篇一:商品住宅实行住宅质量保证书和住宅使用说明书制度的规定ﻭﻪ 商品住宅实行住宅质量保证书和住宅使用说明书制度的规定ﻭﻪ （一九九八年五月二十日 建设部发布)ﻭ
　第一条 为加强商品住宅质量管理,确保商品住宅售后服务质量和水平,维护商品住宅消费者的合法权益，制定本规定。ﻭﻪ 第二条 本规定适用于房地产开发企业出售的商品住宅。 第三条　房地产开发企业在向用户交付销售的新建商品住宅时，必须提供《住宅质量保证书》和《住宅使用说明书》。《住宅质量保证书》可以作为商品房购销合同的补充约定。ﻭﻪ　第四条 《住宅质量保证书》是房地产开发企业对销售的商品住宅承担质量责任的法律文件，房地产开发企业应当按《住宅质量保证书》的约定，承担保修责任。ﻭﻪ 商品住宅售出后,委托物业管理公司等单位维修的,应在《住宅质量保证书》中明示所委托的单位。ﻭﻪ　第五条 《住宅质量保证书》应当包括以下内容：ﻭﻪ １、工程质量监督部门核验的质量等级;ﻭﻪ　２、地基基础和主体结构在合理使用寿命年限内承担保修;3、正常使用情况下各部位、部件保修内容与保修期:屋面防水３年；墙面、厨房和卫生间地面、地下室、管道渗漏１年;墙面、顶棚抹灰层脱落１年;地面空鼓开裂、大面积起砂１年；门窗翘裂、五金件损坏１年;管道堵塞2个月;供热、供冷系统和设备1个采暖期或供冷期；卫生洁具１年；灯具、电器开关６个月;其他部位、部件ﻭﻪ的保修期限,由房地产开发企业与用户自行约定;ﻭﻪ ４、用户报修的单位,答复和处理的时限。ﻭﻪ　第六条　住宅保修期从开发企业将竣工验收的住宅交付用户使用之日起计算,保修期限不应低于本规定第五条规定的期限。房地产开发企业可以延长保修期。
ﻪ　国家对住宅工程质量保修期另有规定的，保修期限按照国家规定执行。
第七条　房地产开发企业向用户交付商品住宅时,应当有交付验收手续,并由用户对住宅设备、设施的正常运行签字认可。用户验收后自行添置、改动的设施、设备，由用户自行承担维修责任.第八条　《住宅使用说明书》应当对住宅的结构、性能和各部位（部件)的类型、性能、标准等作出说明，并提出使用注意事项，一般应当包含以下内容:ﻭﻪ　１、开发单位、设计单位、施工单位,委托监理的应注明监理单位;ﻭﻪ　2、结构类型;
ﻪ 3、装修、装饰注意事项;ﻭﻪ　４、上水、下水、电、燃气、热力、通讯、消防等设施配置的说明；ﻭﻪ 5、有关设备、设施安装预留位置的说明和安装注意事项；６、门、窗类型,使用注意事项;ﻭﻪ ７、配电负荷;ﻭﻪ８、承重墙、保温墙、防水层、阳台等部位注意事项的说明；９、其他需说明的问题。ﻭﻪ　第九条 住宅中配置的设备、设施,生产厂家另有使用说明书的,应附于《住宅使用说明书》中。ﻭﻪ　第十条 《住宅质量保证书》和《住宅使用说明书》应在住宅交付用户的同时提供给用户。ﻭﻪ 第十一条 《住宅质量保证书》和《住宅使用说明书》以购买者购买的套(幢)发放。每套(幢)住宅均应附有各自的《住宅质量保证书》和《住宅使用说明书》.ﻭﻪ 第十二条 房地产开发企业在《住宅使用说明书》中对住户合理使用住宅应有提示。因用户使用不当或擅自改动结构、设备位置和不当装修等造成的质量问题，开发企业不承担保修责任;因住户使用不当或擅自改动结构,造成房屋质量受损或其他用户损失,由责任人承担相应责任。ﻭﻪ 　第十三条 其他住宅和非住宅的商品房屋,可参照本规定执行。 第十四条 本规定由建设部负责解释．　第十五条 本规定从199８年９月１日起实施。ﻭﻪ篇二:建设部关于印发《商品住宅实行住宅质量保证书和住宅使用说明书制度的规定》的通知ﻭ

ﻪ 一、各级建设行政(房地产)主管部门要认真组织实施《住宅质量保证书》和《住宅使用说ﻭﻪ 明书》制度,加强房地产开发企业的管理,在商品住宅销售中明确质量责任、确保商品住宅质量.ﻭ
二、房地产开发企业要结合《住宅质量保证书》和《住宅使用说明书》的实行，建立和完善ﻭﻪ 企业内部的质量管理制度,加强对施工及材料、相配＆gt；和设备采购的管理,使用优质产品，并明ﻭﻪ　确与设计、施工、监理、材料、构配二、设备供应等相关单位的质量责任.ﻭﻪ 三、《住宅质量保证书》和《住宅使用说明书》由房地产开发企业自行印制，各地建设和ﻭﻪ 房地产管理部门可以根据实际情况制定《住宅质量保证书》的样本。ﻭ
