the construction projects will assign personnel to participate in the review meeting and supervise the review process if necessary.职业卫生技术服务机构对其作出的评价报告负责。Occupational health service organizat
37、ions are responsible for their evaluation reports.第十二条建设单位应当在建设项目可行性论证阶段,根据职业病危害因素分类目录和建设项目职业卫生专篇编制规范编写职业卫生专篇,并委托具有相应资质的职业卫生技术服务机构进行职业病危害预评价。Article 12 The construction unit shall, in the construction project feasibility study phase, prepare a chapter exclusive for occupational health according to C
38、ategories of Occupational disease hazards and Construction Project Occupational Health Chapter Preparation Standard, and entrust qualified occupational health service organization for evaluation of occupational disease hazards. 第十三条建设单位在可行性论证阶段完成建设项目职业病危害预评价报告后,应当按规定填写建设项目职业病危害预评价报告审核(备案)申请书,向有管辖权的卫
39、生行政部门提出申请并提交申报材料。Article 13 The construction units, after completing the construction project occupational disease hazard evaluation report in the feasibility study phase, should complete Construction Project Occupational disease hazard Pre-Evaluation Report Review (Record) Application and apply to the competent health administrative departments and submit the application materials.按照国家有关规定,不需要进行可行性论证的建设项目,建设单位应当在建设项目开工前提出职业病危害预评价报告的卫生审核或备案。For construction projects not requiring fea
